Gun Laws Fail Again..and People Die

I used to think that gun laws stopped crime and made us safer. Now, I see a violent crime as another failure of the many gun control laws we already have. Gun laws don�t work, and we can�t achieve safety by piling regulations on honest people. Recent events are clear examples.

In a unanimous vote by the Philadelphia City Council on Thursday, Pennsylvania�s largest city approved language for a new ordinance lifting a general 40-year-old ban on electronic weapons.

The adopted measure, Bill No. 170674-A, repeals Philadelphia blanket 1977 ban on �stun guns, also known as electric or electronic incapacitation devices,� and comes after a Second Amendment group pressed the city to remove the seldom-enforced law. A more narrow ban on possession of the devices by those under age 18, or selling them to minors, will take its place.

A group of 28 Senators led by Sen. Chris Murphy (D-CT) to require private sellers to conduct background checks for the sale or transfer of firearms, with certain exceptions.

The requirements of the Background Check Expansion Act would apply to all unlicensed sellers, whether they sell firearms online, at gun shows or out of their home. These sellers would need to visit a licensed firearms dealer to run the background check before finalizing any gun sale.

The list of recent bill introductions is instructive. �Universal background checks,� de facto semi-auto bans, removing protections against junk lawsuits to bankrupt the firearms industry, banning magazines, waiting periods, and even basing firearm prohibitions on incomplete evidence. All of this in the name of protecting against criminal activity when it�s clear that criminals will simply ignore the new restrictions with the same regularity as the old ones.

Anti-gun Capitol Hill Democrats and their gun prohibitionist cheerleaders are once again pushing an agenda that seems to have become their �one-size-fits-all� solution to violent crimes, even though none of the measures they want adopted would have prevented the mayhem.

This comes as lawmakers in Illinois rejected a proposed ban on �bump stock� devices like the one believed to have been used during the Oct. 1 mass shooting in Las Vegas that left 58 people dead.

According to the Las Vegas Review Journal, Sen. Catherine Cortez Masto (D-NV) told reporters, �We must work to keep gun out of the hands of the seriously mentally ill, people with a history of violence, criminals and terrorists.�

California requires most firearm purchasers to wait 10 days before they can bring their gun home, regardless of whether they already own one, or how long it takes to pass a background check. Several California residents who already own firearms challenged the 10-day waiting period and prevailed in federal district court because the state could only assert a general interest in a �cooling off� period.

The U.S. Court of Appeals for the Ninth Circuit ignored that the burden was on California to prove its case�and the state could show no evidence that the wait would have any public-safety effect when the purchaser already owns other arms.

While bump stocks make a semiautomatic weapon fully automatic, the devices are legal. Congress banned fully automatic weapons in 1994 as part of the Public Safety and Recreational Firearms Use Protection Act.

The Wall Street Journal reported on Tuesday that the department had opened an official probe into the NRA�s actions concerning Carry Guard. The investigation follows a legal review conducted by Everytown for Gun Safety and distributed to regulators in both New York and California. (Everytown provides a portion of The Trace�s funding.)

Instead of concurring on the Senate version from two weeks ago, yesterday during informal session, the Massachusetts House of Representatives passed gun control language identical to that which was previously passed as part of House Bill 3979, a new appropriations measure. This is the same overreaching language that was previously passed by the House which would ban modifications commonly made to firearms by law-abiding citizens. However late last night, the Senate rejected the proposal by passing their original language narrowly targeting bump fire stocks and crank triggers as part of Senate Bill 2194, another appropriations measure.

Opponents of an armed population often make the unfounded claim that AR-15 rifles are unsuitable for hunting. Joe Clowers of Texas shows that America's favorite rifle, some variation of the AR-15, works very well for hunting feral pigs.

A new federal study looked at firearms safety training for children and found it may not be effective.

That�s important for Tennessee, which has one of the highest rates of accidental shootings involving children.

The United States Government Accountability Office recently released a report that examined programs related to gun access and the effect of those programs.

In reviewing four peer-reviewed academic research studies, the report said �behavioral skills training did not instill consistent safe firearm habits in young children.�

After just one day on the run, a wanted fugitive is back in police custody thanks, in part, to an armed homeowner in Jonesboro, Arkansas.

Johnathan Ware, 31, was found hiding in the homeowner�s trash can early Wednesday morning, local media reported. The homeowner, in turn, held Ware at gunpoint until police arrived.

