CA: DA's office finds four shootings were in self-defense

Four civilian shootings this year that left three people dead and one wounded were all justifiable, Shasta County District Attorney Stephanie Bridgett said Thursday.

As such, those who did the shootings won't be criminally prosecuted, she said.

The shootings included the Feb. 15 shooting of 45-year-old John Scott Souza, also known as John "Jocko" Larry Parks. Souza was shot and killed by Michael Lake, 27, of Redding.

HB1169 allows any person who is legally eligible for a Class 2 firearm carry license and who has possessed a valid North Dakota driver�s license or ID card to carry a concealed firearm without needing to first obtain the firearm carry license. However, existing state law prohibiting loaded firearms in vehicles only specifically exempted firearms carried under concealed carry permits, prompting the question about whether constitutional carry applied in vehicles. Attorney General Stenehjem ruled that a North Dakota driver�s license or ID card �is the equivalent� of a concealed carry permit, so constitutional carry qualifies for the exemption to the prohibition against loaded firearms in vehicles.

This year could be another record-breaking year for firearms found in carry-on bags of passengers trying to board flights in Louisiana, led by guns seized at New Orleans' Louis Armstrong International Airport. So far this year, the Transportation Security Administration has intercepted 83 guns at airport security lines across Louisiana, including 56 in New Orleans.

"We are pretty certain we're going to unfortunately set a record," said Sari Koshetz, spokeswoman for the Transportation Security Administration. "It's not the kind of record we want to set."

By a narrow majority, the Supreme Court of Delaware recently struck down decades-old regulations that it found conflicted with the state constitution by �completely eviscerat[ing] a core right to keep and bear arms for defense of self and family outside the home.�

Article I, Section 20 of Delaware�s Constitution protects the right �to keep and bear arms for the defense of self, family, home and State, and for hunting and recreational use.� Courts interpreting Section 20 have found this state law is �intentionally broader than the Second Amendment� and specifically protects an independent right to bear arms outside the home.

There�s nothing about �shall not be infringed� that is unclear. Self defense and the right to bear arms is a right our founders recognized in the Bill of Rights. This right extends to individuals whether they are in their home, in public, or in another state.

The present law allows for states to deny individuals this right by not accepting concealed carry permits from other states. Currently, ten states do not accept any out-of-state permits while other states accept permits from certain states and not from others.

I don�t think THE PUNISHER pulled any punches on showing the uglier sides of gun control debate. Why should it, when this is the same show that shows us people facing brutalization by bullets nearly every single episode? THE PUNISHER covers the parts of gun control that aren�t so black-and-white. From reasons why someone who is purportedly anti-gun would have a concealed carry permit to why average citizens might turn to pro-gun ideas in our society.

To carry a concealed weapon in California, you must have a conceal and carry weapons (CCW) permit.

In Sacramento County, the sheriff's department determines if someone qualifies for a license by looking at four requirements: good moral character, good cause for the license, is a resident of the county and has completed firearms training.

A newly released state audit found inconsistencies with the Sacramento County Sheriff's Department permitting process for CCW.

The state auditor reviewed three counties: Sacramento, Los Angeles and San Diego.

Philipstown town board members signaled their intention to support a proposed gun safe storage ordinance that�s garnered attention inside and outside the west side of Putnam County.

The potential local law would require gun owners in Philipstown to store their weapon or weapons securely to prevent theft and/or access by children and other people who should not possess firearms. No owner or custodian of a firearm would be able to leave their firearm out of his or her immediate possession in their home without physically giving it to a lawful custodian, having it placed in a locked container or having disabled the gun with a safety locking device.

Democrat leaders finally recognize the important role guns play in self-defense.

Now that�s a headline we�ll never see.

One of the main problems in the gun debate is the fact that gun control proponents always focus on the tool causing injuries or deaths, while conveniently neglecting the fact that guns save a significant number of lives in comparison. And even that misses the bigger point about constitutional rights and Liberty. In other words, there�s no real debate at all.

For years, if not decades, the gun control lobby has been pleading with firearms owners to come together and find some �common ground� on gun control, and in so doing, they started with the wrong message and certainly the wrong sales pitch.

Instead, let�s find some common ground on gun rights.

For openers, can we agree that the Second Amendment should be treated with the same respect as the other amendments in the Bill of Rights? The Second Amendment is no less important than the First Amendment, or any of the other eight amendments in the Bill of Rights.

Arkansas lawmakers have approved the rules for a new measure expanding where concealed handguns are allowed, rejecting concerns that it would allow students to keep guns in dorms or could infringe on Second Amendment rights.

The Legislative Council approved the rules Friday for carrying out the law, which allows people with concealed handgun licenses to carry at college campuses, government buildings and some bars if they undergo additional training. The council is the Legislature's main governing body when lawmakers aren't in session.

Moms Demand Action representatives say that in 2017 nine of their volunteers won seats in local elections around the country. But for next year, over a dozen have already announced plans to run � with potentially hundreds more getting ready to throw their hat in the rings.

Ostensibly to combat illegal trafficking of firearms, S.2063 instead arbitrarily limits law-abiding citizens to one firearm purchase or transfer a month and creates unnecessary red tape. In addition, the measure makes no exception for the loaning of a firearm and eliminates the online portal for private sales, thus moving all private firearm transactions to a licensed firearm dealer. This proposal also allows dealers to charge up to $10.00 to facilitate such a transaction.

There is little evidence for the effectiveness of gun rationing laws.

FBI figures show surging interest in concealed carry licenses in the nation�s capital following a recent court ruling that effectively ended D.C.�s discretionary licensing regime.

D.C. officials decided not to appeal the ruling in early October. That month, the FBI ran 217 background checks for D.C. residents, two-thirds of them in connection with concealed carry license applications. By contrast, only one-licensed related check was run in September, and no one had applied for a concealed carry license at all during the previous October.

The surge then continued in November, with 75% of the city�s record 365 National Instant Criminal Background Check System queries run for concealed carry licenses.

On 28 November, 2017, the Honolulu Star Advertiser wrote that the Honolulu Police Department had been sending letters to people that were both registered gun owners and registered medical marijuana users.

The letters ordered the medical marijuana users to turn in their guns.

Add to this dangerous brew officers who are either poorly trained, or not trained at all in de-escalation tactics, especially when in contact with individuals who possess (legally, or otherwise) firearms, and it is less a matter of if, than of when, deadly confrontations occur.

And, these are just the more obvious cases.

Police deserve our support and respect, but this should not preclude us from demanding reforms to a problem in which exercising Second Amendment rights � either intentionally, passively, or in the case of Shaver and Crawford, not at all � exposes gun owners to greater risks of deadly confrontations with police.
