"...There seems to be Something infernal in this Art. But our quondam Friend Jonathan used to quote from Mat. Prior "when it is to combat Evil, Tis lawfull to employ the Devil." Nearly 260,000 Texans have a license to carry a concealed handgun, according to revised figures released this week by the Department of Public Safety. At the end of last year, 258,162 people had permits, up about 4 percent from the year before and more than double the number in 1996, when Texas law first allowed people to carry concealed weapons.

From this you see it was a premeditated act, justified by the rules of war and not depending on the firing from the houses...."

In some recent posts I have been following the "Stand your ground law", or Arkansas House Bill 1027. It's Senate counterpart SB 2 failed in committee for unknown reasons.
I called and talked with Representative Mike Burris, sponsor of HB 1027 and asked him why I keep seeing the bill being moved back further and further on the Judiciary Committee's agenda.
It was as I suspected, he is seeing resistance from numerous Prosecuting Attorneys, namely Pulaski County Prosecuting Attorney Larry Jegley.

Smith & Wesson may be best recognized as the brand of choice for Dirty Harry, the movie cop who warned punks his .44 Magnum was "the most powerful handgun in the world." But that was in 1971, and much has changed in the past 36 years.
Police officers want lighter-weight pistols than the bulky steel revolver "Dirty" Harry Callahan barely concealed under a sport coat. Soldiers need foolproof weapons that won't get jammed by the desert sands. There are guns now more powerful than the .44, and Smith & Wesson has realized it can't get by on its name--or Dirty Harry's--alone.

Cheap, available assault rifles, which closely resemble the Kalashnikov AK-47s brandished by Iraqi insurgents and African rebels alike, have become the weapons of choice for gang members and other violent criminals in Palm Beach County. Growing numbers of criminals are favoring these powerful semiautomatic weapons, which, authorities say, have greatly enhanced their capacity for indiscriminate violence. In the past six months, assault rifles have been used to maim or kill dozens, including bystanders such as a 50-year-old father of three and an 8-month-old baby.

Garth F. Bailey, of Pembroke Pines, pleaded no contest to manslaughter in 1988 for shooting his girlfriend in the head while she cooked breakfast. Eight years later, the state of Florida gave him a license to carry a gun.

John P. Paxton Jr., then of Deerfield Beach, pleaded guilty to aggravated child abuse in 1993 for grabbing his 4-year-old nephew by the neck, choking and slapping him for flicking the lights on and off. Eight years later, the state gave him a license to carry a gun.

Florida has given concealed weapon licenses to hundreds of people who wouldn't have a chance of getting them in most other states because of their criminal histories.

The nation's mayors -- including St. Paul's Chris Coleman and Minneapolis' R.T. Rybak -- are taking dead aim at the illegal firearms that fuel the carnage visited upon so many of their neighborhoods. With Democrats now controlling Congress, they stand a good chance of taking down the barriers to effective law enforcement erected by the National Rifle Association and its congressional allies.

Thirty-one more mayors from across the country have signed up for the Coalition of Mayors Against Illegal Guns since the group held a national summit in Washington on Tuesday. Mayor Bloomberg, who co-chairs the coalition with Boston Mayor Thomas Menino, said the membership spike shows "that momentum is building for our effort to crack down on illegal guns and convince state legislatures and Congress to take ideology out of law enforcement."

Some people shake their head at buying Girl Scout cookies. But an elderly woman in the far southern reaches of St. Louis shook a shotgun, police say.

They knocked on the door of one house, police say, and were told to go away. But the man rang the bell a second time -- whereupon a 78-old-woman answered the door with a shotgun in hand.

The father and daughter fled back to their home, where the father and called police.

Police say they confiscated the shotgun, described as a double-barreled 12-gauge. But prosecutors decided against filing any charges.

Introducing America’s gun owners

The right of Americans to bear arms, as stipulated in the 2nd Amendment to our Constitution, will soon get a microscopic examination as different presidential candidates establish their positions on gun ownership.

I’d like to take this opportunity to introduce the readers of this column, and by extension their candidates, to American gun owners. I won’t pretend gun owners are a homogeneous group, but it’s safe to say that a significant portion of them resemble the folks I've described below in their beliefs and actions.

"... It is well worthy of publication for the instruction of our citizens, being profound, sound, and short. Our legislators are not sufficiently apprized of the rightful limits of their power; that their true office is to declare and enforce only our natural rights* and duties, and to take none of them from us. No man has a natural right to commit aggression on the equal rights of another; and this is all from which the laws ought to restrain him...."

Volokh's bright but controversial idea--which is soon to be published in the Harvard Law Review and was recently presented at the American Enterprise Institute--is that there is a constitutional right to what he terms "medical self-defense."

The basic concept is that the government may not throw substantial obstacles in the path of medical treatments that might protect against death or serious harm.

Even before Kansas had a concealed-carry law, the 2005 Legislature tried to ensure that locals couldn't restrict gun rights more tightly than the state. Now, though, some cities are putting their own spin on concealed-carry, following the League of Kansas Municipalities’ view that cities, like other property owners, can opt not to allow concealed handguns in their workplaces and on their property.

A Pine Bluff woman charged with second degree battery following a 2005 incident in which her gun discharged during an altercation says her case illustrates why legislators should remove the requirement of Arkansas’ law that civilians retreat before they use deadly force.

Jean Painton of Pine Bluff, president of the Jefferson County Landlord’s Association, testified before the Senate Judiciary Committee on Wednesday at the state Capitol that she was charged with a criminal offense and sued in civil court for attempting to intervene with a gun to help an 11-year-old at an apartment near her office.

I am a westerner who supports the rugged individualism of the West," Richardson told a crowd of local and Las Vegas reporters he spoke to for 11 minutes before speaking to an audience of 250 for almost an hour.
