On September 6, the defendants in WVCDL's lawsuit against the City of Martinsburg filed an answer to WVCDL's amended complaint. Unfortunately, just a few hours later, the court issued an Order of Abstention (the order was amended a week later to correct a clerical error), directing WVCDL to file a separate lawsuit in state court to litigate the questions of state law separately from the federal case and return to federal court if we fail to overturn the city building gun ban ordinance in the separate case. |

SEPTEMBER 28--FBI agents targeting possible child porn collectors have built an undercover web site purporting to offer illicit videos for free, but which actually captures the IP address and other identifying information of suspects who click on download buttons offering samples of the sites illegal clips, The Smoking Gun has learned.
The bureaus operation last month snared a Department of State diplomatic security officer, according to court records. James Cafferty, 45, who was stationed at the U.S. Embassy in London, was named in an August 29 felony complaint charging him with possession of child pornography. |

A pair of Alabama conservation enforcement officers think they've come up with the perfect way for avid hunters to honor their loved ones for eternity. Officers Thad Holmes and Clem Parnell have launched Holy Smoke LLC, a company that will, for a price, load cremated human ash into shotgun shells, and rifle and pistol cartridges. It's the perfect life celebration for someone who loves the outdoors or shooting sports, Parnell says. "This isn't a joke. It's a job that we take very seriously," he said. "This is a reverent business. We take the utmost care in what we do and show the greatest respect for the remains." |

A law that allows people to carry concealed guns in bars and other places that serve alcohol went into effect in Ohio on October 1. However, not all bars are complying with the new law. They are not doing anything illegal -- the law allowed for businesses to ban guns. Most sports stadiums and arenas have previously said they will continue to ban weapons. Many bars are, too. |

Subsequently, the state court handed down a decision in Williams vs. State stating, If the Supreme Court, in this dicta, meant its holding to extend beyond home possession, it will need to say so more plainly, meaning they now recognize the Second Amendment, but that it does not extend outside the home.
By making such a claim, the state automatically renders the homeless defenseless, without protection of the Second Amendment. |

Universities and anti-gun lobbyists have had many reasons to celebrate this year, with the death or delay of bills in more than a dozen states that would have allowed the concealed carry of weapons on campuses. But it seems the momentum may be shifting.
On Wednesday, the Oregon Court of Appeals overturned a longstanding rule of the state university system that prohibited guns on its campuses, making it legal for concealed carry permit-holders to carry anywhere on public college grounds. Only Utah's state law is as liberal.
And early this summer, legislators passed laws in Wisconsin and Mississippi that allow anybody with a concealed weapons permit to carry a gun on public campuses. |

Of course, Calderon couldn't suggest that. Instead he fell back to beating his tried and true dead horse - quoting the absolutely false statistic that 85% of firearms found in Mexico are purchased in America. Do some study about the source of this number, which is often quoted by politicians on both sides of the border - and you'll see how it is really an attempt to blame our second ammendment for the violence in Mexico. |

We knew before leaving Ruidoso Mayor Ray Alborn had issued an executive order banning guns from village buildings. Made sense to us. Yawn. When's the next bus to the big city? It turned out, however, the issue was explosive.
The uproar all began when area resident Tony Seno, gun in holster, approached the podium to speak at a city council meeting. The mayor said no go. Alborn, himself a former head football coach at Rice University, called the wrong defense.
He stopped Seno dead at the line of scrimmage, but the gun-totin' libertarian dropped back and threw a perfect spiral to the National Rifle Association. Those folks don't take lightly any kind of weapons ban. |

That was the theme of this years Second Amendment Foundations Gun Rights Policy Conference (SAF/GRPC) held last month in Chicago, Illinois.
The SAF chose Chicago because Illinois is the only state to grant absolutely NO right to carry a concealed firearm for self-defense.
Personally, I question that conclusion since New Jersey may as well be considered among those states that DO NOT issue carry permits to private individuals. |

The unusual feature of the start of this years term is that the Obamacare case isnt the only blockbuster looming on the high courts horizon. In the weeks ahead, the justices are set to consider taking up a string of other potential landmark cases that could further transform the new term into a clash of constitutional titans. They include disputes examining:

Well, the text of that correspondence has been released, and it seems that its no smoking gun as a White House spokesman said earlier, the e-mails pertain not to gun walking (the ATFs alleged practice of watching traffickers buy guns and doing nothing to stop them), but to other law-enforcement efforts. There is some talk about guns that were trafficked from Arizona and recovered at crime scenes, but no admission that the ATF deliberately let those guns go despite having the ability to stop them. |

Utah has a reputation for being a hunting and gun friendly state. However, state law still prohibits convicted felons from owning guns, much in the same manner that federal law does. Due to both state and federal restrictions, one Salt Lake City gun charges lawyer says that individuals facing gun charges may not realize that they can face charges at both levels even though one act occurred. |

There were no cannons on display in Bismarck on Sunday, but there was plenty of antique firepower. Around 1,500 people poured in to the Bismarck Civic Center for the Dakota Territory Collector Gun Show.
For the past fifteen years, Janet Parks and her husband have been selling and collecting guns. "The older we get and the more we can afford the antique rifles, we've moved on to very high-end collectible guns," she said. |

Martial law includes the suspension of civil liberties, such as freedom of speech and dissent, the right to bear arms and self-defense, the right to freedom of movement, and the right to presumption of innocence. The Declaration of Independence recognizes the right of each and every human being to "life, liberty and the pursuit of happiness." These are inalienable, pre-existing rights, meaning that they are natural and inherent rights, not given to us by any government. That means that no one, including government officials, police or military, may violate these rights or remove them otherwise, they could not be considered inalienable. |

In a classic Friday document dump -- a sure sign of an administration with something to hide -- the feds released to congressional investigators a months worth of e-mail correspondence in the summer of 2010 between Bill Newell, then head ATF agent in Phoenix, and his friend Kevin OReilly, a former White House national-security staffer for North American affairs.
What do you know? Among the e-mails was a photograph of a powerful Barrett .50-caliber rifle that had been illegally purchased in Tucson and recovered in Sonora, Mexico, raising the possibility of a second gunwalking program, this one called Wide Receiver. |

Canton has joined other communities in firing back against the misuse of fake guns, which Public Safety Director Patrick Nemecek said have been used to harass people most commonly in traffic altercations increasing the chances of serious accidents. |

Brian Vicente, one of the state's most prominent medical-marijuana proponents, calls it a "travesty."
Tony Fabian, one of the state's foremost gun-rights activists, says it's evidence of "hostility."
What has forged this quirky convergence of advocacy tokers, meet shooters is a September letter from the federal Bureau of Alcohol, Tobacco, Firearms and Explosives saying it is illegal for medical-marijuana patients to own firearms. |

Mark Naymik's Sept. 22 column,"Gun violence swells calls for state action," is typical anti-rights nonsense that suggests politicians in Columbus can simply pass more laws and make Cleveland's criminals leave their guns at home. Cleveland's problem isn't guns; it's bad people who obtain guns illegally. |

People who obtain licenses to carry concealed weapons will have to remove their guns before they enter any property owned, leased or controlled by Door County.
The County Board on Thursday voted 21-0 to approve the ban developed by Corporation Counsel Grant Thomas.
"I made it as restrictive as we possibly could under the statute," Thomas told the board. The county Administrative and Finance committees had recommended approval. |
