NC: New law allowing loaded guns in national parks takes effect today

Loaded guns are allowed in Great Smoky Mountains National Park, on the Blue Ridge Parkway and in other federal parks and wildlife refuges under a law that takes effect today.

For avid park users like Tom Showalter, who spends a lot of time pedaling the parkway and doing volunteer trail maintenance in the Smokies, it's an invitation to violence.

It's a bad law, said Showalter, who teaches history at Warren Wilson College. It just brings people with guns into contact with people without guns. It's totally unnecessary.

But gun-rights advocates say people should be able to carry guns in national parks as a means of protection.

The guns-in-workplace issue gained steam with the indefinite suspensions slapped on Washington Wizards Gilbert Arenas and Javaris Crittenton after they brought firearms to practice. New York Giants receiver Plaxico Burress remains imprisoned after accidentally discharging a firearm in a New York nightclub.

But it took less than a day for a hunting-happy ballplayer to take offense.

St. Louis Cardinals closer Ryan Franklin is upset about the ban, telling the St. Louis Post-Dispatch that "a few guys screwed it up for everybody."

I would like to address this in two parts. The true laws of the country and state we live in. And, my personal opinion on this subject.

...

The obvious: Our tattered and seldom-read Constitution of the United States of America's Second Amendment says I, as a citizen, have the "right" to bear arms. Not a privilege, a right. Nowhere does it define this as pursuant to hunting or recreation. It does not define it by saying open carry or concealed. It simply says I have the "right." As a matter of fact it does not even describe what type of gun I may have.

I refer to the news article in the same issue of The Bellingham Herald in which the letter appears. A stabbing took place on State Street because one person bumped into another person. Later it was discovered that others involved were also armed with weapons.

It is a legal right to carry a handgun in our state. When purchasing a handgun one must complete a form requiring personal information and a background check is done. Those who do carry are required to have concealed weapons permits issued through the law enforcement agencies of our state after both fingerprint and another background check has been completed.

Ed.: In Washington, a permit is only required for *concealed* carry.

Today in the United States, all able-bodied male citizens between 18 and 45 years old, who are not already members of the regular armed forces, or members of the National Guard or of the Reserves, who constitute the organized militia, are the unorganized militia.

Unorganized Militia not organized.

The right of the people to keep and bear arms are women citizens not people? Are 15- to 17-year-old males citizens not people? They were in the militia in 1775 and 1898. Are 46- to 107-year old male citizens not people? Their right to keep and bear arms shall not be infringed. The right of the people.

Dr. Keith Ablow, a forensic psychiatrist from Tufts University in the Boston suburb of Medford, said the tenure denial could have been like "a kind of deadly assault on her ego" if her self-worth was wrapped up in her academic credentials.

"In that way, firing a gun at those people could feel like self-defense in a twisted way," he said.

The House of Delegates passed a bill last week ensuring that employees, customers, tenants and other Virginians can store their guns in a locked vehicle on a public parking lot.

House Bill 171, approved on a 72-27 vote, says, No person, property owner, tenant, employer, or business entity shall maintain, establish, or enforce any policy or rule that has the effect of prohibiting a person who may lawfully possess a firearm from storing a firearm locked in or locked to a firearms rack in a motor vehicle in a parking lot, parking space, or other similar property set aside for motor vehicles.

The National Shooting Sports Foundation (NSSF) the trade association for the firearms industry hailed todays ruling by the Washington State Supreme Court holding that the Second Amendment rights of law-abiding Americans are applicable to the states through the 14th Amendment.

This decision by the Washington State Supreme Court is a welcomed development and victory for the rights of law-abiding firearms owners, said Lawrence G. Keane, NSSF senior vice president and general counsel. Americas firearms industry remains optimistic that the U.S. Supreme Court will rule in the upcoming McDonald v. City of Chicago case that the Second Amendment is a fundamental individual liberty that all states and local governments must respect.

Clutching cups of coffee and chatting in loose groups, the people outside Starbucks on Sunday didn't look particularly unusual, save for the holstered guns strapped to nearly everyone's hip or thigh.

The display of Smith & Wessons, Glocks and Kel-Tec pistols among lattes and coffeecake was part of an organized rally to spread awareness about Wisconsin's open carry law as well as the recent treatment of a Sussex gun carrier by local law enforcement. Participants later drove to the Wisconsin State Patrol District Headquarters in Waukesha and demonstrated on the front lawn.

A new piece of evidence in the trial of a pharmacist accused of murder is causing controversy.

A security guard found a shell casing from a 22 caliber bullet at the Reliable Pharmacy almost three months after the incident, but some are debating how it got there.

According to Jerome Ersland's attorney, the shell casing could have come from anywhere. In fact, defense attorney Irven Box said it may have been in the pharmacy the entire time but was missed by police. However, there is also concern Ersland could have planted it.

Gun owners who want to have an extra-heavy pack can carry their firearms in the countrys national parks and wildlife refuges starting today.

Aside from adding extra weight or expressing Second Amendment rights on principle, however, its rather pointless.

Heres why: A new law goes into effect today allowing the lawful carry of firearms in the parks and refuges in accordance with state laws. But actually firing the guns remains outlawed.

The law has caused little concern for park rangers, who are charged with enforcing the laws inside parks.

Perhaps emboldened by its headway in protests against the old Colosimo's Gun Center, an interfaith group rallied yesterday against a new target - the Shooter Shop in Kensington.

This time, though, the demonstrators ran into an opposing force: a contingent of pro-gun counterprotesters.

It all added up to a lively demonstration of the First Amendment and a quarrel over the Second Amendment as the sides each mustered about 40 protesters outside the gun shop, on Allegheny Avenue.

When the antigun advocates from Heeding God's Call went into silent prayer, the pro-gun folks sang "God Bless America." When the antigun folks sang a hymn, an opponent shouted, "Long live the Second Amendment."

One of the men who sued the District for the right to keep handguns at home is taking D.C. back to court.

This time, Tom Palmer wants the right to carry firearms in public.

According to the Washington Post, Palmer says the Second Amendment is on his side. He claims the right to bear arms means the right to carry them with you.

The case is pending in U.S. District Court.

Palmer claims he wants to carry a gun for safety.

Opponents said there's nothing safe about letting people walk the streets of Washington with loaded guns.

Duncan Dohmen wants people to notice the pistol he carries.

He isn't a police officer and tells people that when he's asked. He likes these chances to educate people about a right afforded them 219 years ago -- a right he fears could be stripped.

"Rights not exercised are rights lost," said the 68-year-old resident of Covington in King County. "... I was walking around for 18 years with a pistol secretly concealed and it alarmed nobody. Then I realized that (openly) carrying a pistol might cause questions."
...

"Most are curious and want to know, 'Can you do that?' And then I explain," he said. "I think some think I'm a cop and just don't say anything. I make sure to tell them no because I don't want to impersonate."

Speaking of public safety, the Post profiles Tom Palmer, the Cato Institute fellow who was a plaintiff in the case that reversed the D.C. ban on handguns. (He drives a Smart car, so consider all my predispositions totally blown.) Palmer has now filed another suit against the city for the right to carry handguns in public. Palmer relays that a frightening confrontation in 1982 in which he drew a gun on a set of "thugs" convinced him that carrying a handgun was necessary for self-protection. Plus he is all about taking the Second Amendment as literally as humanly possible. I bet the Secret Service is absolutely thrilled about this.

Memo to all Major League Baseball players: Leave your guns at home. A new policy from Commissioner Bud Selig's office bars anyone in MLB from bringing firearms and other deadly weapons into locker rooms or on road trips. Notice of the policy was tacked on the walls of every spring-training clubhouse Friday. Aside from guns, the prohibited weapons include "explosives, daggers, metal knuckles, switchblade knives and knives having blades exceeding five inches."

Homeland Security Secretary Janet Napolitano says terrorists who are U.S. citizens or live in the country legally and plot against the U.S. are just as big of a concern as international terrorists.
She says that when she started as secretary a year ago, the focus was largely on international terrorists who want to harm U.S. interests. But in the past year, more of the violent extremism that has been seen overseas is showing up in the U.S.
She says officials need to drill down and analyze the factors that make a young person, raised in the U.S., migrate to extremist beliefs and actions.
Napolitano was speaking to governors who are in Washington for their annual conference.

Thanks to a new federal law beginning February 22, people who can legally carry concealed handguns according to state law can also carry within National Parks and Forests in that state, too. While this may help protect visitors from the parks burgeoning crime problem, the story of this laws journey through Congress provides a lesson in campaign contributions and anti-Liberty special interests.

"The 'common sense' theme established by the letter is happily coincidental. My "Rights Watch" column for the month is 'Senseless in Seattle,' commenting on media coverage and calls for more "citizen disarmament following "the murder of four police officers in a Pacific Northwest coffee shop by a felon with a history of violence"--one aided and abetted by family members. Yeah, a lot of sense that makes, to impose more infringements on you and me."

Lower Merion School District officials brag that they give every one of their 1,800 high-schoolers laptop computers to "ensure that all students have 24/7 access to school-based resources."

Instead, they ensured they got a 24/7 sneak peek into students private lives by secretly monitoring webcams embedded in the laptops to spy on teens and their families at home, according to a federal, class-action lawsuit filed this week in Philadelphia.
