"The mother of a teenager sexually abused by a former Pleasant Point police officer is seeking $6 million in damages from him and the tribe. Margaret Mitchell of Perry filed the lawsuit last week in U.S. District Court in Bangor less than one week after Carlos Bones, 40, was sentenced in Penobscot County Superior Court to four years in prison with all but 21/2 years suspended for sexually abusing his 14-year-old baby sitter."

"The lawsuit claims that in abusing the teenager between December 2003 and January 2004, Bones deprived the girl of her constitutional due process rights to liberty, privacy, bodily integrity and personal autonomy as protected by the Fifth and 14th amendments. On her daughter's behalf, Mitchell is seeking $5 million in compensatory and punitive damages from Bones."

Most U.S. States Don't Make the Grade When it Comes to Gun Violence Prevention Laws; Annual Ratings Warn of Risks Ahead as Federal Assault Weapons Ban Expiration Leads to More Dangerous Weapons on America's Streets, Says Brady Campaign

"Thirty-one states get a 'D' or an 'F' in measurements of the gun laws in those states, according to nationwide ratings released today by the Brady Campaign to Prevent Gun Violence united with the Million Mom March in partnership with state-based gun violence prevention organizations across the nation."

"In the eighth year of the release of the grades, only three states actually changed grades, two for the worse and one for the better. But a number of states strengthened laws linking guns and domestic violence, and others defeated the most extreme concealed weapons proposals such as allowing concealed guns in bars and schools. Overall, there is concern gun violence in some states could increase in 2005 because Congress failed to renew the federal assault weapon ban, which expired last fall, and many states with reasonable laws border on states that lack restrictions on assault weapons."

"Only five other states - California, Connecticut, Hawaii, Maryland and Massachusetts - received ratings in the A-range. Thirty-one states were given Ds and Fs."

"One of the central difficulties of the existing law concerning householders rights is that there is no legal definition of exactly what 'reasonable force' actually constitutes."

"If a householder is prosecuted, it is for the jury to decide whether the force used against an intruder was reasonable in the circumstances."

"Householders may use force if they fear for their own safety or that of their family, or to protect their property."

"But that force has to be justified by the circumstances and must not be excessive or disproportionate to the threat in other words, householders must not go 'over the top'."

"Chicago Mayor Richard Daley is repackaging his 'same old extremism' as a new plan to strip law-abiding citizens of their gun rights, and penalize retailers for crimes committed by somebody else, the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA) said today."

"Mayor Daley has proposed gun control legislation that would make it a crime to sell firearms without taking 'reasonable precautions' against their illegal use, which are impossible for a dealer to do, and allow lawsuits against gun dealers who "should have known" that a gun buyer intended to commit a crime."

"This goes beyond the ridiculous," observed CCRKBA Chairman Alan Gottlieb. "Mayor Daley not only wants to hold firearms dealers responsible for the criminal acts of people beyond their control, he now expects them to become mind readers. ..."

"For years the National Rifle Association has spent millions to spread misinformation: owning a handgun makes you safer, the Second Amendment protects an individual's right to own a gun, and meaningful firearm reform makes communities dangerous. ..."

"The truth is, the Second Amendment doesn't apply to individuals. Since 1939, the Supreme Court has found that the Second Amendment doesn't give an individual a Constitutional right to own a gun. The amendment clearly focuses on granting that right only to a 'well-regulated militia.' Even though the NRA and its powerful friends convinced former attorney general John Ashcroft to opine that it did apply to individuals, federal courts have ruled it doesn't, upholding Washington, D.C.'s handgun ban in Seegars v. Ashcroft."
