In this case, USA v Herrera, the Fifth Circuit en banc upheld a conviction for possessing firearms while an "unlawful user" of controlled substances. DeMoss, one author of Emerson, joined by Smith, dissented saying in part that the ruling violated the Second Amendment and Emerson. Note that in another case in October 2002, Smith and DeMoss upheld ruling that possession of sawed-off shotgun was "crime of violence" (USA v Sema). |

"The state Department of Education yesterday suspended six Kea'au Middle School students on the Big Island for one year following last week's incident in which two handguns were brought to campus and passed around."
"Judith Saranchock, DOE complex area superintendent for the Kea'au, Pahoa and Ka'u school complexes, issued the suspension order. The boys, all seventh-graders, initially were placed on "crisis suspension" Nov. 18 while school officials investigated.
