MI: Gun groups sue to stop Secretary of State Benson's open carry ban at polling places

Advocates disgruntled by a recent ban on the open carry of firearms near polling locations have sued in Michigan's Court of Claims to stop it.

The lawsuit filed Thursday by Michigan Open Carry, Michigan Gun Owners and Michigan Coalition for Responsible Gun Owners argues that Secretary of State Jocelyn Benson's order banning open carry near polling places conflicts with state law, conflates open carry with voter intimidation and "is conjured without any legal basis or authorization under Michigan law."

The edict creates an ultimatum, the lawsuit said: Either individuals give up a 2nd Amendment right to bear arms for self-protection or give up their right to vote.

�A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.� The Second Amendment and other freedoms spelled out in the U.S. Constitution were intended to calm fears that the new government could engage in tyranny. Some legal scholars believe the amendment was meant to protect the right of states to use militias for self-defense, but the U.S. Supreme Court has ruled that the Second Amendment establishes gun ownership rights for private citizens.

The political division in this country is Grand Canyon-esque in size and scope, and it would be impossible to build a bridge that could overcome that gap. Let�s face it, half of our country wants to usher in global socialism, while the other half wants nationalistic capitalism. Half of the country wants government controls over every aspect of your life, while the other half values the individual rights, freedom and liberty that were envisioned by the Founding Fathers. One half wants to ban guns, while the other half wants the freedom to bear arms that is guaranteed by the Second Amendment. One half wants to defund the police, while the other half wants to ensure law and order.

On 23 September 2020, Judge Roger T. Benitez issued another impressive order in a case involving the Second Amendment.

A number of California residents, firearm businesses, special interest groups, foundations, and a political action committee have organized to sue California AG Xavier Becerra et al, to challenge the constitutionality of California's complex net of regulations for the ownership and use of various firearms the state deems to be �assault weapons�. The lawsuit has been winding its way through the federal legal system in the Ninth Circuit.

Probably the first inclination that something bad is about to happen is when some crook gets in your face with a gun or other weapon. An investigation is underway to determine if a 26-year-old Pontiac man acted in self-defense when he fatally shot a 34-year-old man at a party store in the city Thursday night after being physically attacked.

According to the Oakland County Sheriff�s Office, it was shortly before 11 p.m. when deputies and Star EMS responded to the Huron Liquor Shoppe at 140 E. Huron Street on a report that someone had been shot.

But officials now say the causal connection between the fight and Weaver's death is unclear.

The county's top prosecutor, DA Matthew Rogers, said an autopsy of Weaver was unable to determine whether the fight led to Weaver's death or whether it was caused by other factors.

Rogers said the exact nature of the fight between the two men is unclear, "specifically as to whether either Chavez or Weaver acted in self-defense."

In another sign that the controversy over guards seen at a St. Petersburg early voting site is far from dying down, several civil rights and voting rights organizations sent a letter to the Pinellas County sheriff urging him not to station uniformed deputies at early voting sites.

The letter signed by the American Civil Liberties Union of Florida, Common Cause, the NAACP and other groups, claims that Sheriff Bob Gualtieri's response could "amplify voter intimidation" rather than combat it.

For the record, if anyone has the right to argue in favor of restricting the ownership of assault weapons, it's survivors of far too many mass shootings. As America's founders wisely allowed for, we can always amend what the Constitution says. A perhaps better and much saner idea would be to amend the NRA, by convincing a reluctant media to point out it's highly deceptive and historically irrational position.

The Gazette took a second swipe at the Second Amendment this past Sunday, asking, �The Bill of Rights gives us the right to bear arms and the right to assemble peacefully ... does it give us the right to do both at the same time?�

The question is based on the false premise that the First and Second Amendments conflict with one another. In truth, one cannot exist without the other; You have no rights that you can�t defend. The Second Amendment is the one right that guarantees all others, leveling the playing field for the weak vs. the strong.

Arizona arguably has one of the most impactful Senate races in this election cycle. Martha McSally is running in a special election to fill the rest of the term in the seat formerly held by John McCain. Why is it so important to make sure she wins this special election?

Because her opponent is Mark Kelly. You�ve heard of his wife, former Representative Gabby Giffords, who had posted a supportive record on our Second Amendment rights prior to suffering horrific wounds after being shot during a constituent meet-and-greet. By some miracle, she survived.

Students at Stanford University made several �Act of Intolerance� reports about a Second Amendment event promoted by the Stanford College Republicans.

The event was designed to help students �procure and maintain a firearm under the letter of the law as well-informed and responsible American Citizens.� Although members of the Stanford College Republicans organized the event, the club did not officially sponsor it.

One such battleground is Colorado, which became the 17th state to enact a red flag law this year, after voters elected Democratic majorities to both houses of the state legislature. The law has been used 73 times in its first seven months, but opposition has been swift: In the aftermath, nearly half of the state�s counties have declared themselves �Second Amendment sanctuaries� and passed local ordinances or other rules that buck the state law. The fight is now intensifying in Colorado�s race for the US Senate.

Sens. Richard Blumenthal (D-Conn.) and Sheldon Whitehouse (D-R.I.) called out the National Rifle Association (NRA) on Friday for working to reshape the federal judiciary while Judge Amy Coney Barrett�s nomination to the Supreme Court advances in the Senate.

The Democrats were joined by gun violence advocacy groups Giffords, Everytown for Gun Safety, Brady and March for Our Lives to discuss a new report led by Blumenthal that details the gun industry�s funding of judges in lower courts and now for Barrett.

Local Republicans plan to hold a large rally on Sunday in support of President Donald Trump and several state and local Republican candidates running in the Nov. 3 election.

�Freedom Rally� will take place from 1-5 p.m. at Cloverdale Barn at 2368 Cedar Creek Grade in Frederick County. The event is being organized by county resident and gun rights activist Susan Shick, along with the Frederick County Chapter of Second Amendment Supporters. Shick said about 1,000 people are expected to attend. The event is free and open to anyone.

Halloween 2020 will find the DC Project hosting their largest fundraiser of the year. The DC Project Team Match will be held at the scenic Reveille Peak Ranch in Burnet, TX, and runs from October 30 through November 1. The weekend kicks off with a fundraising banquet on Friday, followed by a two-day, team 3-gun match on Saturday and Sunday.

The DC Project Team Match and banquet benefit our Second Amendment advocacy efforts and provides an excellent opportunity to support the shooting sports and the 2A. Throughout the competition, teams will compete for a cash payout for the top three places of four Lewis class divisions.
