MI: Can employees have guns in their cars? Commissioners say no

In a close vote Thursday evening, Missaukee County commissioners rejected a more lenient employee gun policy.

It came down to an issue of liability, according to commissioners who voted against the proposal.

�If an employee of the county did something untoward, who is going to be responsible?� Pamela Niebrzydowski said. Even an employee acting with good intentions might injure an innocent person.

"I feel pretty strongly about this liability thing," she said.

For other commissioners, it was more personal.

They know the employee who requested a policy revision and trust him, they said.

And some commissioners were concerned about personal liberties.

"We keep whittling away at our rights," Hubert Zuiderveen said.

Florida formed a study committee after 17 students and teachers were killed, and an additional 17 were injured, at the Marjory Stoneman Douglas High School in early 2018. I read some of the MSDHS safety commission report. Unfortunately, I don�t see much good coming out of it.

This was more than a school failure; it was a political failure. More of our children will be at risk and some will die because of problems in the Florida legislature.

Sure, implement the suggestions in the report, but please don�t stop there.

The Florida Supreme Court will hear arguments March 6 in a dispute about whether a controversial 2017 change to the state�s �stand your ground� self-defense law should apply to older cases.

The 2017 change shifted a key burden of proof in �stand your ground� cases --- a shift that can play a role in determining whether people claiming self-defense should be shielded from prosecution. But appellate courts have split about whether the change should apply to defendants who were arrested before the 2017 law took effect but whose cases were pending.

Recently, two researchers disproved at least some of Emanuel�s prognostications and added to the growing body of evidence that allowing citizens the right to defend themselves with guns outside their homes can lead to a decrease in crime (see, e.g., here, here, here, and here for examples). Publishing in Applied Economics Letters, Srikant Devaraj and Pankaj Patel (from Ball State University and Villanova University, respectively) used neighborhood-level crime reports from Chicago and Philadelphia during the period January 2006 to December 2015.

Days after reclaiming the House majority, Democrats are introducing gun control legislation timed for the anniversary of the shooting of former Democratic Rep. Gabby Giffords.

Speaker Nancy Pelosi and other Democrats will introduce a bill to expand background checks for sales and transfers of firearms on Tuesday, the eighth anniversary of the day Giffords was shot in the head at a constituent meeting in Arizona.

Giffords, who co-founded a gun safety group with her husband, Mark Kelly, said in a statement Friday she was thrilled that her former House colleagues were responding to a gun-violence epidemic that killed nearly 40,000 people last year.

In fact, we should organize our entire society around everyone owning a gun, or at least the indisputable fact that many people own guns�sometimes many guns�and we often have no idea who they are or whether they are sane. Even if you choose not to participate in American gun culture, your life should be oriented around avoiding gruesome death at the hands of someone who does. We should design all of our institutions and our buildings to account for the fact that anyone could show up, at any time, to kill people with the deadly weapons they easily acquired, as this phenomenon is completely inevitable.

Cohen�s proposal illustrates that there is a significant number of people who simply do not like the work of the Founding Fathers, which should cause those who are conservative and are advocating for an Article V Constitutional Convention to change course. The same electorate that just turned control of the House of Representatives to Steve Cohen and Nancy Pelosi is the same electorate that would elect delegates to any convention considering amendments to the Constitution.

There is no question that the Electoral College would be in the crosshairs at any such constitutional convention. So would the Second Amendment.

A hearing is scheduled on January 15 in a U.S. District Court in Austin, Texas, in a federal lawsuit over the state of New Jersey's law that bars distributing digital information that could assist in making a gun to anyone in that state who is not a registered or licensed gun manufacturer.

Defense Distributed, a company founded by Cody Wilson, inventor of the first plastic 3D-printed pistol, and dedicated to distributing hardware and software aiding in home gunsmithing, is involved in a multi-front legal battle over the distribution of their digital files. In this particular case, they are insisting that the Jersey law violates "violates the First Amendment, Commerce Clause, and Supremacy Clause."

