How many times have you heard or read this: �If people shouldn�t need photo ID to vote, why should it be required to buy a gun?�
Too many left-tilting reporters and politicians quickly dismiss this question as redneck rhetoric, but don�t let them get away with such dismissive condescension. It is a legitimate question because we�re not talking about guns, we�re talking about rights and all constitutionally protected rights are equal, especially the ones enumerated in the federal and state constitutions. |

Sen. Tom Brewer wants a Nebraska constitutional amendment granting the right for individuals to carry concealed weapons with no need for a license. This not what we would call safe and proper use of a firearm. In our responsible and safe society, requiring a license to carry a concealed firearm does not restrict gun ownership as Sen. Brewer is implying.
Sorry, Senator, but you�re misguided on this one. For one to carry a concealed firearm, we will continue to require a license. |

A bill moving to the Senate floor in early January would explicitly bar towns and cities from enacting firearms regulations on municipal-owned property, and would allow residents to sue the town to force officials to remove the ordinances. Residents who sue could get $10,000 in court settlements. Town officials who lose a lawsuit could be forcibly removed by the governor.
The bill, House Bill 307, has pitted firearms rights groups � from the National Rifle Association to Gun Owners of America � against town officials and gun safety advocates. And it has reignited debates over how far �local control� should extend in the state. |

The state senator says his message in the card is clear and to the point.
"It�s not meant to be offensive to anybody. It�s more so to send a message of where we stand on the Second Amendment,� Brattin said.
The card features Brattin's family holding real weapons, like shotguns and assault rifles. Even the youngest of the group has a gun in their hands.
"I would much rather train my children to know and respect the tool in which they�re handling that way there is no such tragedy that occurs or accident," Brattin said. |

Under current law, those with concealed carry permits who are stopped in their vehicles are required to promptly notify law enforcement when they are carrying their weapons. SB 215 shifts the burden from the permit carrier to law enforcement, who must ask if there is a weapon in the vehicle. The bill further reduces the penalty for failing to notify law enforcement from a first degree misdemeanor to a misdemeanor of the second degree. The bill initially proposed a minor misdemeanor penalty for failing to accurately answer an officer�s direct question, but was later upgraded when law enforcement officials and agencies expressed their concern. |

This is at issue each time you hear about a First or Second Amendment challenge to state legislation. While the Bill of Rights didn�t originally apply to the states, the 14th Amendment required that individual protections guaranteed by the U.S. Constitution must also pertain to state and local governments.
Unfortunately, just a few years after its ratification, the Privileges or Immunities Clause of the 14th Amendment was virtually written out of the Constitution by a series of Supreme Court decisions. The result was increased difficulty for people trying to vindicate their civil rights in court or fight racial and economic discrimination in the states. Anyone interested in racial justice should know about the 14th Amendment. |

But when it comes to the issues of temperament or their knowledge, what I do in the cases of Ninth Circuit judges, Trey, is I send them several U.S. Supreme Court cases that have an impact on Alaska. I ask them to read them so that they're up-to-speed on big issues in my state. And then I talk about issues, like the Second Amendment. Let me give an example. Nearly 70% of the households in Alaska are gun owners. The Second Amendment is hugely important to my constituents. So I raised the issues that matter to Alaska and, to be honest, these judges usually don't know anything about these issues, and it's a way to educate them. |

On Wednesday, December 15, 2021, the Ohio Senate brought Senate Bill 215 to the floor and passed it with a vote of 23 to 8. The bill now moves to the House.
Last month, on November 17, the Ohio House passed House Bill 227, which was then introduced into the Senate.
That means we have two bills, one in each chamber, that are halfway to the goal line. More importantly, we have successfully put Representatives and Senators on the record supporting and voting in favor of Constitutional Carry. So as we come to the close of the year, we are closer to putting a bill onto the Governor�s desk than at any time in history. And we hope to make this a reality before the primary election next year. |

The purpose of the Second Amendment is to protect the ability of each state to call up its army. It precludes the new central government from disarming the people of the state. It was not intended by its framers, its framers being the states, to prevent the states from regulating firearms or to frustrate each state�s normal police powers to protect the health and safety of their communities.
An individual�s right to bear arms, to the extent such a right exists, may be based on historical precedent or traditional usage or state law, which precedent or usage or state law can be recognized and upheld by the central government. |

A Missouri law forbidding local police from enforcing federal gun laws poses a threat to the public, according to the U.S Department of Justice. A court brief filed Tuesday by the DOJ outlines multiple examples.
One instance highlights an Independence police officer who was killed in a shootout in September. Local authorities initially refused federal assistance in tracing the murder weapon. |

Known as "constitutional carry" or "permitless carry," it's a change to Indiana law that some Republican legislators have been working on for years.
"It's still -- to me, it's an infringement of our constitutional rights to mandate -- require -- somebody to jump through hoops, go get fingerprinted, pay a fee -- you still have to pay to get your fingerprints done -- wait God only knows how long," said State Rep. Jim Lucas (R-Seymour), one of the lawmakers planning to introduce this type of bill. |

He laid an ammo can on the ground in the sand and fired one round into it. The can shot up in the air about 3 feet, and was propelled backwards about 10 feet. He then showed us the entry point of the bullet, a small maybe 1/2-inch diameter hole and the exit point, a 6- to 7-inch massive, jagged hole. He then told us that he demonstrated on a metal, ammo can what it would do to a human body. |

HR 3960 effectively scatters the functions of BATFE across the entire Department of Justice. We could very well see some provisions kicked over to the FBI. Others could go to the United States Marshalls. It would likely be harder to keep track of every function. It could very well depend on who the attorney general is. For a hack like Merrick Garland, it is a huge chance for mischief, to put it mildly. |
