When he saw two men pry into his neighbor's house with a crowbar one afternoon earlier this month, Joe Horn did what many people would do: He called 911.
But when police had not shown up by the time the suspects were about to leave, the 61-year-old retiree did something most people probably would not: He stepped outside with his 12-gauge shotgun and killed them. |

So the ban has been hopelessly feckless, thus rendering moot the city's argument that the ban should be "a legally permissible public-safety measure that has saved lives."
But is it constitutional? The appeals court said the ban "amounts to a complete prohibition on the lawful use of handguns for self-defense. As such, we hold it unconstitutional ... (and) conclude that the Second Amendment protects an individual right to keep and bear arms," a right that "existed prior to the formation of the new government under the Constitution." |

For the Supreme Court to rule otherwise would fly in the face of the founding principles of this nation. The rights of individual to own and possess firearms - including handguns - is one guaranteed by the Second Amendment and one that the courts should protect and defend.
Likewise, the Second Amendment is a two-way street in that the right of individuals to own and possess handguns means that not all individuals will use their rights appropriately - some will resort to criminal activity and senseless violence - and they will forfeit those rights.
But the argument that the Second Amendment does not extend to individuals is one to which we do not subscribe and one we believe endangers this nation. |

Mitt Romney, Fred Thompson, John McCain, and Mike Huckabee are staunch Second Amendment advocates and all oppose most restrictions on gun rights including D.C.’s. Rudy Giuliani favors some restrictions but opposes the D.C. gun ban. He thinks the Supreme Court should strike it down permanently.
Ed.: You must be kidding, Ken. Romney a "staunch" Second Amendment supporter, yet no mention of Ron Paul, who might be the most ardent supporter of the right to keep and bear arms among the 2008 presidential candidates? Your intellectual cowardice speaks volumes. |

In Ontario, Canada, the law required anyone owning a rifle or shotgun to register it with police. That law is now out the window and long guns will no longer need registering with anyone. Officials of Ontario have admitted that enforcing the law did no good whatsoever in curbing crime, exactly what lawful gun owners have claimed for years. A governmental official was quoted saying, trying to enforce the law was a waste of time and money. |

..the slayings followed an argument over a $50 debt.
Tavares, the neighbor charged in the Mauck slayings, was released from a Boston-area maximum-security prison in July after serving 16 years for manslaughter; he had killed his mother with a carving knife.
Mitt Romney, the former Massachusetts governor who is seeking the Republican nomination for president, has called on a judge he appointed to resign because the judge freed Tavares from prison.
"They're going to use this in political games," said Beverly's mother, Karen Slater, after the service. "But I want to use them back" to raise awareness about the criminal-justice system that let Tavares go free.

One of the many charged debates on Internet message boards in response to the controversial Taser incident in Uintah County is whether a driver being issued a citation is required to actually sign the ticket. And if the driver doesn't, what, if anything, happens next. Is refusal a separate criminal penalty? Grounds for arrest? A citizen's right?
The debate rages after a dashboard camera from a highway patrol trooper's car was posted on YouTube, detailing an exchange that played out between officer John Gardner and a motorist he had stopped, Jared Massey.

As book titles related to Hurricane Katrina continue to accumulate, more and more voices of storm survivors are being heard. While many of these books focus on the most unfortunate victims of the storm — those people whose homes were destroyed by flood waters, who lost family members, who wound up at the Superdome or Morial Convention Center, who were eventually evacuated — others tell the tales of those who stayed behind. |

WASHINGTON - Firefighters in major cities are being trained to take on a new role as lookouts for terrorism, raising concerns of eroding their standing as American icons and infringing on people's privacy.
Unlike police, firefighters and emergency medical personnel don't need warrants to access hundreds of thousands of homes and buildings each year, putting them in a position to spot behavior that could indicate terrorist activity or planning. |

The U.S. Supreme Court will soon decide whether to hear a case that goes directly to the question of whether owning a gun is an individual right under the Second Amendment of the U.S. Constitution or a collective right of states that maintain militias.....It's as if they read only half of the amendment, the part that says "the right of the people to keep and bear Arms shall not be infringed." They ignore the first half, which clearly stipulates that the right to bear arms exists in the context of a "well regulated Militia, being necessary to the security of a free State ..."....We think that ruling is a distortion of the Second Amendment.

I agree that the National Rifle Association and its minions willfully misinterpret both the spirit and the letter of the Second Amendment by citing only half of its content: "The right of the people to keep and bear arms shall not be infringed" [editorial, Nov. 23, "Whose Right To Bear Arms?"]. Putting this line into the context of the entire sentence ("A well regulated militia, being necessary to the security of a free state ...") completely argues against the dangerous implications of the sentence fragment. |

Federal officials are routinely asking courts to order cellphone companies to furnish real-time tracking data so they can pinpoint the whereabouts of drug traffickers, fugitives and other criminal suspects, according to judges and industry lawyers. In some cases, judges have granted the requests without requiring the government to demonstrate that there is probable cause to believe that a crime is taking place or that the inquiry will yield evidence of a crime. ... "Most people don't realize it, but they're carrying a tracking device in their pocket," said Kevin Bankston ... "Cellphones can reveal very precise information about your location, and yet legal protections are very much up in the air."

Associated Press
SPOKANE, Wash. - A federal judge in Spokane has sentenced a 51-year-old man to nearly four years in prison on charges that he made illegal silencers for firearms.
Michael G. Teasley pleaded guilty to manufacturing an unregistered firearm and being a felon in possession of ammunition.
Two other firearms charges were dismissed as part of the plea bargain.
Police found seven silencers at Teasley's East Spokane home last year. He claimed the devices were designed for use as filtering devices for water and gasoline, but firearms experts later determined they were operable silencers, which are illegal to make or possess.

The Supreme Court agreed this past week to decide whether the Constitution grants individuals the right to own firearms, thrusting the court into a political thicket ahead of next year's election. The court will decide whether the District of Columbia's 1976 law that bans handguns, generally considered to be the nation's strictest, violates the Second Amendment. A federal appeals court struck down the handgun ban in March, becoming the first federal court to overturn such a law on Second Amendment grounds. |

The U.S. Supreme Court's decision to hear the case challenging a Washington, D.C., handgun ban would be the first time the court has directly interpreted the Constitution's Second Amendment. It'll likely be heard in the spring and could be another contentious issue that impacts the 2008 presidential election. Some court watchers say it will be the biggest case of the year and could have the most bearing on the rural South where many gun owners live and vote. |

As the Supreme Court prepares to take on the key Second Amendment question of the individual right to keep and bear arms, as opposed to bearing arms only as part of an organized state militia, Alaskans may be sorting out their own views on the issue. Perhaps people living here, thousands of miles from the nations capital in one of the youngest states in the country, are actually a little closer to the idea of individual rights and freedoms than those in older, more civilized parts of our nation. |

Court papers show Tavares claims he went to the Maucks home to collect a $50 debt around 7 a.m. Saturday when he unwrapped his .22-caliber revolver from a towel, covered it to muffle the noise and shot Brian Mauck in the face, then the back of the head.
He then chased Beverly Mauck out the front door, grabbed her by the hair and shot her in the back of the head, Tavares told authorities.
He said that he dragged her body to where her husband was lying, placed her body over his and covered them both with a blanket because, He respected them, court papers show.
Tavares told cops he and his wife went to Point Defiance where he threw the gun off a cliff toward Puget Sound.
