NY: Keeping Guns Out of the Parks

Forty-seven United States senators recently wrote to the secretary of the interior, Dirk Kempthorne, asking him to lift the ban on carrying ready-to-fire weapons in national parks and wildlife refuges. Under current law, guns carried into or through a national park or refuge must be unloaded, taken apart, or cased in a way �that will prevent their ready use.� According to the senators� letter, this rule infringes on gun owners� rights and is �confusing, burdensome and unnecessary.� There is nothing confusing about the distinction between federal lands where hunting is allowed and national parks, where hunting is not. (Nor should someone who is confused by the difference be carrying a loaded weapon.)

On the day after he completed a one-year sentence at the Rikers Island jail, Osvaldo Hernandez walked into an Army recruiting office in Elmhurst, Queens. He was a felon with a plan to change his life.
It was late in 2003. Mr. Hernandez had been convicted of possessing an unregistered pistol the year before. The Army, struggling to meet its recruiting goals, granted him an enlistment waiver for the crime and soon swore him in.
Four years later, Mr. Hernandez, 25, is Specialist Hernandez, a paratrooper in the 82nd Airborne Division in Afghanistan.
His transformation from inmate to productive citizen would seem to be complete. His Army supervisors say he is reliable, honest and brave.

Back on December 28th, I posted on Red Pills regarding Montana�s Senator Jon Tester�s form letter in response to the concern raised by one of his constituents regarding the confirmation of Michael J. Sullivan as Director of the ATF. Senator Tester is a Democrat but was elected with the help of Montana gun owners because of his professed, �I believe in our 2nd Amendment freedoms and the right of every law-abiding American to keep and bear arms� (see below).

Now that Sen. Tester has responded with a form letter which said absolutely nothing, Montana gun owners have every right to be concerned. I certainly am of the same mind as Gary Marbut, President of the Montana Shooting Sports Association when he asked in a post-election (2006) op-ed:

Hopefully our Senators did not overlook this article over the weekend of Chief Federal Judge Mark Wolf asking our new Attorney General Michael Mukasey to crack down on misconduct and to force Michael J. Sullivan's staff to tell be truthful in court. Sullivan who is currently serving as Acting Director of the ATF and awaiting confirmation by the Senate; is also still serving as US Attorney for the District of Massachusetts.

Sullivan's office has been criticized numerous times by Judges, so which continues to beg the question: Is it wise to confirm a director who's office has been charged with misconduct and lying, to head an federal agency which is notorious for misconduct and lying?

Your rant, filled with the typical paranoiac distortions so many gun owners have in the US, confirms openly everything I imply in my article: that guns make people more aggressive, more liable to lose their temper, less rational and it often turns them into boorish bullies who hide behind their anger, mean spiritedness and fear to intimidate others.

GeorgiaCarry.org and Cherokee County Probate Judge Kipling McVay have resolved a federal lawsuit brought by GeorgiaCarry.org and member Rebecca Breed over Judge McVay�s practice of requiring SSNs of Georgia Firearms License applicants.

In the settlement, Judge McVay will be ordered by the federal court not to request SSNs of GFL applicants and to expunge from her records the SSNs of GCO members.

GeorgiaCarro.org has reached a settlement with the Cobb County Probate Court in a lawsuit brought by GCO in federal court over the requirement to provide SSNs when applying for a Georgia Firearms License. In the terms of the settlement, Cobb County will be prohibited from requesting SSNs of any applicant, will be required to expunge GCO members� SSNs from their records, and will be required to pay GCO�s attorney�s fees.

Calling it "a core fundamental issue" for his group this year, the head of the National Rifle Association lobbied hard Monday for a bill that would allow employees to keep handguns in their cars at work. NRA Executive President Wayne LaPierre made a rare appearance under the Gold Dome Monday, a week before the Legislature convenes, to push the bill with key lawmakers.

Many have received the following letter from the NRA-ILA Executive Director Chris Cox to Acting BATFE Director Michael J. Sullivan. They have also received an e-mail response. Chris Cox had earlier submitted a letter to the National Ombudsman as well, regarding the ATF shutting firearms dealers down.

Although it does not oppose Sullivan, it does not support him either! Many elected officials offices that I have spoken with repeatedly ask..."What does the NRA say?" They believe that if the NRA has not voiced opposition to Sullivan then they do not have a problem with him.

The NRA letter touches on many of the major issues of abuse that the ATF have been committing.

In its brief, the District forwards three different arguments; they appear to me to be nested, in that if the first argument fails, the second may withstand scrutiny, and so on. These arguments/sections are as follows:

1) The Second Amendment Protects Only Militia-Related Firearm Rights.

