Given that his thumbnail bio at the bottom of the page states that he is a professor of Criminal Justice (in addition to the Biology professorship he claims in the essay) I must assume that the piece is satirical, but since I am sure that he has colleagues as clueless as he is pretending to be, I am going to address his points as if they weren�t . . ." ... |

In an effort to present a full picture to the plight of outspoken NJ Gun law critic James Kaleda, I felt it wise to devote an entire column to the dissection of the New Jersey Firearms Purchaser Identification card application. An unwary or naive applicant can easily run afoul of the law, through no real fault of their own and absent any criminal intent or deliberate effort to mislead or provide false information
SUBMITTER'S COMMENT: The Democratic People's Republic of New Jersey not only requires that citizens apply for a permit to exercise a constitutional right, but sets snares to trap those innocents who do so. |

Another point it would have been worth exploring: Even in states that impose a duty to retreat, it may be qualified so much that in practice it is little different from "stand your ground." In New York, for example, the victim of a public assault is expected to retreat rather than use lethal force only if he "knows" he can do so "with complete personal safety" for himself and others. Furthermore, there is an exception for someone who "reasonably believes that [the] other person is committing or attempting to commit a kidnapping, forcible rape, forcible criminal sexual act or robbery." |

Last year, more than 145,000 conceal carry licenses were issued by Ohio counties, almost twice that of 2012.
And since it was enacted in 2004, there are now 400,000 residents who are permitted to conceal their handguns on their person.
Rick Kaleda of the Buckeye Firearms Association told Sound of Ideas host Mike McIntyre that these numbers speak for themselves, in demonstrating people�s interest in armed self-defense. |

A Clark County judge today dismissed all charges against a Vancouver homeowner who shot and killed an alleged car prowler in January 2013.
Superior Court Judge Dan Stahnke dismissed a second-degree murder charge against Sean H. Doucette at the request of prosecutors.
�This has had a very damaging impact on his life,� Doucette�s attorney, Steven Thayer, said Wednesday. �He had to go to considerable expense to defend himself and to redeem himself, and essentially, he had to prove his innocence, which he has done.�
Doucette shot and killed Iosif Dumitrash, 19, of Portland just before 4 a.m. Jan. 29, 2013, in the 14800 block of Northeast 33rd Street. |

Legislation expanding Florida�s self-defense law to include showing a weapon or firing a warning shot in self-defense has sped through the Senate with bipartisan support.
The bill (SB 448) would include the �threatened use of force� in Florida�s self-defense statute.
Currently, the law � commonly referred to as Stand Your Ground � allows a person to use deadly force if they fear death or �great bodily harm,� but it includes no provision for firing a warning shot or showing a weapon. |

Californians have flooded several sheriff offices with applications and inquiries for permits to carry concealed guns.
Sheriffs in some politically conservative or rural counties reported spikes in applications while other counties in the state experienced smaller increases.
Demand is being driven by a federal appeals court ruling last month that made it easier for residents to obtain the hard-to-get permits. About 56,000 Californians have a concealed-weapons permit in a state of 38 million residents. |

Residents had until Thursday to turn in their magazines, Ruchman wrote, but by that afternoon he had come across some pretty shocking statistics:
�Sunnyvale police say nobody has showed up at the city's Department of Public Safety to turn over their magazines,� he reported last week.
One of those high-capacity magazine owners is 67-year-old Leonard Fyock, who is also a plaintiff in a lawsuit challenging the law filed by the National Rifle Association. Speaking to Ruchman last week, he said he simply gathered his soon-to-be-contraband ammunition holders and took them outside of Sunnyvale limits. |

The first thing Dr. David Adams did when asked about the bill allowing licensed gun owners to have their weapons in a school parking lot was bring out his wallet and show his gun permit.
"I have a gun permit. I own a gun. I'm not highly trained. I know there are a lot of people who feel like they have the right to carry their gun anywhere. I get that. I just don't think a school is a good place to keep and store those," said Adams, the superintendent of Shelbyville Central Schools.
Originally a bill to address gun buybacks, Senate Bill 229 was amended to allow licensed gun owners to bring firearms onto school property as long as the weapons are kept in a locked vehicle out of sight. |

Lori Haas and Mary Kay Mace wrote Governor Otter today urging him to veto SB 1254. Both women have daughters who fell victim to gun violence in two separate rampage shootings on different college campuses.
Emily Haas survived two gunshots to the head while attending French class at Virginia Tech in April of 2007. Ryanne Mace was a sophomore majoring in Psychology when she was killed at Northern Illinois University in February of 2008, just three months shy of turning twenty. |

Prosecutors recently dropped charges against 37-year-old Richard J. West after it was determined he rightfully defended himself against 44-year-old David D. Peterson with a small pocket knife at Whispering Pines Tavern.
�While the (surveillance) video didn�t show everything, it did support the eyewitness accounts that after the initial conflict was over, the alleged victim jumped in, and it was then that Mr. West wound up on his back on the floor getting the crap kicked out of him,� said Jackson County District Attorney Gerald Fox, who filed the original charges.
�His use of force was therefore reasonable, so the dismissal was on the basis of lawful self-defense.� |

A high school student in upstate New York was suspended for wearing an NRA T-shirt that touted the second amendment after he refused to turn it inside out or cover the words with duct tape.
Shane Kinney, a 16-year-old sophomore from Grand Island, located between Niagara Falls and Buffalo, served a one-day, in-school suspension Monday after he refused last Friday to turn his T-shirt inside out at the request of the vice principal at Grand Island High School. The shirt was emblazoned with the NRA logo and the words, �2nd Amendment Shall not be Infringed� across the back. |

Oklahoma lawmakers continue discussing the possibility of allowing guns on school property. HB 2329 passed overwhelmingly on the floor of the Oklahoma House of Representatives Monday, but there is still a heated debate over whether guns on school property is the right call.
Currently, many legal gun owners who pick children up from school might be committing felonies. Adults with guns who stay in their vehicles are following the law. Those who leave their vehicles with a gun inside on school property are committing a felony. HB 2329 would change that, allowing guns to be locked in cars on school property. |

The town council approved the repeal of the ban on second reading Jan. 28 .
The measure would have taken effect Feb. 27 and allowed open carry of firearms on all town-owned and -managed properties and buildings. Council's vote was 4-3, with Clark Hammelman, Chip Wilson and Mark Heath voting no. Wilson and Heath thought the issue should go to the voters, which was why Guentensberger said he collected the 2,657 signatures he submitted. |

The U.S. Supreme Court apparently has decided to let Americans choose between their Second and Fourth Amendment rights, leaving untouched a lower court decision that supported the use of a violent SWAT attack on a man�s home because authorities were concerned about the mere presence of a weapon.
The Rutherford Institute represented John Quinn, who was shot in the no-knock raid by officers because he thought his home was being invaded by criminals and reached for his weapon.
Attorneys with William Olson P.C. and the the United States Justice Foundation also submitted the friend-of-the-court brief on behalf of Quinn. |

Yesterday, we marched. Yesterday, we chanted. And yesterday, we stood in solidarity against an unjust law. Convening in Tallahassee, Florida, we organized a massive rally in a state that is ground zero for the outrageous �Stand Your Ground� laws that have propped up in dozens of states. Joined by the parents of both Trayvon Martin and Jordan Davis, as well as surviving family members of Emmett Till, we marched by the hundreds to the State Capitol. �Stand Your Ground� is an affront to the safety and security of our children, and we must reform this egregious law before we keep the nation standing on shaky ground. |

One day, the happy little town of Sunnyvale, Calif., had a brilliant idea: Ban all the guns to stop all the violence! (Or, at least, ban all the �magazines that hold more than 10 rounds of ammunition.�) And so they did, via a referendum. A 10-year battle using firearms to challenge the scope of federal power under the commerce clause ended with a whimper when the U.S. Supreme Court recently declined to hear MSSA v. Holder.
Montana Shooting Sports Association president Gary Marbut initiated the lawsuit after the Montana legislature passed the first Firearms Freedom Act in the U.S. The bill prohibited the feds from enforcing any federal gun laws on firearms manufactured in and kept within the borders of the state. |

Gun owners can now openly carry their weapons in El Paso County parks.
The Board of County Commissioners unanimously reversed a ban on open carry on parks on Tuesday.
The vote allows open carry, but the law still bans firing a weapon, and setting off fireworks or other explosive devices.
Their vote was unanimous, 4-0, and though Commissioner Hisey wasn't present for the vote, he said if he were, it still would have been unanimous because he also supported overturning the ban. |

Yesterday�s Washington Times reported the speculation, apparently gathering some steam, that Democrat party insiders are promoting vehemently anti-gun Chicago Mayor Rahm Emanuel as the party�s presidential nominee in 2016.
This is not the first time such speculation has been printed as a substitute for news. Lloyd Grove, writing in the Daily Beast almost one month ago reported that Emanuel, who served in both the Clinton and Obama administrations, �is said by well-connected Democrats to be considering the idea of running for president if Hillary Clinton opts out of the 2016 race.� |

Connecticut gun rights activists are using yesterday�s report of a home invasion by an on-line southwest Florida news service to bolster their opposition to the Constitution State�s new gun control law, and today Reason.com is reporting that one police agency is conducting an internal investigation of an officer who said he would like to �bang down your door and come after your gun.� |
