Michigan Court of Claims Judge Christopher Murray issued a preliminary injunction Tuesday that effectively halts Secretary of State Jocelyn Benson's directive banning the open carry of guns near polling locations on Election Day.
Attorney General Dana Nessel announced almost immediately after the decision was issued that her office would appeal to the Court of Appeals "as this issue is of significant public interest and importance to our election process."
The edict by Benson "smacks of an attempt at legislation" and lacks public input instead of following the regular rule-making process, Murray said during a Tuesday emergency hearing. |

Michigan Attorney General Dana Nessel filed an emergency appeal against an injunction that stopped the ban on open carry firearms at the polls.
On Tuesday, Court of Claims Judge Christopher Murray issued a preliminary injunction that stops the ban on open carry guns at the polls.
The ban directive was issued by the Michigan Secretary of State to prevent voter intimidation.
An attorney for the state argued before the judge that the ban was issued because of open carry protests inside and outside of the state capitol over the Governor's COVID lockdown orders and the criminal case against 14 men in an alleged plan to kidnap the Governor.
She also told the judge they have heard poll workers are afraid to work on election day. |

Hundreds of thousands in Michigan own guns, have Concealed Pistol Licenses, and have been in open carry protests in Lansing over Governor Whitmer�s COVID-19 lockdown orders.
They believe they have become unfairly targeted in the heated debate over open carry guns at the polls on election day.
The legalities are now in the Michigan Court of Appeals.
Court of Claims Judge Christopher Murray shot down the ban on guns issued by Secretary of State Jocelyn Benson.
Michigan Attorney General Dana Nessel appealed and says this will be resolved by Tuesday.

Joe Biden and his administration have stated clearly that the Second Amendment is on the chopping block if he is elected. Let us examine their proposals versus reality:
1.Banning of modern sporting rifles, known to liberals as "assault weapons." Formerly liberals called these "assault rifles," but quietly changed the term to cover anything they disliked. This ban includes the very popular AR15, M1A, M1 carbine, AK platforms, most anything with a detachable magazine. Most of these arms have been with us 60-100 years. |

South County saw its first crime charged as vehicle hijacking in August when a man and woman were charged with murder after they tried to carjack a man at the Classic Car Wash on Lemay Ferry Road, but the victim shot and killed their 18-year-old accomplice in self-defense, according to police accounts. In addition to the murder charge, the man and woman were also charged with armed criminal action, vehicle hijacking and various other felonies. |

Amendment V and Amendment VI only involve laws in Franklin County and Lauderdale County but the entire state must approve them. These amendments �provide that a person is not liable for using deadly physical force in self-defense or defense of another person on the premises of a church under certain conditions.� Kelley said that these amendments are puzzling because the state already has laws on the books that would allow for people to defend themselves anywhere, not just in churches. |

The potential for an upset in this state was noted before, and with less than a week before Election Day, it�s worth a closer look.

2. Pro-gun The Republicans are not �pro-gun.� They are pro-intimidation. They are pro-anarchy. They are pro-vigilante justice. While the Second Amendment is (arguably) about the right to self-defense�as written, it�s about militias and national defense�it does not in any way, shape or form empower one class of people over and at the expense of another class. As it is, Republican jurists have repeatedly seen what they want to see so that the desire for peace and security is second fiddle to the desire for unlimited firepower. It�s no coincidence the Republicans went gun-nuts after the election of the first Black president. Democracy is no longer a means to power. It is now an obstacle. |
