Montana law - known as the Castle Doctrine - gives residents a great deal of leeway, including deadly force, when it comes to protecting their home.
"I wouldn't advise anybody to break into anybody's home in Montana - [and] this is a great case in point. A lot of people carry weapons and Montana," Missoula County Sheriff's Office spokesperson Paige Pavalone observed.
"Montana law bases an extra emphasis on a person's property and privacy, so there's a lot of people here who carry weapons and have weapons in their home. And people in Montana will protect their property - whether it's their home, their livestock or anything on that property. |

It was just after midnight when the two targets, a male and a female both in their 20s, were inside an apartment complex in a Memphis� Whitehaven neighborhood and were approached by a man who was armed with a gun, local media reported. The man intended to rob the couple, but didn�t expect them to fight back instead.
Apparently the male victim became involved in a physical altercation with the suspect and during the course of their struggle, the female victim then grabbed the suspect�s gun. She fired several shots, striking both the suspect and her male companion. |

The whole approach is an artifice when applied to anything more than a straightforward customer purchase or client services relationship, far better in concept for �10 things your Realtor won�t tell you� for which this approach is usually applied. There�s far too much wrong in this piece to respond to point for point. Besides, the thousand-plus overwhelmingly critical comments posted in response did a good job of identifying the selective use of data and inaccuracies. Thursday�s press conference by backers of Initiative 594, the so-called �universal background check� measure, might want to explain how their proposal would have prevented last night�s slaying of a White Center teen, or any other crime.
During today�s press event, postponed from Tuesday due to the tragic KOMO helicopter crash on the street in front of Fisher Plaza, prosecutors Mark Roe from Snohomish County and Dan Satterberg from King County both acknowledged that if passed, the 18-page gun control measure will not be a panacea to violent crime. |

As it stands right now, if you shoot out a warning shot from a gun you could get put behind bars. But, that could all soon change and fit within stand your ground protection.
The Florida House on Thursday afternoon approved House Bill 89 Threatened Use of Force. Several lawmakers stood up to speak but in the end the vote was 93-24. |

In an effort to stabilize Ukraine and extend its authority, the interim government has set a deadline of Friday for turning in the illegal firearms that are now carried openly by so-called self-defense groups in Independence Square, the politically important plaza in the center of the capital.
The order was seconded on Thursday by the French ambassador to Ukraine, Alain R�my, who said the disarmament of the militias that helped overthrow the former government is a central requirement for the European Union to begin disbursing financial aid, along with the government fighting corruption. |

A federal appeals court is giving a Hawaii man another chance to argue that he should be allowed to carry a gun in public � a privilege rarely given to people in the state.
The 9th U.S. Circuit Court of Appeals issued an opinion Thursday sending Christopher Baker's motion for a preliminary injunction back to District Court. Baker filed a lawsuit in 2011 against the Honolulu Police Department after he was denied a license to carry a gun in public for self-defense.
The appeals court said the lower court erred when it ruled that Baker couldn't prove Hawaii's restrictions on carrying firearms violate the Second Amendment. |

It is bad enough that Florida lawmakers are rushing to expand the application of the "stand your ground" law that should be repealed rather than made even broader. But the House took recklessness to a new extreme Thursday by approving legislation that also allows defendants in self-defense cases to keep from the public the entire record of the case. That would essentially create secret arrests and prosecutions, and it has no place in a justice system that has to be held publicly accountable. Lawmakers should be repealing "stand your ground,' not fashioning a cover-up for those hiding behind a law that legalizes deadly violence. |

A pair of high-profile, NRA-supported guns bills won the support of the Florida House on Thursday.
One proposal seeks to extend Stand Your Ground immunity to people who fire a warning shot or threaten to use other deadly force in cases of self defense.
The second bill would prevent children from facing severe punishments for playing with simulated weapons in schools. It specifically permits the use of pastries as pretend pistols. |

Gaetz said the intent of the amendment was to restore privacy for people who appropriately use the state�s �stand your ground� law in self-defense. Hammer said she had no hand in writing the amendment, but agrees with Gaetz that it is necessary.
�If you didn�t do anything wrong, why should you have a record that you did?� Hammer said Thursday. �Why would the public need to know that? A person�s right under the Constitution is to be free of persecution, so it�s not right that you could be persecuted because of something that is inaccurate, for something that you didn�t do.� |

The House had a lengthy debate Thursday before killing a bill that sought to eliminate a portion of the state Constitution that requires all males between the ages of 14 and 45 to enroll in a state militia.
State Rep. Mike Moyle, R-Star, said that requirement hadn't been followed since the 1970s, and unfairly excluded women from the militia.
The bill would have required that the issue be put before voters in the November election. But the proposal drew a slew of opponents, and was defeated by a vote of 33-37.
Opponents worried that a ballot measure would confuse voters and that use of the word militia might impact Second Amendment rights. Some lawmakers also argued that the law should be enforced. |

Yavapai County officials are concerned about a bill in the Arizona Legislature that would allow people to bring concealed weapons into public buildings where guns currently are prohibited.
...
House Bill 2339 would allow people to carry deadly weapons into public establishments and public events if they have concealed carry permits.
The bill grants a few exceptions, including public establishments that have security personnel, screening devices and locked areas to store guns. Those accommodations would be cost-prohibitive to install in every county building, said Thurman, who tracks bills for the board.

The Libertarian Party of Kansas announced in a news release Thursday it opposes President Barack Obama�s appointment of Topeka Police Chief Ron Miller as U.S. marshal for Kansas.
�We ask that the U.S. Senate not approve his nomination,� said the statement released by state party chairman Al Terwelp and Second Amendment chairman Earl McIntosh.
Terwelp and McIntosh encouraged Kansans to call and email U.S. Sens. Pat Roberts and Jerry Moran to ask them to oppose the appointment.
McIntosh said the marshal�s position would bring Miller �too much power for someone who doesn�t like the 2nd Amendment.� |

The battle over gun control in Washington State heated up Thursday as backers of a new initiative to require background checks for all gun sales kicked off the campaign to pass I-594. The measure is one of a pair of gun initiatives on the November ballot this year, with the competing I-591 seeking to block any new state gun regulations that have not been enacted at the federal level.
King County Prosecutor Dan Satterberg was among a large and diverse group that turned out for the I-594 campaign kickoff. The Republican argues state laws prohibiting gun sales to convicted felons, minors and those who have been involuntarily committed for mental illness are far too easily evaded. |
