"Its good that we dont see opportunists and haters showing up in Mississippi, jumping to conclusions before all the facts have been established, proclaiming guilt without weighing the evidence, but stirring up racial animosity and threatening violence anyway due solely to the skin color of the men in these reports."

A 5-year-old girl jumping on a bed was injured by a bullet early Saturday when a gun beneath the mattress went off, police said.
The incident occurred at about 12:22 a.m. Saturday at a Marquette Park residence in the 6400 block of South Artesian, police news affairs told CBS 2. The child was jumping on a bed when a weapon discharged, apparently from underneath the mattress.
The girl sustained a wound to the ankle, police said. She was taken to Comer Childrens Hospital, the Chicago Fire Department said. No condition report was available, but it was presumed the injury was of a non-life-threatening nature.

A New York judge says it's Constitutional for the city to charge an application fee for a handgun permit. Federal Judge John Koeltl (KOH'-tuhl) Monday rejected a lawsuit brought by guns rights advocates including the New York State Rifle & Pistol Association and the Second Amendment Foundation. They sued last year, saying a $340 handgun license fee every three years is unconstitutional because it burdens a basic right. The judge says there's no evidence the fee has stopped anyone from exercising their rights. He says the city showed the fee helps cover administrative costs.

Top Remington Arms officials are threatening to pull out of New York if the state Legislature passes a bill mandating that guns carry tiny identifying stamps. Mandating firearms microstamping will restrict the ability of Remington to expand business in the Empire State, wrote Stephen Jackson, Remington chief strategy and acquisition integration officer, to top state officials. Worse yet, Remington could be forced to reconsider its commitment to the New York market altogether. Such a move could decimate Ilion, where Remingtons flagship plant employs more than 1,000 people.

One of the worlds major gun manufacturers is threatening to pull its plant out of New York over a gun bill pushed by Mayor Bloomberg. Remington Arms Company, in a recent letter to Gov. Cuomo, said it may be forced to bail on the Empire State if a law requiring bullet casings to carry unique markings is enacted.

The attorney counseling George Zimmerman, who shot unarmed black teenager Trayvon Martin as he was walking home from the store with a bag of Skittles, says if charges are filed, Zimmerman will argue that he acted in self-defense and that Florida's stand-your-ground law applies.
Attorney Craig Sonner said the public is only hearing part of the story, and when all the facts come out, it will be clear that Zimmerman acted in self defense. A grand jury is scheduled to begin hearing the case April 10.
"George Zimmerman suffered a broken nose, and had an injury to the back of his head, he was attacked by Trayvon Martin on that evening," Sonner said. "This was a case of self defense."

Asked about the shooting death of Trayvon Martin, Mayor Michael Bloomberg said, "The gun lobby is writing our nation's gun laws." "It's a disgrace," said Bloomberg, during the question-and-answer session of a press conference today about the expansion of Steiner Studios in the Brooklyn Navy Yard. "They write 'em in Washington. They write 'em in the state capitals. And the result is that our children are being killed, our police officers are being killed, you and I and our families are in danger."

The New Black Panther Party is offering $10,000 for the "capture" of the man who shot and killed Trayvon Martin. The Orlando Sentinel reports that New Black Panther leader Mikhail Muhammad announced the bounty on George Zimmerman's head during a rally over the weekend in Sanford, Florida, where the shooting happened last month. "If the government won't do the job, we'll do it," Muhammad said, referring to the failure thus far of police to arrest Zimmerman. Sanford Police Captain Robert O'Connor is asking that people ignore the offer.

The fight to enact microstamping legislation continues, in spite of the bill being pulled from the Senate Codes Committee and recommitted to the Rules Committee last week. Microstamping bill sponsor Sen. Jose Peralta, D-Jackson Heights and gun control advocates are calling for action from Gov. Andrew Cuomo and the Senate to get the bill passed this session. Peralta called for Senate Republicans to bring the bill (S.675-c) to a vote.

Miami Gardens teenager Trayvon Martin was suspended from school in October in an incident in which he was found in possession of womens jewelry and a screwdriver that a schools security staffer described as a burglary tool, The Miami Herald has learned.

SUBMITTER'S COMMENT: Tardiness, truancy, graffiti writing, marijuana possession and a backpack containing unexplained women's jewelry and a large screwdriver described as a "burglar's tool" -- and the media is still trying to manipulate the public by using this old photo of an angelic-looking, baby-faced boy instead of the six-foot-two-inch 17-year-old he had become.

A number of years ago, with the election of George W. Bush the gun lobby said, well have a President where we work out of their office. Around that time, in their unchecked euphoria, they launched a big budget advertising campaign with the slogan, I am the NRA. The ads featured spokespeople like Tom Selleck and Nolan Ryan with the intent of making the NRA appear folksier, more in touch with the average American. They provided the perfect disguise for their real agenda of opposing strong, sensible gun laws and, ultimately, went on the offensive to pass laws that actually promote and create more violence.

Recently divulged information about Trayvon Martin's checkered academic history has added a new dimension to the very public discussion about the deceased teenager's month-old shooting. As it turns out, Martin was suspended a number of times from Krop Senior High School in Miami Gardens for infractions ranging from tardiness and truancy up to possession of marijuana and a screwdriver that the school's security staff described as a "burglary tool." The troubling incidents date back to October 2011, when Martin was allegedly caught with a horde of women's jewelry and the aforementioned screwdriver, according the Miami Herald.

