CA: Video clears man in fatal Cava 22 stabbing

A man who stabbed two men outside of Cava 22 one year ago was released from jail last week, after video evidence presented at his trial showed he was likely acting in defense of a friend.

�Things aren�t always what they seem at first glance,� said public defender Ilona Solomon in an interview with Mission Local. She said her client Nelson Hernandez-Deleon, 32, was defending his friend and likely saved that man�s life on Sept. 18, 2021.

�Simply stated, instead of moving toward becoming a shall-issue jurisdiction, New York State has further entrenched itself as a shall-not-issue jurisdiction. And, by doing so, it has further reduced a first-class constitutional right to bear arms in public for self defense ... into a mere request,� wrote Suddaby, who sits in Syracuse.

The ruling also rejected provisions that would bar people from carrying handguns into certain �sensitive locations.�

On Wednesday, the Supreme Court vacated a controversial Massachusetts law that puts strict restrictions on the ability to buy and possess handguns.

The law in question includes a lifetime ban for anyone with even a nonviolent misdemeanor which resulted in 2 years of jail time, even if that misdemeanor was out of state. In addition, the law requires a state-issued license in order to carry a firearm.

The case, known as Morin v. Lyver, has been �remanded to the United States Court of Appeals for the First Circuit for further consideration� according to an order list from SCOTUS. The court references its own ruling on a New York concealed carry law from June of this year as its reason for vacating the case.

Mass shootings of the kind that took place at a Thai daycare on Thursday, resulting in the deaths of at least 38 people, most of whom are children, are relatively uncommon in Thailand. The last time the country experienced a shooting on this scale was two years ago at a shopping mall in northeastern Thailand when a soldier killed 29 people with an assault rifle. It was the first and deadliest mass shooting in Thailand�s modern history, until today. The question now facing the country as it reels from its latest tragedy is what its notorious gun culture, at least by Asian standards, has to do with it.

U.S. Senators Mike Crapo and Jim Risch (both R-Idaho) joined 24 Senate colleagues in sending a letter to Amalgamated Bank President and Chief Executive Officer Priscilla Sims Brown, criticizing the bank�s manipulation of an international standard-setting organization to force U.S. financial services firms to categorize gun purchases--an indefensible attempt to target law-abiding Americans exercising their right to purchase firearms and to enact far-left political goals.

�Your bank is attempting to restrict the Second Amendment rights of Americans by going around the democratic process. You should expect Congressional oversight of your actions,� the Senators wrote.

Following a Supreme Court decision earlier this year in New York State Rifle and Pistol Association V. Bruen � a case in which the court asserted gun restrictions are only constitutional if there is historic tradition of regulation � Laxalt tweeted that the decision was a �tremendous victory for the constitutional rights of Americans.�

�Today, as politicians in Washington are voting to impose additional restrictions on our constitutional rights, I am grateful that the Supreme Court upheld fundamental principles of our country,� Laxalt wrote, referencing a bipartisan bill expanding gun background checks in the wake of the school shooting in Uvalde, Texas.

Gun safety is on the ballot in Iowa this year. Voters will consider a state constitutional amendment called Public Measure 1, which states, �The right of the people to keep and bear arms shall not be infringed. The sovereign state of Iowa affirms and recognizes this right to be a fundamental individual right. Any and all restrictions of this right shall be subject to strict scrutiny.�

The last sentence makes this amendment very different from the U.S. Constitution's Second Amendment, and more extreme. What is strict scrutiny and how would it change the legal landscape?

Restrictive states gun sales per capita: 2020 � .024; 2021 � .023.

Gun sales for the rest of the USA in 2020 were 18.6 million, and .075 firearms sold per person. In 2021, there were 16.2 million firearms sold, and .065 firearms sold per person.

Less restrictive states, gun sales per capita: 2020 � .075; 2021 � .065.

This is significant evidence of repressing the exercise of Second Amendment rights. In 2020 and 2021, the sales of firearms in the restrictive states were only one-third as many per capita as in non-repressive states.

So much for the right to keep arms.

The latest case became known as Antonyuk v. Hochul. This time GOA sued a slew of new people, including New York Governor Kathy Hochul. Mr. Antonyuk and GOA then found other plaintiffs that did intend to violate the CCIA and refiled and asked for a TRO. The courts have held that if a law is unconstitutional, citizens are under no duty to follow it.

