DC: Will the SCOTUS gut the 2nd Amendment?

Guns Don’t Kill People – Governments Do!
It is a disturbing contemplation that you may ultimately be forced to choose to be murdered by your own government rather than to live as a slave. And it has happened many times in recent history. It is not just a historic anomaly. Forewarned is Forearmed. As the saying goes, "I would rather be judged by twelve than carried by six."
The Supreme Court should be Impeached and Removed en masse if they utter a single word alluding to any lawful power to touch our God-Given Right to Keep and Bear Arms. This would include any Dictum or Sophistry inferring that a ruling in a case brought in DC could set a precedent overruling so-called gun laws within any of the States of the Union. A unanimous decision against a God-Given Right would only confirm their unanimity in Sedition. But it would still be a Nullity Constitutionally speaking.

Submitter's note: Excellent article. Worth sending to friends and enemies.

At a time when...shootings haunt American campuses, the hot line aims to be one angle of prevention. As Sgt. Raymond Trigg...puts it, calling..."relieves the stigma of being called a rat." ...The young rock musician who inspired it lives with the consequences of ruthless violence. Matthew Gross...is trying to rebuild a life...after a stranger's gunshot left him with a serious brain injury. Gross' family wanted to make some good come out of this ordeal. "We asked the question... : What kind of culture do we live in that people can own guns so easily?" says Peter Gross. "PAX says let's not make it a political issue the goal should be...to see guns for what they are, dangerous, with devastating effects on families."

Although Supreme Court justices appear to be leaning against upholding D.C.s ban on handguns, Mayor Adrian Fenty says its critical that the city maintain its ability to outlaw firearms. "Make no mistake about it, this is a public safety case," Fenty said. "The reason the city council enacted the gun ban in the 1970s because crime was getting out of control and guns were the cause of a disproportionate number of fatalities. When the gun ban became law, violent crime dropped significantly in the city and has steadily gone down since then." On Tuesday, the Supreme Court held oral arguments on the case. Judging from their questions, a majority of the justices seemed to indicate that the 2nd Amendment permits individuals to possess firearms.

CHARLOTTE, N.C. No injuries are reported after a pilot's gun discharged on a U.S. Airways flight from Denver to Charlotte, N.C.

Airline and federal officials say Flight 1536 was not in any danger as a result of the incident, which occurred about 9:50 a.m. MDT on Saturday.

Officials say the unnamed pilot was allowed to carry the weapon as part of the Transportation Security Administration's Federal Flight Deck Officer program. It was created after the Sept. 11th terrorist attacks.

Ed: RKBA content starts about 1/3 down the page.

HENNINGER: I think I agree with that. Most people probably can't quote the Second Amendment, but they do know what this is about. It is about gun control, right? The issue that's been kind of at the center of our politics for two decades.

Well, it turns out they thought Justice Kennedy might have been a swing vote here. It turns out when it was his turn to talk mainly what he was asserting is the American people have a right of self-defense. And what he meant was you have a right to defend yourself in your home.

Now, I think this goes to the heart of the matter because the gun control advocates, it isn't that they are against guns. they are against the idea of kill. Guns kill people.

Big Tim Sullivan was a notorious Irish gangster whose mob controlled New York City south of 14th Street around the turn of the 20th century. Throwing in his lot with the likes of Monk Eastman, Paul Kelly and Arnold Rothstein, Sullivan became an expert on that dark nexus where organized crime and politics consummate their unholy alliance, and soon became an influential figure in the corrupt Democratic machine there known as Tammany Hall.

Some jurisdictions across the U.S. have been arming rank-and-file officers with high-powered assault rifles for a decade or more because of greater numbers of shootouts, standoffs in which police were outgunned, rising officer deaths and mass shootings of civilians by heavily armed gunmen.

If you get into a fire fight, you want to be the winner, said Scott Knight, police chief of Chaska, Minn., and chairman of the firearms committee for the International Association of Chiefs of Police.

The Brady Center to Prevent Gun Violence said it understands the moves to assault weapons. Police officers need to be able to defend themselves and the rest of us, and they need the weapons to do so, said spokesman Peter Hamm.

In chapter 11 of Abbey’s Road [1979, Penguin Books, New York], Edward Abbey writes: “The tank, the B-52, the fighter-bomber, the state-controlled police and military are the weapons of dictatorship. The rifle is the weapon of democracy. If guns are outlawed, only the government will have guns. Only the police, the secret police, the military. The hired servants of our rulers. Only the government - and a few outlaws. I intend to be among the outlaws.”

By Bob Barr

Last week, the U. S. Supreme heard oral arguments in a case that last year found the 32-year gun ban in the District of Columbia unconstitutional. Despite the fact that the Second Amendment’s guarantee of the ‘right to keep and bear arms’ has been a part of our Constitution for 217 years and has given rise to innumerable court cases during those many decades, this is the very first time the High Court has directly confronted the meaning and scope of the Amendment.

Fans of gun rights and scholarly defenders of the U.S. Constitution alike were left pleased and optimistic by what they heard U.S. Supreme Court justices say March 18 during oral arguments for a case challenging Washington, D.C.'s, sweeping, super-strict gun law. The plaintiff in District of Columbia v. Heller argues that D.C.'s ban -- which essentially makes it illegal for private citizens to own handguns at all or possess rifles that are assembled or unlocked and ready to use -- violates the Second Amendment.

