MI: Craigslist ruse ends with two shot in Urbandale

Two people were shot Tuesday night in Urbandale after they attempted to rob a father and son looking for a car to buy, police said.

�This was a Craigslist deal gone bad,� said Battle Creek Police Chief Jim Blocker. �They were some folks from Grand Rapids who were looking for a car and were jumped by three attackers.�

During the attack the son pulled a revolver and fired shots, hitting two of the attackers in the chest, Blocker said.

Blocker said the son, who has a license to carry a concealed firearm, pulled out the revolver and fired at least two shots.

A third person believed involved in a Tuesday night attempted robbery and shooting has been apprehended.

The man was found inside 121 N. Broadway Boulevard, according to Detective Sgt. Jim Martens, supervisor of the detective bureau.

The man is possibly one of three men who attempted to rob Robert Vanderwiel, 72, and his son, Jon Vanderwiel, 42, from Grand Rapids who came to Battle Creek to purchase a car they found on Craigslist, an internet want-ad site.

They told police they were attacked by three young men, but Jon Vanderwiel announced to them he had a gun and fired twice from a revolver at close range, hitting two of the attackers.

State Rep. Klint Kesto, chairman of the House Judiciary Committee, said Tuesday he'd met with the advocates who on Monday publicly urged him to advance bills that would prohibit guns in schools, libraries and other public places and expand background checks in Michigan.

"I don�t see any empirical evidence that those bills would stop gun violence, and that�s what I�m looking for," Kesto, a former Wayne County prosecutor, said. "We don�t want to see any violence, but we need real empirical evidence that something works.�

Nationally, gun control opponents note that cities with some of the toughest gun limits, such as Chicago, have some of the highest gun violence rates, and that existing gun laws aren�t enforced.

Her so-called fix consists of a dead-on-arrival legislative proposal making gun manufacturers financially liable for the misuse of their products and an executive order determining the meaning of certain words used in federal statutes.

The liability-shifting proposal is akin to punishing General Motors whenever a drunken driver misuses his Chevy and injures someone. The courts would surely reject that.

The left has a second amendment problem. It believes that the right to abortion and gay marriage are fixed in the Constitution � somewhere or other, you�ll just have to trust them � but the black-and-white guarantee of the right of individuals to own guns is a big misunderstanding.

On this issue, the left doesn�t particularly like or comprehend the country it lives in, especially that it was founded by men who distrusted government and sought to limit it by protecting certain essential individual rights, including gun ownership.

Concealed carry expansion legislation, Sub. House Bill 48, is expected to come up for a floor vote in the Ohio state House on Wednesday, October 7.

Sub. HB 48, sponsored by Representative Ron Maag (R-62), would expand where Ohio carry permit holders may lawfully carry a firearm for self-defense. The bill would also give discretion for college institutions to allow concealed carry on their campuses, as previously reported.

Our state has had two recent incidents make headlines involving people certified to carry a concealed weapon using their gun during crimes others are committing.

One of those incidents was Tuesday night in Battle Creek, where a father and son were going to buy a car they saw on Craigslist but were jumped by three men when they got there. The son, who has a license to carry a concealed weapon, shot two of the men. The father and son were then able to get away and call police.

Bergeron says that he is pondering whether a decision to retry could be met with an immediate motion to dismiss the charges with prejudice since he believes the judicial error in this case may have created a double jeopardy situation.

Besides, if you are DA Chris Hicks, elected with no opposition in 2014, how many times do you want to tell your constituents that they have no right to defend their families and property in their own homes before the next election in 2018?

The battle to allow Floridians to openly carry their firearms is now being waged on two fronts.

The Florida Supreme Court Wednesday announced it would take up the case of Dale Norman v. Florida, which could overturn the state's open carry ban. Just the day before, a bill to overturn that same ban passed its first committee meeting in the Florida Legislature.

The Norman case began in Fort Pierce on Feb. 19, 2012, when police arrested Norman, who was apparently strolling down the street packing heat for the very first time � at least legally. He had just gotten a concealed carry permit. The problem, though, is that Norman's gun was not concealed, as police dash-cam video clearly shows.

In the aftermath of yet another mass shooting event, this one at an Oregon community college, a clearly frustrated President Barack Obama delivered an impassioned plea for action on gun control.

"This is a political choice that we make, to allow this to happen every few months in America," he said. "We collectively are answerable to those families who lose their loved ones because of our inaction."