Although the judge let certain aspects of the CCIA stand, most of the law was restrained. The judge followed the road map set by Bruen and ruled based on the actual text and history of the Second Amendment.

Neither the LAPD�s fee of $268 nor the Los Angeles Sheriffs� fee of $150 includes the cost of the livescan or training class, which adds nearly $300 to the cost of becoming licensed to carry a concealed weapon.

�We are looking at more than a $500 effective price tag to exercise a constitutional right if you are getting a permit from LAPD,� Moros told The Epoch Times.

The LAPD, which did not immediately respond to requests for comment, previously told The Epoch Times that it temporarily suspended the application process for concealed carry permits while it evaluates the U.S. Supreme Court�s landmark ruling in N.Y. State Rifle and Pistol Association v. Bruen.

You may need to communicate with bullies in the only language they know. Violence is never the solution, as we are frequently taught, but self-defense laws are in place for a reason.

A federal judge on Thursday blocked large portions of a new New York gun law, jeopardizing a measure that was passed just three months earlier and underscoring the difficulty that states may face in restricting the public carrying of firearms after a major Supreme Court ruling in June.

In a 53-page order, the judge, Glenn T. Suddaby of the Northern District, said he would block the state from enforcing several provisions, writing that New York�s attempts to bar guns in a number of places deemed �sensitive� � including museums, theaters, stadiums, Times Square, libraries, places offering services to children and anywhere alcohol is served � appeared impermissible.

On Thursday, a federal judge in Syracuse struck down key parts of New York's Concealed Carry Improvement Act, the hallmark piece of legislation lawmakers drafted this summer to rein in the U.S. Supreme Court's expansion of gun rights.

The new legislation was designed to provide licensing officials with additional information about concealed-carry applicants, now that they are presumptively able to obtain a permit to carry a concealed firearm in public.

No one seems to pay attention to the second word of the Second Amendment � �well.�

How do no background checks at gun shows, no digital records of weapons, no database of weapon owners and no professional management of weapons in this country fit the label of �well regulated.� To quote Flavor Flav of the hip hop rap group Public Enemy, the ATF�s National Tracking Center, or NTC, �is a joke.� Before you get too flustered by my claims of �no records,� read up on the NTC�s NRA-imposed non-digital limitations. This organization is forced to operate at a level of inefficiency that marvels the mind.

The Gun Violence Archive finds that there have been 496 mass shootings in 2022 alone. On September 1, 2021, law HB 1927 was enacted throughout the state of Texas to allow people who are legally allowed to carry a gun to be able to carry concealed and unconcealed weapons in public without a License to Carry (LTC). Texas Gov. Greg Abbott also signed laws loosening gun control, such as SB 20, which allows for citizens to store firearms in hotel rooms, and HB 957, which prevents criminal offenses from being charged for the sale and distribution of firearm silencers.

On September 30, 11 Democratic attorneys general (AGs), led by the AGs of the District of Columbia, New Jersey, and Delaware, sent a letter in support of major credit card companies Visa, Mastercard, and American Express adopting a new merchant category code for the sale of firearms. The letter from leading Democratic AGs follows a letter from two dozen Republican AGs to the credit card companies, opposing the adoption of the merchant code.

During the pandemic, gun and ammunition sales spiked dramatically in the United States � particularly among Black women, who have become the fastest growing group of gun owners in the country.

�In 2021, we were just coming outta COVID and violence was at an all-time high, riots were at an all-time high and human trafficking is at an all-time high,� licensed gun instructor Robin Evans tells Yahoo Life as a way to explain the rise. �So at that moment, I feel like there was a huge shift in Black people, in general, just wanting to learn how to defend themselves.�

Tippetts also discussed his perspective on gun laws.

�I�ve always said I would support any gun legislation that did not violate the second amendment,� he said. �You can take pretty much any gun law that you were to pass�it will not hold up scrutiny in the Supreme Court.�

Bringing in the related topic of gun violence, Tippetts said, �It�s not a gun problem. We cannot blame the tools for the damage created by the user. If it wasn�t for a gun, if it wasn�t for any kind of a weapon�they will find other kinds of weapons. We have to combat really the root of the problem, which is not the guns themselves. Those are the tools. It is the mental state of the individual.�
