What does help the homeowner according to Tamburino is the fact that she says she fired four warning shots.
What it shows there is she did not want to use deadly force at that time, rather she was trying to scare him off, and it didnt work, he kept coming, and then supposedly reached for something in his waistband, so, yes, it helps her side that she tried to warn him to stop and he did not stop, Tamburino said.
According to the search warrant the homeowner was not alone. |

The National Rifle Association has petitioned the Supreme Court to hear a challenge to Californias recent move to ban high-capacity ammunition gun magazines in the Golden State.
"Californias ban violates the Second Amendment, the Takings Clause, and the fundamental right of self-defense," Jason Ouimet, executive director of NRA-ILA, said in a press release Wednesday. "The reason Americans choose these commonly owned magazines is the same reason law enforcement does - to better defend themselves, their loved ones, and their communities from violent attack." |

Colorado is filled with so many beautiful spaces and places. Those places are filled with various forms of wildlife and one of the most popular without a doubt...are elk.
In fact there are more elk in Colorado (almost 300,000) than most other states combined!
We've had so many different stories about elk which just seem to grow and grow each and every year.
We've had elk that have gotten themselves in precarious predicaments, we've heard about elk making surprise visits to homes during all hours of the night, and we've seen cranky elk that let's face it, I'd be cranky too if I was an elk and some people were trying to get all up in my business, keep your distance.

Representative Chip Roy (R-TX) introduced a bill called the No Backdoor Gun Control Act in the U.S. House of Representatives that would remove the any other weapons (AOW) definition of a firearm under the National Firearms Act (NFA).
An AOW is a catch-all definition for any weapon or device capable of being concealed on the person and from which a shot can be discharged through the energy of an explosive. This category includes pistols with a vertical grip, smooth bore pistols that can expel a shotgun shell, wallet holsters, and more. One famous example is the Serbu Super-Shorty. |

The only claim allowed to proceed to discovery was brought under Connecticuts Unfair Trade Practices Act (CUPTA). In allowing the CUTPA claim to proceed, the Connecticut Supreme Court wrote in its Soto v. Bushmaster (4-3) opinion, [T]he plaintiffs allege that the defendants wrongful advertising magnified the lethality of the Sandy Hook massacre by inspiring Lanza or causing him to select a more efficiently deadly weapon for his attack. Proving such a causal link at trial may prove to be a Herculean task. NSSF believes the Court incorrectly allowed this one claim to go forward to discovery. |

Georgia Gov. Brian Kemp Wednesday declared 2022 will be a historic year for gun enthusiasts, at a pep rally for state Republican lawmakers partnering with Second Amendment organizations to expand gun ownership rights
As dozens of people gathered across the street from the state Capitol in Liberty Plaza, Kemp delivered his firearm-friendly message to dozens of people gathered for the March for the 2nd Rally organized by the gun rights group GA2A.
Kemp said momentum continues to build behind legislation that would remove the requirement for gun permits and grant license reciprocity to states with similar gun laws. |

"Hell, yes, were going to take your AR-15, your AK-47 said then-Democratic presidential hopeful, Beto ORourke, in 2019.
In fact, this has been a persistent rallying cry among Democrats for decades now, often forming some part of a campaign pillar during election cycles. Weve all heard Democrats lament the ideology that Americans shouldnt be allowed to have access to certain types of guns, like assault-style rifles because theyre dangerous. |

At first glance, the law does not seem unreasonable or overly burdensome. Every person who operates a motor vehicle in California is required to carry liability insurance for negligence and accidents. And every motorist is also required to pay annual fees to register their vehicle or renew their registration. There are bridge tolls and toll roads also that exclusively affect those driving cars and trucks and motorcycles.
Critics of the law, however, say there is no constitutional right to drive a car or truck, while the right to own firearms is actually enshrined in the Constitution. Their argument is you cannot regulate or tax a right guaranteed by the Bill of Rights. |