Ware was in the custody of the Harrisburg Police Department Tuesday when he escaped. According to a news release from the Jonesboro Police Department, Ware was arrested following a domestic disturbance in which he was injured and taken to the hospital for medical treatment.

Since the personal so-called �right to bear arms� has been rendered obsolete by those disciplined armed forces, the wind has been sucked from its sails, leaving it as a once great idea now dead in the water. It stands as a hollow principle that has outlived any practical use it might once have had. Not only that, but as written, in today�s world it is unenforceable, and so meaningless in any practical terms, a relic of the way things used to be � and many seem to wish they still were.

LaGrange College professor John A. Tures cross-examined various figures on gun crime and found that homicide rates are not markedly different for states with gun control for private sales versus states without.

He did this as a project with his students, wherein they examined a study that provided an overview of findings from a wide spectrum of angles and political persuasions, including findings that are considered nonpartisan. These findings included figures from The Law Center to Prevent Gun Violence, the NRA-ILA, and the Centers for Disease Control and Prevention (CDC).

Why is it when there�s a bombing, we blame the bomber; when there�s a drunk driving accident, we blame the drunk driver; but when there�s a shooting, we blame the gun?

� Since 1993, gun crime has gone down 49 percent while gun ownership has increased.

� At Sandy Hook (a gun free zone) the shooter turned the gun on himself when he heard armed first responders. How many more would have died had the officer�s gun not arrived?

� A shooter at a mall turned his gun on himself when a concealed carry person pointed a gun at the shooter. How many lives did this concealed carry gun save? Shouldn�t the gun get credit for these facts as well?

A Second Amendment lawsuit out of California is drawing attention at the Supreme Court and support from multiple groups, said gun rights group The Calguns Foundation, which joined Second Amendment Foundation and two individuals on a petition in September seeking the Court�s review of a Ninth Circuit ruling that upheld the state�s 10-day waiting period laws when they are enforced against law-abiding gun owners after they pass a rigorous background check.

�It seems insane to me that a citizen can buy something like that,� 49ers CEO Jed York said at a Thursday news conference. �I�m not anti-Second Amendment. This is something that is common sense.�

The 49ers have pledged $500,000 to outreach efforts, and are partnering with police unions from San Jose, Oakland, Santa Clara, New York, Los Angeles, Sacramento, Long Beach and Portland with the goal of bridging gaps between the police and the local community. The groups are backing federal legislation to outlaw bump stocks, armor-piercing bullets, and gun silencers, all of which the police unions cite as threats to legal law enforcement efforts.

One great example Stern notes: The issue of defensive gun use (DGU) �is often dismissed by the media as myth.� Indeed, to them, anyone who owns a gun is a potential criminal, and the concept that citizens might actually own and use guns as a means of self-defense is as alien to the Left as the idea of free speech. But, Stern explains, �DGUs happen all the time � 200 times a day, according to the Department of Justice, or 5,000 times a day, according to an overly exuberant Florida State University study. But whichever study you choose to believe, DGUs happen frequently and give credence to my hunting friends who see their guns as the last line of defense for themselves and their families.�

John M. Snyder, long known as a champion of the Second Amendment, passed away Oct. 22. He was 79.

A veteran of the gun rights battle, Snyder had been a long time lobbyist and also worked with and helped found the Citizens Committee for the Right to Keep and Bear Arms (CCRKBA). He also worked with its sister organization, the Second Amendment Foundation. He was an author and had served as editor of CCRKBA�s monthly publication, Point Blank.

The Iowa Legislature did not specify a legal process for using a "stand your ground" defense. The provision�signed into law earlier this year�says an individual who feels threatened has no duty to retreat before using deadly force for self-defense.

"Lamar Wilson used deadly force�like force�to repel the deadly force he and others were confronted with," defense attorney John Bruzek writes in a pre-trial motion.

Bruzek says according to the new law, a use of force with a "stand your ground" justification means the defendant is immune from "criminal or civil liability".

In a response, the Johnson County attorney writes the new law does not allow for immunity from prosecution.

It is October 27 and House Speaker Paul Ryan (R-WI) has just finished ignoring national concealed carry reciprocity for a 42nd consecutive week.

National reciprocity was introduced by Rep. Richard Hudson (R-NC) on January 3, 2017, and Ryan has remained mum on it ever since, with one exception. That one exception came in the wake of the June 14 Alexandria attack, when Ryan told Rep. Thomas Massie (R-KY) that �he didn�t think the time was right� for legislation revolving around reciprocity.
