President Barack Obama is trying to put Republicans on defense in the U.S. debate over gun rights with a call to ban people on the government's no-fly list from buying firearms. The trouble is his proposal may be unconstitutional.
The idea is an occasional subject of Democratic legislation that Obama gave new life after the Dec. 2 mass shooting in California that killed 14 people, which the FBI has labeled a terrorist attack. Neither of the attackers, Syed Rizwan Farook and his wife, Tashfeen Malik, were on the no-fly list. |

Since our nation�s founding, all 44 of our presidents have sworn to uphold and defend the Constitution of the United States. Most have understood that this means the entire Constitution, not just the parts they like. But today, President Obama believes a key provision of our Constitution � the Second Amendment � does not apply to him. He believes the relevance of the right to bear arms has somehow changed since our founding, and that it is no longer his duty to uphold or defend it. |

I almost feel sorry for the gun-control crowd.
They keep trying to convince themselves that people are on their side, but schemes to restrict the 2nd Amendment keep getting defeated on Capitol Hill.
And when a handful of state governments go against the trend and try to trample on constitutional rights to gun ownership, politicians get tossed out of office and gun owners engage in massive civil disobedience.
Now we get to the icing on the cake.
The New York Times just released polling data showing that a majority of Americans are against banning so-called assault weapons. Look at the bottom line and see how the numbers have dramatically moved in the right direction. |

James Collins just walks, but the sidewalk has become a tightrope. That's because of what he carries.
Strapped across his back is an AR-15 rifle with the muzzle pointed towards the ground. It's perfectly legal for him to carry it -- openly.
"I just want to have the extra protection to defend myself and defend my family," Collins said on Thursday.

In its third opinion in the same case, a majority of a three-judge panel ruled Dec. 14 that a state law prohibiting doctors from asking patients about gun ownership is valid.
In earlier rulings, the U.S. Court of Appeals for the Eleventh Circuit held that the Florida Firearm Owners Privacy Act was a valid regulation of physicians' speech. It first said the law fell within the state's right to regulate licensed professionals (145 HCDR, 7/29/14). The second time the panel looked at the law, it upheld it under the First Amendment's intermediate scrutiny standard (146 HCDR, 7/30/15).
This time around, the panel applied the First Amendment's strict scrutiny standard and said the provision passed constitutional muster. |

The demand for conceal carry in Arkansas has gone up.
Over the past few months, local firearm and self-defense training facilities have seen an increase in the demand for conceal and carry firearm classes.
Marty Cale, owner and chief instructor at Krav Maga self defense center in Fayetteville said the demand for conceal carry permits in northwest Arkansas has gone up. |

Ultimately, as we show in our latest ABC/Post survey, for everyone who wants to address terrorism with stricter gun laws, there's someone else who sees an armed citizenry as the best defense. This sense may rise in response to external threats; the shift to majority opposition to an assault weapons ban is a new phenomenon. It didn�t appear in a pre-Paris, pre-San Bernardino poll by the Pew Research Center in July (57 percent in that survey supported an assault weapons ban). And our finding is confirmed in a new New York Times/CBS News poll, which also found support for banning assault weapons at a new low. |

Republican members of Congress have taken aim at the Obama administration with their latest move involving a highly-contentious fight between gun rights advocates and the State Department.
Filing an amicus brief on behalf of Defense Distributed Thursday, congressional Republicans came to the defense of a non-profit firearms manufacturing company currently entangled in a legal battle with the State Department.
In Defense Distributed v. U.S. Department of State, the Obama administration is citing the International Traffic in Arms Regulations (ITAR) in an effort to curb Defense Distributed�s effort to publicly post online blueprints of 3D printable firearms. |

It wasn�t until last week that I realized the ACLU opposed gun control. The co-chair of the Colorado ACLU announced his support for use of guns in self-defense on Facebook.
Unfortunately, in the resulting furor he was forced to resign. Indicating that he owned a firearm apparently was too much for his colleagues to bear.
Of course, Loring Wirbel�s original endorsement was a bit unusual. He wrote: �we have to really reach out to those who might consider voting for Trump and say, �This is Goebbels. This is the final solution. If you are voting for him I will have to shoot you before Election Day.� They�re not going to listen to reason, so when justice is gone, there�s always force.� |

The responses to gun violence vary wildly in different regions of the country and across different parts of the ideological spectrum. Many are calling for more legislative regulation of firearms, while others have decided that the best way to protect themselves from gun violence is to get a gun of their own.
On Black Friday, several states reported record-setting gun sales, including Utah. The Bureau of Criminal Identification (BCI) conducted 2,485 background checks on the day after Thanksgiving. "It was our highest day in the history of the program, and we've been doing this 17 years," said Lance Tyler, the BCI�s Brady Background Check section supervisor. |

History has shown us that gun-free zones do not provide a safe environment, although that has been the main selling point for their creation by Congress.
If we truly value the lives of our children, maybe the time has come to eliminate these gun-free zones, which have become free-killing zones, and instead actually allow adults to defend themselves and any unarmed Americans from being totally defenseless. The police are 10-plus minutes away. We cannot afford hiring full-time police to defend these areas. Besides, they would be the first to be targeted in any attack. Let teachers carry concealed weapons and provide them with training. |

The Paris and San Bernardino attacks have fueled a surge in US gun sales, as Americans seek to protect themselves � and stock up in case lawmakers finally act to tighten firearms controls.
Since a Muslim husband and wife opened fire in California on December 2, killing 14 people and wounding 22 others, sales at the RTSP range in New Jersey � one of the largest centers in the northeastern United States � have surged 50 percent, according to one of its owners.

So, what is to be done?
The latest outrage against innocent lives, this one in California, once again raises the issue of easy access by evildoers to weapons of mass destruction. We invaded Iraq in 2003 ostensibly to rid that nation of such weapons, but back home in America we allow them to be bought and sold in bulk, and even encourage these nefarious transactions.
Ed.: I don't recall ever seeing nuclear, biological, or chemical weapons offered for sale in bulk. |

When Texas� open carry law begins at the beginning of 2016, Lubbockites can openly carry handguns inside the council chambers during council meetings and all public meetings.
After several hours of hearing citizens� comments at Thursday's council meeting, city leaders voted to reject two resolutions aimed at disallowing concealed and open carry during council meetings. The two resolutions were presented by Councilwoman Latrelle Joy, and both failed by a vote of 5-2.

Way up in a New York high-rise, inside the headquarters of Cerberus Capital Management, Stephen A. Feinberg had reached a sobering conclusion: The guns had to go.
It was mid-December 2012, three years ago this week, and 20 children and six adults had just been gunned down at Sandy Hook Elementary School in Connecticut.

Astronaut Capt. Mark Kelly said he has several firearms and has not once questioned the Second Amendment since his wife, former Congresswoman Gabby Giffords, was shot in Tucson, Arizona, in 2011.
But upon announcing the start of new organization in New Hampshire promoting safer gun laws, Kelly said he questions why loopholes still exist in federal law that allow people legally barred from purchasing a firearm to acquire one online or in the parking lot of a gun show.