2) The Second Amendment Does Not Apply to Laws Limited to the District of Columbia.

3) The District's Reasonable Gun-Control Laws Do Not Infringe The Right to Keep and Bear Arms.

NY: Police Officer Faces Federal Charges

A city police officer who was arrested last month on charges of raping a 14-year-old girl was charged in federal court on Monday with bringing her and a second teenage girl across state lines to engage in illegal sex, officials said. The officer, Trent Young, 39, had been a martial arts instructor to both victims and, on separate occasions in 2006 and 2007, took them from his hometown, Middletown, N.Y., to his martial arts school in New Jersey, according to a statement by the United States attorney�s office in Manhattan. ... The second girl came forward on Jan. 3, according to a federal compliant. ... Officer Young�s lawyer, Gary Greenwald, said, �His defense is it never happened.�

"When we first talked about it, I had a hard time with it," said Maldony, a rifle hunter who said he sometimes shoots a bow and arrow for fun. "But after I thought about it, I thought it would be crazy not to have it. It's just one child stepping in front of an errant arrow to have a whole lot of pain in the borough."

Borough council on Monday adopted an ordinance that counts bows among items that can't be shot near homes.

The ordinance considers compound bows, crossbows, air guns, spring-loaded guns and slingshots the same as firearms: They can be shot only in self-defense, while hunting or with permission from everyone who lives within 50 yards.

A 7-Eleven clerk was justified in shooting a knife-wielding robber on Christmas, Allegheny County District Attorney Stephen A. Zappala Jr. said Monday.

Kaelin Weber, 24, shot Lawrence Davis, 20, at the Ingram convenience store after Davis jumped the counter and slashed him.

"The actions of the clerk, including the use of a firearm, were justified and therefore the clerk will not face any criminal charges related to this incident," a release from Zappala's office stated.

Violent crime has increased in Australia, Canada and Great Britain following adoption of legislation restricting firearms. Contrast this with the fact that gun ownership U.S. citizens is at an all-time high, and "right-to-carry" laws have been implemented in 40 states. And violent crimes have fallen dramatically. The most flagrant exception to this trend is in Washington (murder capital of the U.S.) and New York City, where you have the most restrictive "gun control" laws in the country.

Yes, our Founding Fathers knew exactly what they were doing when they wrote the Second Amendment.

Authorities believe Bass, 21-year-old Jonathan Bruce and a third person who remains at large went into a mobile home at 25 Red Oak Drive in Warren County on Dec. 30 with intent to commit robbery. A teen who lived in the mobile home shot and killed Bruce in apparent self-defense.

"This is not an allegation of Bass actually pulling the trigger," Pace said of the charges. "He is being charged for willfully participating in a felony act in which someone was killed."

On the Republican side, former New York Mayor Rudy Giuliani and Senator John McCain led the polls one year ago. As I and many other Second Amendment defenders have detailed throughout the past year, both candidates have serious flaws in their records that should raise warning flags for gun owners. Former Massachusetts Governor Mitt Romney's deep campaign pockets helped pull him into front-runner status by summer of 2007, but gun owners' worries only deepened - Romney too has an anti-gun record.

The anti-gunners of the Loony Left have painted themselves into a corner with their court case. By taking an appeal all the way to the United States Supreme Court, and basing an argument on the interpretation of a key tenet of the Constitution, the anti-gun crowd in DC Metro Government has opened to door for their own demise. How? According to the very Constitution that they are attempting to redefine, there is no such thing as a DC Metro Government.

Nearly a dozen members of a police SWAT team in western Colorado punched a hole in the front door and invaded a family's home with guns drawn, demanding that an 11-year-old boy who had had an accidental fall accompany them to the hospital, on the order of Garfield County Magistrate Lain Leoniak.

The boy's parents and siblings were thrown to the floor at gunpoint and the parents were handcuffed in the weekend assault, and the boy's father told WND it was all because a paramedic was upset the family preferred to care for their son themselves.

I've been meaning to make a comment about a post at Joe Huffman's, that I found out about at Jed's.

It seems this BATFU character Tom Mangan is abusing his position to insert agenda-driven editorial comments into what should be straight news stories, and the "Authorized Journalists" are more than happy to let him get away with it. That the bureau under "Maximum Mike" hasn't reined in his shameless self promotion can only mean it serves Sullivan's purposes.

Maybe Mangan's interested in advancing in the ranks after the presidential elections, or bucking for a position over at Crime Gun Solutions/AHSA if things don't work out...?

Let's hope it's the latter.
