Gunshots on New Year's Eve. After an already violent 2021, it was the breaking point for Democratic council members Nicole George, Pat Mulvihill and Bill Hollander.

After being bombarded with emails from community members whose property was damaged, the trio began brainstorming how to put an end to those celebratory shootings.

On Thursday, they presented their solution: Make it a crime for anyone to fire a gun in the metro.

It does include exceptions for several legal uses, including hunting, self-defense, military training, at a firing range or while target shooting.

Stand Your Ground laws in Kansas could be getting a second look this legislative session.

The law is under renewed scrutiny after Sedgwick County District Attorney Marc Bennett cited it in his decision to not press charges in the death of 17-year-old Cedric Lofton, who died while in custody.

Kansas Rep. Jo Ella Hoye is calling for hearings into the law in hopes of passing a bill this session clarifying its intent.

As New York Democrats propose cracking down on gun trafficking amid a crime wave, the area�s state senator has a different proposal.

Sen. George Borrello, R-Chautauqua County, is sponsoring a bill implementing a �Stand Your Ground� law in New York, which would remove the legal duty to retreat from a threat outside the home before using lethal force, as well as granting immunity in criminal and civil cases.

Dispatchers receive calls about people shooting in crowded urban areas on a daily basis, but police officers cannot do anything after shots are fired if there is no target, body, or damage found. According to Louisville Metro Police Department Lt. Col. Josh Judah, there were 5,756 calls of shots fired made in 2021, and 325 between New Year�s Eve and New Year�s Day alone.

�We don�t have any enforcement tool for that,� Judah said, �because right now that is not illegal.�

On Thursday Governor Kristi Noem announced a single legislation intended to eliminate taxes and fees associated with business incorporations and concealed carry permits in South Dakota.

�South Dakota is already among the most business-friendly states in America. With this action, we will make it even easier to do business here,� said Governor Noem. �We also guarantee the right of our people to keep and bear arms. It will not cost you a penny to exercise your Second Amendment rights in South Dakota.�

Rittenhouse's attorney, Mark Richards, filed a motion Jan. 19 asking prosecutors to return Rittenhouse's rifle, his ammunition, his face mask and other clothing he was wearing the night of the shooting to him. Richards and David Hancock, a spokesman for Rittenhouse, said last week that Rittenhouse wants to destroy the rifle and throw the rest of the items away so nothing can be used as a political symbol or trophy celebrating the shootings.

The motion hearing was before Judge Bruce Schroeder, the Kenosha County judge who presided over Rittenhouse's trial. Hancock said Rittenhouse would not be in court for Friday's hearing.

"San Jose�s imposition of a tax, fee, or other arbitrary cost on gun ownership is intended to suppress gun ownership without furthering any government interest. In fact, the penalties for nonpayment of the insurance and fees include seizure of the citizen�s gun," the lawsuit said. "The Ordinance is, therefore, patently unconstitutional"

The bill, which the group is attempting to strike down, will become law on July 25, six months after it was passed.

"If left intact, the City of San Jose�s Ordinance would strike at the very core of the fundamental constitutional right to keep and bear arms and defend one�s home," the gun rights group said in the lawsuit.

A three-judge panel of the Ninth Circuit Court of Appeals recently ruled that Los Angeles County�s closure of gun stores at the start of the COVID-19 pandemic was unconstitutional.

In the panel�s decision, Judge Andrew Kleinfeld wrote that the Los Angeles County order �severely burdens the core of the Second Amendment right at a time of crisis, precisely when the need to exercise that right becomes most acute.� Judges Ryan Nelson and Lawrence VanDyke concurred with Kleinfeld�s opinion.

State Senator Kevin Kinney (D) of District 39 weighs in on the recent advancement of the �Second Amendment Preservation Act.�

A Senate subcommittee recently advanced Senate File 2002 on a vote of 2-1. The bill would prohibit the enforcement of any federal gun restriction, and any law enforcement agency that attempts to enforce or aid infringement on �the people�s right to keep and bear arms� would be subject to a $50,000 civil penalty for each violation.

In November, Blair County voters � countywide and in 24 municipalities � approved referendums requiring local governing bodies to enter into an agreement forbidding use of taxpayer resources for efforts infringing on Second Amendment rights.

Commissioner Laura Burke suggested Thursday that the draft agreement prepared by the solicitors of local governing bodies, using language from the referendums on the November ballot, may be sufficient to consider for adoption.

As proposed, the draft states: �No taxpayer resources of the municipalities, whether jointly or severally, shall be used to enforce any legislation passed after Nov. 2, 2021, that would infringe upon an eligible citizen�s right to bear arms.�

Twenty-five states attorneys on Thursday called on the U.S. Supreme Court to strike down Maryland�s ban on semi-automatic weapons, including AR-15-style rifles.

In urging action, the states said that it is time for the high court to set straight how it views the Second Amendment at a time when lower courts are handing out conflicting opinions.

�This case presents the court with a unique chance to provide additional guidance to the lower courts about the scope of the individual right protected under the Second Amendment,� said the brief urging the court to take up Bianchi v. Frosh.

State Senator George Borrello has introduced legislation to eliminate the �duty to retreat� clause from New York self-defense statutes.

Under this measure, citizens who are justified in using deadly force to defend themselves would be immune from criminal and civil liability. The legislation would remove the duty to retreat in places where the defender is lawfully permitted to be. It would also direct courts to instruct juries that the duty to retreat is no longer a consideration when determining if a person used the threat of force or actual force to deter an aggressor and prevent injury or death to themselves or others.

There�s little sign that Congress is ready to adopt a national version of Ethan�s Law regulating gun storage, but overall the prospect for stronger gun safety laws is improving, Sen. Chris Murphy said Wednesday.

�This issue is heading in only one direction. It takes sometimes far longer than many of us are comfortable with for federal politics to catch up with public opinion, but it�s a matter of when � not if � the federal government finally gets to where 80 or 90 percent of where the American public is,� Murphy told listeners on a Facebook Live session.

A group of 25 Republican attorneys general has urged the Supreme Court to review a challenge brought by gun rights advocates against Maryland�s assault weapons ban.

The GOP officials� request, which came in court papers filed Wednesday, asked the court to agree to hear the challengers� appeal after losing in the lower federal courts.

At issue is a Maryland gun control law signed in 2013 that generally prohibits classes of guns deemed to be assault weapons, including AR-15-style semi-automatic rifles and some pistols. The law, known as the Firearms Safety Act of 2013, is one of the strictest in the nation.

However, insurance industry representatives have noted there are remedies within the system and that, in the vast majority of circumstances, no policy will be underwritten by actuaries to cover an illegal act. Most standard policies contain a liability exclusion for intentional and/or criminal acts and no insurance that will cover criminal acts is under development or foreseen, according to those in the personal lines insurance industry.

Insurance was just not meant to cover criminal acts, and those meant to cause harm unless there are extenuating circumstances such has a home invasion or self-defense, say personal lines experts.

First-time gun buyers accounted for 30 percent of all firearms purchases last year, according to an annual survey of retailers by the National Shooting Sports Foundation.

The 5.4 million people estimated to have bought a gun for the first-time last year represents a 10 percent decrease in first-time firearms purchasers compared to 2020, which set an all-time record for gun sale activity, said the NSSF, the Newtown-based trade association for the firearms industry.