You can tell a lot about a personparticularly a judicial nomineeby studying the organizations that throw their support behind that nominee.
To that point, gun-ban groups far and wide are singing the praises of Judge Ketanji Brown Jackson, President Joe Bidens nominee for the U.S. Supreme Court vacancy left by retiring Justice Stephen Breyer.
President Biden has governed as the strongest gun safety president in history, and we have every confidence that Judge Jackson will employ a mainstream, commonsense reading of the Second Amendment, John Feinblatt, president of Everytown for Gun Safety, said in a released statement. |

President Joe Bidens (D) 2022 State of the Union Address touched on a lot of subjects, both domestic and international, and once again included his anti-Second Amendment agenda.
I ask Congress to pass proven measures to reduce gun violence. Pass universal background checks. Why should anyone on the terrorist list be able to purchase a weapon? Why? Why? And folks, ban assault weapons with high-capacity magazines that hold up to a hundred rounds. You think the deer are wearing Kevlar vests? Look, repeal the liability shield that makes gun manufacturers the only industry in America that cant be sued. The only one, said Biden. |

Legislators organized a press conference with police chiefs and sheriffs across the state for a bill on the Second Amendment shortly before it passed the senate on Thursday at the state capital.
SF 0102, known as the Second Amendment Protection Act, was sponsored by Sen. Larry Hicks, R-Baggs, and is meant to prohibit the enforcement of federal regulation of firearms by state officials.
Wyoming has the highest percentage of gun ownership in the nation, Hicks said. Consequently, the federal government pursues actions that are inconsistent with our values and infringes our citizens Second Amendment rights and infringes upon our 10th Amendment right of the constitution of the United States. It is absolutely imperative that we act. |

A judge ruled today against New York Attorney General Letitia Jamess request that the National Rifle Association be dissolved following claims of fraudulent use of funds, while still allowing her office to go forward in pursuing various other remedies for the alleged misconduct. The judge said dissolution of the NRA could impinge, at least indirectly, on the free speech and assembly rights of its millions of members. Thats exactly what I argued when Jamess office filed the action. |

New movement from the Ohio statehouse tonight as the state legislature passes a bill that would no longer require a concealed carry permit.
Senate Bill 215 now goes to Governor DeWine for his signature
Signing the bill into law would allow anyone who is legally able to own or carry a gun to have it hidden on their person without telling anyone.
Proponents of the bill say it's our constitutional right to bear arms but opponents argue there are flaws with the legislation for you and law enforcement. |

I ask Congress to pass proven measures to reduce gun violence. Pass universal background checks. Why should anyone on the terrorist list be able to purchase a weapon? Why? Why?
Well, I suppose we can start with the Second and Fifth Amendments of the United States Constitution. The terror watch list (last estimated to have almost 2 million names on it) and no-fly list (tens of thousands) are tools used by law enforcement to monitor potential threats, not to adjudicate guilt or innocence. The last time Senate Democrats tried to pass a bill weaponizing this monitoring tool, they proposed banning not only those currently on lists from owning guns, but anyone whose name was on a list in the preceding five years. |

The Alabama Senate Judiciary Committee on Wednesday approved a bill that would repeal the states law requiring a permit to carry a concealed weapon. The bill now heads to the full Senate for consideration of final passage.
Repealing the need for those permits, which require background checks, would put law enforcement officers lives at greater risk, most of law enforcements opponents of the bill said. Supporters of the legislation said Alabama lags behind the 21 other states with such laws and alleged that passages of them didnt result in increased crime. |

As some amendments were added to the legislation, the Senate had to give a final sign-off Wednesday, but the bill is now heading to Ohio Gov. Mike DeWines desk.
Bob Cornwell, Executive Director of the Buckeye State Sheriffs Association, representing sheriffs across Ohio, told FOX 8 that they are neutral on the bill, because of an amendment which was added Wednesday.
If an individual is approached by a law enforcement officer, the individual, if theyre carrying a firearm, must notify the law enforcement officer that they are carrying. If they fail to do so then it would be a misdemeanor of the second degree, said Cornwell. |
