CA: Federal judge again rules that California's ban on assault weapons is unconstitutional

The lawsuit filed by the San Diego County Gun Owners Political Action Committee, California Gun Rights Foundation, Second Amendment Foundation and Firearms Policy Coalition is among several by gun advocacy groups challenging California's firearms laws, which are among the strictest in the nation.

It was filed on behalf of gun owners who want to use high-capacity magazines in their legal rifles or pistols, but said they can't because doing so would turn them into illegal assault weapons under California law. Unlike military weapons, the semi-automatic rifles fire one bullet each time the trigger is pulled, and the plaintiffs say they are legal in 41 states.

Murder charges were dismissed Friday against a Portsmouth man who claims he fatally shot another man in self-defense.

District Court Judge Douglas Ottinger ruled at the end of a preliminary hearing there was insufficient evidence to send the case against Will Patterson Sr. to a grand jury, according to defense attorney Michael Massie. Patterson, 45, had faced a second-degree murder charge and two related firearm counts.

I'm pretty skeptical about the 90-day waiting period, both because it does seem substantive "lengthy" but also because it seems hard to justify as a means "to ensure only that those bearing arms in the jurisdiction are, in fact, 'law-abiding, responsible citizens.'" The $150 fee is a closer call, and its validity might turn on whether the state can show that the fee is "the purpose of charging the fee is limited to defraying expenses incurred in furtherance of a legitimate state interest" of processing the applications to make sure that applicants aren't felons or otherwise disqualified, and that they have taken the necessary training. In any case, I expect much more such litigation in coming years.

U.S. District Judge Brian Wimes in a March ruling invalidated the law as a violation of the supremacy clause.

While purporting to protect citizens, (the Missouri law) exposes citizens to greater harm by interfering with the federal governments ability to enforce lawfully enacted firearms regulations designed by Congress for the purpose of protecting citizens, Wimes wrote.

The St. Louis-based 8th U.S. Circuit Court of Appeals in September declined to halt the judges ruling, prompting Missouri officials to seek emergency relief from the Supreme Court.

Governor Dikko Radda of Katsina State has called for reforms to allow civilians to purchase firearms for self-protection, similar to how bandits have access to weapons. He made this statement during a media chat in Abuja, stressing that people should be able to defend themselves when criminals possess firearms.

Radda expressed the need to balance this approach, emphasizing that citizens have the numbers, zeal, and determination to protect themselves. He cited the example of the Civilian Joint Task Force (CJTF) in Borno, who are supported by the police and the military when going on missions.

Colorados law is not just a waiting period on the right to possess peaceably purchased property. It is a delay on safety itself. On October 1st, Colorados new 3-day waiting period law went into effect as passed by the states legislature and Governor Jared Polis, requiring those who purchase a firearm to wait three days before acquiring the gun. That is, once a citizen has passed a federal background check, a state background check, and paid for a firearm upfront, the government then mandates an additional 72-hour delay prior to taking possession of a firearm.

New regulations that require state-conducted background checks for gun and ammunition buyers in New York state recently left one area resident in the lurch.

The individual? Chautauqua County Sheriff James Quattrone.

On Sept. 22, I attempted to purchase two boxes of shotgun shells at a local sports store, Quattrone told The Post-Journal. These shells were to be used at a trap/skeet shoot that I was sponsoring to raise funds for a new nonprofit organization.

Court cases continue with rulings pending in the Seventh U.S. Circuit Court of Appeals on Second Amendment challenges and in the Southern District of Illinois federal court with a vagueness challenge.

If time goes on and the gun ban is eventually struck down, people start submitting these affidavits or whatever else, what happens to all that information, Plummer said.

A separate bill from state Rep. Amy Elik, R-Alton, would require state police to destroy gun registry records if the law is struck down by the courts.

Plummer said with that prospect still out there, the state should pump the breaks.

A recent shootout at an apartment complex in east Houston has brought to light the potential dangers and legal implications surrounding the use of firearms to protect personal property.

On a late Wednesday night around 10:30 p.m., at an apartment complex in East Houston, a man noticed an individual attempting to break into his car. In an effort to halt the burglary, the car owner armed himself and confronted the suspect. The situation rapidly escalated as the burglar was also armed. A shootout ensued between the two, and luckily, only the burglar was shot.

The Seattle-area homeowner was perhaps clued in that he was going to become a victim of crime when the thugs on his front porch started kicking in his door. Or maybe it was the moment a gun-wielding member of the criminal gang announced he was with Seattle Police. Either way, thats when the shooting started.

What is optic offset? Simply put, a sighting system will never be 100 percent in line with the bore the only way that would be possible is if our line of sight was from the bullets point of view, which is down the barrel. This is one reason why many prefer their optic mounted as low as possible (there are other benefits, too, like better recoil mitigation, a more natural point-of-aim (POA) which well get to later and an increased target-acquisition speed).

If the past three years have taught us anything, its that the guy in the White House has some pretty radical views on the Second Amendment. So when his sons attorney declared (with a straight face!) that his client will probably beat the gun charges against him because they are likely unconstitutional, it might be time to check if youve arrived in the alternate universe of hypocrisy.

MO: Supreme Court refuses to reinstate Missouri Second Amendment law

The Supreme Court on Friday refused a request by Missouri to reinstate a state law that bars police officers from enforcing federal restrictions on the sale and ownership of firearms that the state believes violate the Second Amendment. A federal judge ruled earlier this year that the state law is itself unconstitutional and blocked the state from enforcing the law. In an unsigned order on Friday, the justices left that decision in place while the states appeal continues in the lower courts.

Justice Clarence Thomas indicated that he would have granted Missouris request, while two of his colleagues Justices Samuel Alito and Neil Gorsuch wrote separately to clarify their understanding of the scope of the lower courts order.

GA: Bruen test is out of step and unworkable in practice, hopeful SCOTUS will provide guidance on evaluating future firearms restrictions

The case U.S. v. Rahimi is the first opportunity since New York State Rifle & Pistol Association, Inc. v. Bruen for the U.S. Supreme Court to consider its application to a firearms restriction. I am particularly interested to see if the Supreme Court takes the opportunity to refine or reformulate the Bruen test in a manner that makes it somewhat easier for the federal and state governments to craft sensible firearms restrictions. I am hopeful for the Supreme Court to do so because the Bruen test is out of step with the rest of constitutional law and is unworkable in practice.

Wong asserted his beliefs in a press release on Thursday, stating that the bill will do nothing to reduce crime. Wong also expressed his feeling that it will have a negative impact on lawful gun owners in Massachusetts by infringing on their Second Amendment rights.

Massachusetts already has some of the strictest firearm laws in the country, along with the lowest rate of deaths associated with gun violence, Wong said in the press release. The vast majority of gun-related crimes are committed with illegal weapons and not with legally owned firearms.

How do you convince a bunch of civilians that they need to keep buying new guns?

In Episode 3 of "The Gun Machine," host Alain Stephens talks about the man who wrote that playbook: Samuel Colt. He also helped seed the fantastical version of the American West that is often misremembered as fact today.

Jose Luis Meneses, a Mexican national who worked as an investigator for ATF at the U.S. Consulate in Tijuana, admitted to buying firearm parts online and at a California gun store and trafficking them into Mexico for profit back in 2017, according to the letter and an ATF memo from the time obtained by Reuters.

The case has not been previously reported.

The trafficking of U.S. weapons south across the border is a top diplomatic issue in Mexico. Mexican officials accuse their American counterparts of not doing enough to stanch the illegal flow of these guns, which they say help arm drug cartels and contribute to the countrys high homicide rate.