Washington on Tuesday joined a handful of other states that ban anyone under 21 from buying a semi-automatic assault rifle after voters passed a sweeping firearms measure in November that has drawn a court challenge from gun-rights advocates.

The ballot initiative seeks to curb gun violence by toughening background checks for people buying assault rifles, increasing the age limit to buy those firearms and requiring the safe storage of all guns. Only the age-limit portion of the measure goes into effect on Jan. 1; the rest becomes law on July 1.

Trump Third Circuit Judge Stephanos Bibas dissented from an opinion by two other judges in December, 2018, and argued that New Jersey�s limit on the amount of ammunition in a single firearm magazine to ten rounds, aimed at decreasing the harm caused by assault weapons in mass shootings, was unconstitutional. This was despite the fact, as Bibas acknowledged, that five other circuit courts of appeals had already upheld similar laws.

Some folks don�t realize that there is a big difference between training and practice. In training, we are learning new skills at a defensive training school or from qualified individuals. But learning those new skills is of little value if we don�t practice them after the training session. In order for those new skills to be effective, they have to become habit (No, it�s not muscle memory). You can�t perfect a new life-saving habit during two days of training, or even a week-long class.

A Jefferson County judge dismissed capital murder charges against three men for a two-year-old�s shooting death based on their claim of self-defense under Alabama�s Stand Your Ground law.

Judge Virginia Vinson issued her three-page order dismissing the charges against the three defendants saying that testimony showed they acted under a reasonable belief that they were in imminent peril when two-year old Ron�Narius Austin was shot and killed in 2017.

Austin was in the backseat of a car with his parents in Avondale when he was struck by a bullet.

Tyrone Lee, the man involved in a violent shootout at a liquor store with a woman and her daughter in 2018, pleaded guilty Friday.

Some viewers may find the surveillance video disturbing, but to others, it shows the brave response by Tina Ring and her daughter, Ashley. They fought for their lives when Lee tried to rob their liquor store with a sawed-off shotgun almost a year ago.

When not allegedly extorting businesses into retaining the services of his property-law firm, Alderman Burke is an active campaigner for and supporter of gun control. That made one item in the courthouse reporting extremely curious: The FBI found 23 guns in Alderman Burke�s office, and he was ordered to hand them over as part of his bail conditions. That is a somewhat unusual finding, especially given that Alderman Burke was the lead sponsor of a city ordinance that would require banks doing business with the City of Chicago to require their business customers to follow a number of strict gun control protocols, including prohibiting the sale of so-called �high capacity� (in practice, conventional-capacity) ammunition magazines.

New details have been released on a shooting that left a 16-year-old dead in Parramore.

Orlando police said a couple trying to sell phones killed the teen, but that it might have been in self-defense.

Officials released 911 calls in the case on Friday.

Orlando police said it was an online cell phone deal that led a married couple to shoot and kill a teenager Wednesday.

Newly-released 911 calls reveal what the couple first told police.

"Somebody robbed us and my husband was like, trying to protect us, and we ended up having to like shoot at them," a woman told a 911 dispatcher.

Every two years, we get a new Congress. That means the political terrain is changing with regards to our Second Amendment rights � at the federal level. So, as the 116th Congress is seated, it�s time to take a sober look at what the new Congress means for our rights.

The House of Representatives will be controlled by the Democrats, while the Senate will see an increased margin for the Republicans. This means that the 116th Congress will be a mixed bag for Second Amendment supporters. There will be good news and bad news for both the long-term and short-term outlooks over the next two years. Let�s take a closer look at each of the chambers.

Virginia�s governor announced Friday plans for a comprehensive package of legislation to prevent gun violence and improve the safety of Virginia�s citizens and communities.

The package includes measures to require universal background checks; establish an Extreme Risk Protective Order; reinstate Virginia�s One Handgun a Month law; prohibit individuals subject to final protective orders from possessing firearms; ban assault firearms; prevent children from accessing firearms; and require individuals to report lost or stolen firearms to law enforcement, according to a statement issued by Gov. Ralph Northam.
