John Council's report on the Emerson case ["Ammo to Both Sides in Gun Case," Oct. 22, 2001] quotes from the specially concurring but erroneous opinion in which Judge Robert M. Parker had written:

"No doubt the special interests and academics on both sides of this debate will take great interest in the fact that at long last some court has determined (albeit in dicta) that the Second Amendment bestows an individual right.

Hamilton County Common Pleas Judge Robert P. Ruehlman's Thursday ruling (now stayed, pending appeal), which struck down as unconstitutional Ohio's ban on concealed firearms, should prompt the General Assembly to guarantee all Ohioans' right to carry guns in self-defense.

Such a guarantee is required by the Ohio Constitution, as Ruehlman's well-reasoned ruling demonstrates, and is good public policy.

The spin doctors working for anti-gun lobbyists shifted into overdrive recently -- trying to portray a resounding legal setback for their agenda as a victory.

Last October, the 5th U.S. Circuit Court of Appeals in New Orleans ruled in U.S. v. Emerson that the Second Amendment to the Constitution guarantees individuals the right to "possess and bear their own firearms...that are suitable as personal, individual weapons."

Maybe it used to seem like war, rushing to the airport, dashing to some far-off gate, worrying about flight delays and connections, about whether your carry-on would fit in the overhead.

But now America is at war, and the thousands of folks strapped into their seats each day no longer see themselves as mere passengers. They are the nation's new, unofficial militia -- a rotating band of would-be defenders, unarmed but no longer unprepared.

The death knell of Probable Cause...

A unanimous Supreme Court clarified police powers to stop vehicles if an officer has reason to suspect a crime...said that the appropriateness of a police stop must be judged on the "totality of the circumstances," in each case.

"Officers' abilities to stop potential lawbreakers should not be limited when it may become very important for us to have that," O'Connor said.

The U. could revoke its policy, it could work with lawmakers to pass a law exempting higher education campuses from the state's concealed-carry law, or colleges and universities could take the issue to court.

(KABA NOTE: Not RKBA-related, but may be of interest to many readers)

The effort to create a statue of the Flag Raising at the WTC attack site which occurred on 09/11/02 by three firefighters which is a "culturally diverse" and "politically correct" depiction which shows different people raising the flag from those who actually did so, is an atrocious affront to decency and the truth and must be over turned.

Please visit the petition site linked to above and voice your support for petitioning the City of New York to only depict the events as they occured.

Another gun control success story.

At a "gun-free" high school in "CCW-free" NYC, two students were wounded in what police say was a gang-related shooting.

If these guys had died in a car accident on the way to school, it wouldn't be national news. But let some punk break the law about 100 times taking his gun to school and you'll know in less than 10 minutes.