He is right. Though years of polling shows overwhelming support for reasonable measures such as universal background checks, banning assault weapons and halting the sale of large-capacity magazines, federal lawmakers � primarily Republicans � refuse to make them law.

Earlier today, second amendment civil rights advocates at Firearms Policy Coalition (FPC) delivered over 40,000 individual letters from concerned Californians demanding that Governor Brown veto Senate Bill 707.

The gun control bill would prohibit gun owners issued a license by their local police chief or sheriff after passing a strict, fingerprint-based background check and agency-approved training course from carrying handguns for self-defense on California school grounds.

After a shooting, law enforcement officers are ignoring an important provision in the state's "stand your ground" statute that requires them to determine if self-defense is applicable before they make an arrest, prominent defense attorneys say.

"If there's a confrontation and someone gets shot or hurt, the winner goes to jail. It doesn't matter about provocation. They're going to jail," said Bradenton attorney Charles M. Britt III, who says he has handled 50 "stand your ground" cases. "The statute says that before law enforcement can make an arrest, they have to determine that 'stand your ground' doesn't apply. It's right there in the statute, but I've never once seen them do it."

Rogue Protection Group said since the UCC shooting they've had a dramatic increase in enrollments for their conceal and carry classes. In the last few days, RPG has taken more than 100 phone calls asking about the classes and firearm safety.


"We want people to carry a firearm if they want to, and if they do, we want them to be safe and we want them to be educated," explained RPG owner Trista Ehly. "Our goal is not to have every single citizen armed; our goal is to make sure the people who are carrying are doing it safely."

Planning commissioners split 4-3 Wednesday over the approval of a proposed firearms training facility near Frostproof.

Cary Scott and Garrett Anderson of Avon Park, who proposed the range on a 40-acre former clay pit off J Zoffay Road, argued the project could boost the area's economy by turning Polk into a center for firearms training facilities.

Lake Wales lawyer Bart Allen, who represented a number of local grove owners, and others questioned whether a facility would be compatible with current citrus operations and future residential development in the area.

Anderson said they are planning to appeal Wednesday's vote to the County Commission.

Florida HB169, a bill that would limit prosecutors ability to use the legal process to punish people who have legitimately acted in self defense, has been introduced in the Florida Senate.

That and other weapons � such as mace and handguns � should be allowed, petition demands

�When we ask what a defenseless 120-pound woman should do if attacked, ASU�s official answer is �call 911.� We respectfully submit that this is unlikely to prevent a student from being victimized.�

That�s one argument a newly formed group of Arizona State University students is putting forth as it demands their campus allow students to carry basic self-defense items � everything from mace and knives to stun guns and handguns � arguing their school�s draconian anti-weapons policy is actually dangerous to students.

National conversation has turned once again to gun control laws following the recent mass shooting in Oregon, but local gun advocates stand firm in support of their Second Amendment rights.

"More gun control will not lead to less gun violence," said Bruce Canfield, historian and author of 12 books on U.S. Military weaponry. "Gun control clearly hasn't worked, and it's not going to work."

Collins restated her support for the Manchin-Toomey universal background check bill, which would prevent people with a criminal or psychiatric record from legally buying a gun, even in a private sale. Other sensible measures could include limits on high-capacity magazines and holding negligent firearms sellers liable for their customers� actions, much as we hold hosts and bartenders accountable when they let guests drive drunk.

Stephen Kwong, 24, of Eagan, hadn�t fired a gun at the range in two years, but decided to swing by after lunch one day last week, bringing with him his friend, first-timer Jessica Wong, 21.

In the wake of the latest mass shooting, this one at Umpqua Community College in Oregon, Kwong remained steadfast that while everyone should have gun training, the right to bear arms should be inviolate and restricting gun rights will not prevent future carnage.

�I mean, look around,� Kwong said. �For $73, two of us were standing inside with a bunch of other people who don�t know each other with guns. The deadliest place could be right here.�

After shootings left 10 people dead and 74 injured in Rochester this summer, public officials have set their sights on a fresh approach to criminal cases that involve illegal gun possession.

The idea is for courts to deal more effectively with people who are caught carrying firearms illegally by handing down more consistent sentences and assigning young offenders to a closely supervised probation program if they show the potential to reform.

Eric Dietz, Ph.D., former director of Homeland Security for the state of Indiana and a 22-year Army veteran, now a professor at Purdue University, researched mass shootings from the 1950s on. He discovered that only two of them occurred where guns are legal to be carried. Think about that: every mass shooting in the United States since the 1950�s except two have occurred in gun-free zones.
