BRYAN A former Brazos County deputy constable will serve prison time on a pair of charges from 2011.
Agustin Rubio pleaded guilty Friday in a Brazos County court and was sentenced to eight years in prison on a pair of charges, one for kidnapping, the other for an attempted sexual assault.
Rubio was first arrested in late August 2011 for the kidnapping of a woman on Fraternity Row in College Station. Rubio placed his victim in handcuffs and in the back of his patrol car, but instead of taking her to jail, left her in a parking lot.
Following his arrest on the kidnapping charge, a woman came forward saying that in June 2011, Rubio had arrested her. He was accused of following her into the restroom and attempting to assault her.

Internal Affairs concluded the officer did not break the law by not calling 911 and not doing a report because property damage was less than $500. He was suspended, but is not facing any charges. Fiorentino-Tyburski said his hood was only scuffed and he did not think Nunn had been injured. However, police said Fiorentino-Tyburski should have noticed that Nunn never got up and that the officer was deceptive and evasive when he was asked about the accident. Police said Fiorentino-Tyburski failed to tell his supervisor about it when he got to afternoon lineup, which is where he was headed when he hit Nunn. The department docked 88 hours of his pay. |

Contrary to claims made in the Dec. 4 editorial, "Guns laws won't get fixed with warning shots," nothing in HB 89 or SB 448 allows warning shots nor do they promote or encourage warning shots.
Warning shots are not safe. Nonetheless, when people are in fear for their lives or the lives of loved ones, they might fire a warning shot rather than shoot someone. People make mistakes and do irrational things when in fear of death or injury. That doesn't mean they should go to prison for 20 years when there was no injury or harm done.
Warning shots are an unsafe result of the glorification of such conduct in movies and on TV. No one is recommending warning shots. |

An investigation into a fatal shooting in San Bernardino led to the arrest of the dead man�s accomplices on Friday, Dec. 6, and the release of the man who killed Manuel Alfred Galvan.
Oscar Hernandez, 30, was arrested Dec. 2 on suspicion of murder. But San Bernardino police detectives determined that Galvan had first fired at Hernandez, who then shot at Galvan in self defense, Lt. Paul Williams said. |

The nation will mark the first anniversary of the tragedy at Sandy Hook Elementary School Dec. 14, a year when Virginia passed school safety bills in a matter of months, while leaving laws on background checks unchanged.
Just days after the massacre, Vice President Joe Biden selected Petersburg Police Chief John I. Dixon III to serve on his gun safety task force. In an interview Thursday, Dixon said he is encouraged by the progress made by several states across the country, but laws at the federal level do not go far enough.
"I think this will always be on America's conscious, forever," Dixon said. "[Improved gun control] is happening state by state. But we need to have a good strong federal push for this." |

However, the access and availability of firearms is associated with an increased risk of suicide in the home. One study concluded that a household is five times as likely to have a suicide in that home if there is a gun in the home. Overall, guns kept in the home were 22 times more likely to be used in accidental shootings, assaults and suicide attempts, than in an act of self-defense, according to the Brady Campaign to Prevent Handgun Violence. |

Legislation to ban plastic guns that can't be detected by metal detectors could head to the White House for President Obama's signature on Monday night, hours before the ban expires at midnight.
Senate Republicans appear unlikely to object when Democrats seek unanimous consent to extend for 10 years the ban on the manufacture, possession and sale of the plastic firearms. The House passed the measure on Tuesday by voice vote. |

Dec. 14 marks the one-year anniversary of the Sandy Hook shooting that left 20 children and six adults dead. The gun control group Moms Demand Action commemorated the upcoming anniversary by releasing a video timed to the Newtown shooting.
According to the Huffington Post, the commercial, which was co-produced with Mayors Against Illegal Guns, is meant to remind viewers to speak out against gun violence. A press release explains exactly what the campaign aims to accomplish. |

The UK Home Office has added language to its firearms rules, making clear that it's generally illegal to make, own, or sell 3D-printed guns. A revised version of its licensing policies says that guns like the Liberator, designed by Defense Distributed and released to the world in May, are covered under and forbidden by the Firearms Act 1968 � manufacturing 3D-printed guns or parts is effectively already banned because of rules against manufacturing guns or gun parts except under certain exemptions, but the guidance now includes explicit text to that effect. "3D printed weapons are potentially lethal barreled weapons and must be viewed as such in law," it reads. "The method of manufacture is not material to this consideration." |

Not true! In point of fact the AR-15 semi-automatic platform is the most popular shoulder arm used in America today, for hunting deer, elk, prairie dogs, for target shooting, by the police and myriad of gun enthusiasts. Almost every manufacturer of rifles has a version of this gun, including our own gun manufacturers here in New Hampshire, Ruger and Sig. Bushmaster was manufactured in Maine, Colt, Mossberg, Savage, DPM, RockRiver, Panther, the list goes on and on. It is not an assault rifle. It is not a selective fire weapon, but as far as the Moms are concerned it looks scary so lets ban it. |

Reps. Charles Boustany (R-La.) and Bill Cassidy (R-La.) both supported the National Right to Carry Reciprocity Act on Wednesday, which would allow gun owners with concealed carry permits to carry concealed guns outside the state their permit is issued in.
�This legislation establishes that a person legally authorized to carry a concealed weapon will be allowed to do so in other states that also authorize concealed weapons,� Boustany said. �These permit holders will still be required to obey the laws of the state they are visiting. Law-abiding permit holders should be allowed to travel between states without fear of prosecution.� |

The Second Amendment Foundation is launching a nationwide television advertising effort, calling attention to �Guns Save Lives Day� on Dec. 15 2013, in conjunction with Bill of Rights Day. SAF founder and Executive Vice President Alan Gottlieb announced the campaign, noting that the organization has bought �hundreds of thousands of dollars of air time� on Fox News, DISH TV, and Glenn Beck�s Blaze Network. He has also purchased air time on national conservative radio talk shows, SiriusXM satellite radio and major radio stations. |

Giffords, who resigned from Congress after being shot by a gunman in 2011, recently closed her campaign and transferred the remaining balance � nearly $300,000 �to a newly-created Rights and Responsibilities PAC, Pia Carusone, senior adviser to Rep. Giffords, told msnbc. Giffords intends to assist candidates who support both Americans� Second Amendment rights and are working to find gun-violence resolutions.
She initially donated money to Sens. Pat Toomey, Susan Collins, and Kay Hagan - two Republicans and a Democrat, all of whom favored the background checks bill that failed in the Senate earlier this year. The PAC will make donations to other individuals throughout the year. |

Lt. Col. Robert Bateman, the second amendment-hating Army Officer who caused controversy after vowing to �pry your gun from your cold, dead, fingers,� works closely with the Department of Homeland Security.
Earlier this week, Bateman, an active military commander, penned a piece for Esquire magazine in which he promised to push for a total ban on all firearms besides muskets, shotguns and rifles, and shut down all gun manufacturers except for those who produced weapons for the federal government and the armed forces. |

Yesterday�s CNN headline said it all: �Shocking new gun control ad released around Newtown anniversary� and they weren�t talking about Thursday�s release of a �Guns Save Lives� advertisement that began airing yesterday on the rival Fox News channel.
The �No More Silence� ad is sponsored by the anti-gun Moms Demand Action for Gun Sense in America and Michael Bloomberg�s Mayors Against Illegal Guns (MAIG). Far from silence, the group, Moms Demand Action for Gun Sense in America, is planning to ring bells at gatherings in 35 states on the 14th � alarm bells about the continuing national trauma from gun rampages, which occur on average about once every two weeks, taking a minimum of four lives on each occasion.