I want to voice my opposition to the proposed microstamping legislation (S675B). This legislation purports to engrave identifying features from a firearm onto fired ammunition casings used by that firearm. It is falsely claimed that this legislation will assist in identifying certain guns. However, the technology involved is seriously flawed. This legislation will add unnecessary costs and burdens to lawful firearms users. This legislation will divert scarce law enforcement resources from protecting people to a wasteful program that will only squander more precious taxpayers dollars.

The National Rifle Associations chief advocate in Tallahassee said Monday that putting the Stand Your Ground law on trial because of the Trayvon Martin case is a mistake. The stand your ground is a good piece of legislation, said Marion Hammer, the groups lobbyist. It was designed to protect he rights of law abiding people to defend themselves when they are under attack or assault. Thats all it does. It keeps law abiding people who choose to defend themselves from having to retreat in the face of attack and make themselves more vulnerable to criminals. Thats what the law is all about.

The New York State Assembly is once again proposing to require "microstamping" for all firearms owners in the state. But this year, they're trying a different tact, and are attempting to include "microstamping" in the state budget. I agree with Senator Tom O'Mara that microstamping is an unnecessary infringement of the privacy and rights of law-abiding gun owners, and efforts to include it in the state budget amount to a sneak attack on local sportsmen and sportswomen, and all law-abiding gun owners. It also jeopardizes the fullest and fairest discussion over state aid for our schools, relief for our property taxpayers, and private-sector jobs for our workers.

The Brady Campaign to Prevent Gun Violence, a group that advocates for stricter gun control laws, claimed Monday that George Zimmerman, the man who shot Trayvon Martin, still has his gun despite press reports to the contrary. One month after the tragic killing of Trayvon Martin, George Zimmerman still has his gun, said group president Dan Gross in a press release. The statement then goes on to blame the National Rifle Association for laws that allowed Zimmerman to keep his weapon even after the shooting. None of this appears to be true.

The Fox affiliate in Tampa reports that a man who claims to have witnessed part of the fight between Trayvon Martin and George Zimmerman says he saw the 17-year-old student on top of the 28-year-old neighborhood watch volunteer, who was wearing a red sweater. "The guy on the bottom who had a red sweater on was yelling to me, 'Help, help," said the man, who asked to be identified only as John, "and I told him to stop and I was calling 911....When I got upstairs and looked down, the guy who was on top beating up the other guy was the one laying in the grass, and I believe he was dead at that point." This account, which John reportedly shared with police, is consistent with the grass stains on Zimmerman's shirt,

Although it wasn't codified as a law until 2005 in Florida, as early as 1921 the U.S. Supreme Court established that a man or woman has no duty to retreat where there is an imminent fear of death or bodily harm. Justice Oliver Wendell Homes Jr. wrote that "detached reflection cannot be demanded in the presence of an uplifted knife."

AK: Bill Would Expand Right To Self Defense

A State House bill that would expand the right to self defense in Alaska has been getting increased attention, in part because of the Trayvon Martin case.

Florida, where Martin was shot last month, passed a similar law in 2005. HB80 would change the definition of when Alaskans can use deadly force.

Currently Alaska law says you can defend yourself if youre threatened or attacked in your home, business, at risk of being car jacked or defending a child or family member regardless of where you are, or if youre a police officer. HB80 would drop the current requirement that in all circumstances other than the home, business or car, you have a duty to retreat if you can do so with complete safety.

Taquanda Baker doesn't remember the suspect saying anything. She just remembers seeing his gun.

"I was standing here," she said, pointing to a spot near her cash register. "As I saw him coming, he already had the gun up."

Baker pulled her gun out of her pocket, misfiring a shot into the wall, then aimed and shot again.

"He stumbled about 3 feet back, hit the floor, and I shot out the door," she recalls.

McGeorge law professor John Myers says the outrage against the law is misplaced. Myers read directly from the law, which states a person is justified in using deadly force, and does not have to retreat.

Myers says Zimmerman would be free in California as well if indeed he was protecting himself from an attack.

The law in Florida is not any different then the law anywhere else, he said. Ive heard all kinds of wild statements about the crazy law in Florida. Florida is completely mainstream when it comes to the law of self-defense.

...

Professor Myers, whose office art includes a poster of Martin Luther King, says...civil rights leaders speaking out against Florida law now are not following the facts of the case.

In Washington and Idaho, there is no statute that gives anyone the right to stand your ground and use deadly force in public when faced with a perceived threat.

Both states have fairly standard laws covering justifiable homicide or self-defense, particularly when a person is in his or her own home.

But neither state has passed a law like the one at the heart of a controversial shooting of a black teenager by a community-watch volunteer, although some news websites and television networks claim they have.

NSSF is pleased to announce that a joint New York state budget committee today voted on a revised budget (AB 9055D) that repeals the ballistics-imaging (COBIS) requirement from state law. Anti-gun legislators had also tried to include a provision in the bill that would have mandated microstamping throughout the state. Remington Arms Co. and Kimber Manufacturing, both New York-based manufacturers, voiced strong opposition to microstamping in Albany. This is a tremendous victory for law-abiding firearm owners, retailers and manufacturers.

This is an update on two earlier posts I've made -- that further explains the law involved in the Trayvon Martin/George Zimmerman situation. It is a more involved explanation of the laws that might apply. The Stand Your Ground law is basically the same law used in Florida for over a century with some added features. To understand why it is very much needed . . . what changes might not be a bad thing . . . and some other important issues . . . lets try an actual intelligent discussion without the media hype, the racial tensions, and the misinformation from lots of talking heads who really have no idea what theyre talking about.