TX: Hays gun proposal a matter of public safety

Perhaps the proposed Hays County firearms regulation should be named after 7-year-old Daniel Galicia. After all, it was his accidental shooting death last year that spurred Hays County Commissioner Jeff Barton to propose the measure that would prohibit the discharge of guns on small lots.

That would remind people what the regulation is all about: making Hays County neighborhoods in unincorporated areas safer for families. And what it’s not about: taking someone’s gun away or restricting hunting by county residents.

Laurence H. Tribe's March 4 commentary "Sanity and the Second Amendment" is a not so cleverly disguised effort in damage control in attempting to influence the court to soften its likely affirmation of the D.C. Circuit Court of Appeals decision involving the overturning of the total handgun ban in Washington, D.C.

Prof. Tribe states that he has studied the "text and history closely" in his concession that indeed the Second Amendment protects an individual's right to own firearms and for that, I applaud him. As he is a fixture in the crowd supporting liberal court activism to make public policy, I hope his conclusions, albeit long overdue, will trickle down to the less edified anti-gun zealots in his camp.

The Right and Wrong of Owning Guns

If, in fact, the founding fathers envisioned guaranteeing the right to bear arms to individuals only insofar as they participated in a militia, do you suppose that on their off-duty days they were required to turn in their guns, disassemble them or keep them under a trigger lock?

Your concern about the dangers that arise from too-easy access to weapons is sensible. But for the law to change in order to reflect contemporary society, the Second Amendment would have to be repealed by another constitutional amendment, not by judicial legislation.

One needs to research the rise of police power abuse and police brutality in our country over the past several years to see that it is climbing and that you can't always rely on the police to be your protectors. The abuse of power by the police should alarm all Americans. Why should they alone be allowed to have semi-automatic weapons and all other law-abiding people denied their rights to have them?

Thus, emphasis on gun ownership has been misplaced. The right to bear arms is based upon well or good regulations. That means at least the following:
- The bearer shall demonstrate the proper use and care of the weapon.
- The bearer shall demonstrate the proper physical and mental capacity to be a member of an organized militia.

Pueblo County Coroner James Kramer used fingerprints to identify the man as 19-year-old James McCarty.

Sgt. Eric Bravo says 24-year-old Andrew Sandoval was hosting a small party when four men showed up and attacked him. Bravo says the group left but returned later, and McCarty confronted Sandoval.

He then pulled a 9 millimeter Glock handgun and shot McCarty five times.

Bravo says Sandoval has no criminal history and has been cooperating with investigators. He has not been arrested.

Along with cameras, coolers and camping gear, visitors to Biscayne and Everglades national parks sometimes pack something else: Guns. Bonnie Foist, chief ranger at Everglades for a decade, said rangers encounter enough illegal firearms -- they wrote 132 violations last year -- that it's the first thing they ask about when stopping someone. "Do you have a weapon aboard or in your car?' It's the standard question,' Foist said. "We want to know what we're facing.' What they may soon face is a lot more visitors with weapons -- and a new right to keep them loaded.

A 74-year-old woman twice shot at a man after he made repeated attempts to break into her home, extort money from her and threatened to set fire to her garage. Hugh Turner was arrested by Scottsdale police about 2 p.m. Friday on suspicion of threatening and intimidation and other offenses. Turner allegedly threatened to burn the womans house down after pouring gasoline in her garage about midnight on Thursday if she refused to give him money, police said. After the woman complied with his demands, Turner fled but later returned to the home about 4 a.m. Saturday and tried to break into an upstairs door using a ladder. The woman fired two shots from a handgun, but the man was able to get away unharmed, police said.

Two candidates. One handgun. Who owns it? Democratic Rep. Gabrielle Giffords or her Republican challenger Tim Bee, president of the state Senate?
The answer is Giffords, who owns a 9mm Glock which she says she keeps locked away in her Tucson home. Bee, father of six young children, doesn't have a gun in his home but says he has a rifle, which he doesn't use, locked away at his parents' house. Nevertheless, these two candidates headed into a closely watched campaign are in a virtual shootout over who is the more gun-friendly.

FENTY IS BLINDLY assuming that just because a law was meant to make the city safer, it must have worked according to plan. In some categories of crime, things have gotten better since 1976, when the D.C. gun ban went into effect. The rape rate per 100,000 residents has indeed fallen by more than half since then, as has the burglary rate. Of course, those results are in line with national trends in crime reduction, and cannot be meaningfully credited to D.C.'s gun laws.

When it comes to the more meaningful data of murders per capita, D.C.'s rate was still higher in 2005 than it was in 1976. It has been higher every year but one since the gun ban passed, and most years it's been enormously higher.

If gun dealer Eric Thompson had his way, college students would carry more than just books. In his vision, the next college shooter is thwarted by a student armed with one of Thompson's guns averting a massacre, saving lives. Thompson's Internet-based business TGSCOM Inc. sold weapons to the shooters at both Northern Illinois and Virginia Tech universities. First, he said, he felt grief for the victims. Then, a sense of resolve. Not to stop selling guns, but to advocate for guns on campus.

 QUOTES TO REMEMBER
Those, who have the command of the arms in a country are masters of the state, and have it in their power to make what revolutions they please. [Thus,] there is no end to observations on the difference between the measures likely to be pursued by a minister backed by a standing army, and those of a court awed by the fear of an armed people. Aristotle, as quoted by John Trenchard and Water Moyle, An Argument Shewing, That a Standing Army Is Inconsistent with a Free Government, and Absolutely Destructive to the Constitution of the English Monarchy [London, 1697].
