MI: Polling places prepare as ban on open carry on Election Day brings mixed reactions

While hundreds of thousands of Michigan voters have already cast their ballots by mail, preparations are underway now at physical polling places.

Michigan�s secretary of state recently announced a ban on open carrying firearms at polling places on Election Day, which has had mixed reactions.

The guidance announced last week really isn�t new, according to a veteran election law attorney. It states you can�t open carry a gun within 100 feet of a polling place. And in previous elections, this has never been an issue for police.

�Many of the polling places you know are gun free zones anyway. They�re in churches, they�re in schools," said John Pirich, an election law attorney.

The manager and employee at a Detroit business were able to stop an attempted robbery Tuesday afternoon.

Police say three suspects attempted to rob a local business in the 9500 block of Dexter. The suspects entered the store and assaulted an employee. The business's owner, a 47-year-old man, saw what was happening and produced a weapon. Police say both victims then fired shots at the three suspects, striking two of them. One suspect is still at large. The other two were arrested and treated at a local hospital.

This is a preliminary investigation.

A deadly shooting left a man fatally wounded after a basketball game Tuesday.

Roseville police say a fight at Midwest Athletics Basketball City at 1640 Eastland Street, led to a man leaving and coming back with a gun. When he pointed the firearm at the person he had fought with, a second man with a valid concealed pistol license, intervened. After an exchange of gunfire, police say the suspect was seriously injured and was pronounced dead at the scene just before 6 p.m. Tuesday.

"At this time, it appears a valid CPL holder intervened. After a brief exchange of gunfire, the individual who left the building was seriously injured and was eventually pronounced deceased at the scene."

Attorneys working on a court challenge to the secretary of state�s ban on open carry guns at the polls say they will file it Thursday morning.

Attorney Dean Greenblatt tells 7 Action News this is similar to the constitutional and separation of powers legal challenge that went all the way to the Michigan Supreme Court over Gov. Gretchen Whitmer's COVID-19 executive orders.

That ruling struck down the law behind those and the court ruled the orders were null and void going back to April. They have been reissued by state agencies controlled by the governor and are in effect.

Michigan Secretary of State Jocelyn Benson says she and the Michigan attorney general have determined Benson has the power to issue the ban.

The Project Appleseed rifle marksmanship clinic will be held on Oct. 31-Nov 1 at Arnold Air Force Base, at Rifle Range Rd.

Registration begins at 8 a.m. The clinic starts at 8:30 a.m. and will continue until 5 p.m.

Participants are taught fundamental rifle marksmanship skills that are to allow a rifleman to be accurate out to 400 yards, with iron sights or a scope, a standard rifle and surplus ammo. Most of the instruction at a Project Appleseed event is conducted on the firing range at 25 yards, at reduced size targets to simulate 100 to 400 yards.

Students will learn rifle shooting from the standing, sitting, kneeling, and prone positions, sight alignment, and breath control, along with safe gun handling...

After review by the Roseville Police Department and Macomb County Prosecutor�s Office, the concealed pistol license holder, who was taken into custody following an altercation at an athletic facility, that led to a man being fatally shot, has been released, according to police.

The case is still under investigation and police are now seeking statements from anyone who might have witnessed the incident.

It happened Tuesday night.

Roseville police were called to Midwest Athletics/Basketball City at 5:45 p.m. after a caller reported a shooting. When they arrived, authorities learned the shooting was the result of a dispute that originated during a basketball game.

New Mexico has to be very vexing for Second Amendment supporters. In a region of the country where the Second Amendment is largely respected, it constantly elects anti-Second Amendment extremists to the United States Senate. It�s frustrating in the extreme. But could this be turned around?

There is a better chance than you might think. After all, Governors Gary Johnston and Susanna Martinez were supporters of our Second Amendment rights, and Martinez was in office until January of last year. Even Bill Richardson, a Democrat, signed concealed-carry legislation. So, it is possible that a Second Amendment supporter could win a statewide race.

One of President Trump's most consequential actions has been the appointment of Originalist and Textualist judges on the Article III courts. Judge Amy Coney Barret is the latest example. She is likely to make a critical difference for the Second Amendment on the Supreme Court.

That will come to a halt if the Republicans lose control of the Senate, starting with Arizona.

A couple of weeks ago, Staunton City Council voted to have a public hearing for residents to come out and share their thoughts on the second amendment.

WHSV spoke with Mayor Andrea Oakes on Wednesday and she said this is an opportunity for everyone�s voice to be heard.

�This is about allowing people to practice their first amendment right to speak concerning the second amendment,� said Oakes.

The meeting is set to take place on Oct. 29 at 6 p.m. Residents can participate in the meeting virtually, over the phone or in person.

While much of our politics in this unusual year have become murkier, this year has produced one clear loser: gun control.

It may seem counterintuitive with Democrats fielding the most anti-Second Amendment presidential ticket of all time, but gun control groups and activists are falling short across the political landscape. Even in a political environment favoring Democrats in November, the gun control movement has failed to get any traction.

Every four years you hear people talking about this being the �most important election ever,� or some such. I don�t actually buy that; every election is important. I will grant that this one has a distinctly different feel to it, and one (only one) of the reasons I think this is so is because it�s been a while since gun ownership has been a visible talking point among the candidates.

Is your real estate agent packing? Not filling boxes to help you move, but �packing heat� � as in carrying a gun?

Many agents are doing just that these days to protect themselves when showing houses to complete strangers, or listing houses for sellers they aren�t familiar with, according to the National Association of Realtors.
 

It�s legal to bring guns to the polls in many swing states. What could go wrong?

Within the space of 12 hours on Election Day 2016, the Election Protection hotline received calls from 85 voters in 28 states who reported seeing guns at the polls. This year, that threat is heightened. Gun sales have skyrocketed to all-time highs during the pandemic, especially among first-time owners. The line between poll watching and voter intimidation has blurred, as Republicans are officially conscripting citizens for an �Army for Trump,� and there�s been a rise in the activity of armed, far-right gangs that have already brandished semiautomatic weapons at protests this year.

I have not seen a run on ammunition like the one at the time of this writing in my lifetime. Those of us who have been in this game remember 2013, the last notable ammo shortage. Even that paled in comparison to what we are currently seeing. Ammo in the main calibers is simply scarce and when you find it you will pay very inflated prices for it. Therefore, most of us will be doing far less shooting than usual.

In the state of Nebraska, we follow what is known as the Castle Doctrine, which means a person has a �duty to retreat.�

Nebraska Law says a person threatened has a duty to retreat if it is safe to do so but that does not include at your home or workplace. If you are home and your house gets broken into or you�re attacked in your workplace parking lot, you have the right to defend yourself.

A Georgia man was arrested Tuesday on robbery, assault and kidnapping charges after being shot by a store clerk�s husband during a hold-up, according to Johnson City police.

The shooting, which police described as self-defense, happened at Scotchman, 1101 E. Unaka Ave., around 10:15 p.m.
