TX: Arrests made in smash and grab of gun store

Houston police and ATF agents arrested multiple people and recovered several firearms stolen from Carter's Country Guns & Ammo.

The men, who are still on the run, smashed open cases with a hammer and ransacked the place, filling bags with guns and ammo. The whole thing only took a little more than 2 minutes.

The ATF, who is investigating the case alongside Houston police, told KHOU on Tuesday that smash and grabs like this one are on the rise around Houston. Thieves often sell the guns to other criminal groups for a profit, and they�re often used in other, more violent crimes.

Submitters note: Obama, this is how criminals get guns. They don't buy them at gun shows.
 

PA: Lancaster police sergeant charged with perjury, simple assault

A man who swore to uphold the law now stands accused of violating it.

Lancaster police Sgt. Raymond M. Corll was charged Wednesday with one count each of perjury, false swearing, official oppression and simple assault.

The charges, filed by the Pennsylvania attorney general's office, stem from an incident in March 2014, when Corll arrested a man for public drunkenness.

During the man's summary trial in July, Corll testified under oath that the man was clearly intoxicated, saying he was staggering the entire width of a 15-foot-wide sidewalk and was unaware of his surroundings.

Video footage from the case, however, showed the man was walking normally and showing no signs of staggering

But thanks to the quick work of the National Rifle Association and the Republican Virginia legislature, the agreements were restored last week through H.B. 1163 and S.B. 610.

�Now, more than six million law-abiding gun owners will be free to travel in and out of Virginia with their Second Amendment rights intact," NRA-ILA Executive Director Chris W. Cox released in a statement about the deal. "Self-defense is a fundamental right that must be respected."

Tomblin�s decision to veto this bill is unfortunate, especially considering the significant support HB 4145 had from both sides of the aisle,� said Dakota Moore, NRA-ILA West Virginia liaison. �We�re hopeful that, in going back to the legislature, each chamber will promptly reaffirm the rights of law-abiding individuals.�

An ordinance to define unsafe areas for the shooting of firearms that has been nearly a year in the making passed quietly at the last meeting of the Lyon County Board of Commissioners.

The commission voted 5-0, with no discussion presented from the public, to approve the unsafe shooting ordinance proposed by Sheriff Al McNeil.

The proposal of the ordinance spawned occasionally heated debate and had been discussed and recrafted several times throughout the nearly yearlong process, as McNeil and other representatives of the sheriff�s office attended advisory board meetings throughout the county and met with other residents and community groups to discuss his proposal.

Yes, I know that there�s no such thing as assault weapons, but let�s just entertain this awful piece of liberal jargon for the sake of argument. Over at Hot Air, Jazz Shaw noted that it might be time for the high court to definitively rule on whether it was a constitutional right for Americans to own AR-15 rifles.

In New York there are several more anti-gun bills being introduced in legislature. Before I get 5000 emails from those of you who don�t care about New York, remember that what happens elsewhere will happen here.

What happens in other states acts as an early warning system for us. As uncomfortable as it is, we have to develop a defense and face the reality of the well-organized, well financed anti-gun groups.

The idea of addressing �gun violence� as a public health problem persists among a number of scientists whom I think should know better: many of my fellow physicians, led by some of our specialty organizations.

Guns are not pathogens�it is how they are used that matters.

Epidemics are not characterized by gradual steady declines in morbidity and mortality, as homicides and violent crime have shown, accompanied by dramatic increases in gun ownership for 20 years. Their campaign is especially disingenuous as we find that our own health care professions are responsible for as many as 400,000 deaths and 10-20 times as much serious harm to patients every year.

During the March 3 GOP debate Donald Trump said there should be no restrictions on the Second Amendment and stressed that attacks on innocents can be prevented or curtailed if the people have the ability to shoot back.

Fox News host Bret Baier pointed out that Trump had voiced support for an �assault weapons� ban in 2000, and Trump responded by saying he does not support such a ban.

Baier asked Trump if he thinks there should be any restrictions on the Second Amendment and Trump answered, �No.�

If Missouri�s Stand Your Ground passes, it would be the first state law of its kind to be implemented since George Zimmerman killed Trayvon Martin in 2012. Wednesday�s hearing came less than a week after the four year anniversary of his death. Since then, no states have passed similar laws. Though Zimmerman did not actually mount a Stand Your Ground defense (he succeeded in trial with ordinary self defense arguments), his acquittal drew such scrutiny to the laws that some states have tried to repeal or weaken theirs since the incident.

In recent years the law has been invoked to throw out murder charges against two inmates accused of stabbing a fellow inmate to death in the Sterling Correctional Facility.

Inmates Antero Alaniz and Aaron Bernal were charged with murder in the 2011 death of inmate Cleveland Flood. Flood was stabbed 90 times shortly after he entered Bernal and Alaniz's unlocked cell, according to KUSA-TV.

Alaniz and Bernal invoked the "Make My Day" law, saying their cell qualified as a domicile and that Flood carried a shank and threatened them. Separate judges agreed, dismissing murder charges, the station reported.

In a statement, the organization articulated what it believed was the only acceptable position on Sotomayor. �We believe that any individual who does not agree that the Second Amendment guarantees a fundamental right and who does not respect our God-given right of self-defense should not serve on any court, much less the highest court in the land,� it said.

If McBurney runs for an elected judgeship, he�ll need prosecutors to help raise campaign funds for him. If he seeks an appointed judgeship, he�ll need those same prosecutors to send favorable recommendations to the Governor on his behalf.

Chairman McBurney is putting his self-interest above your self-defense rights and your right to the presumption of innocence. By refusing to give this bill a hearing, he is ignoring the basic doctrine that a person charged with a crime is innocent until proven guilty.

But Rubio was called out on gun issues long before this presidential campaign cycle begin. On November 7, 2009, the Tampa Bay Times reported that former NRA president Marion Hammer made clear that she not impressed with Rubio�s energy for pro-gun issues while he was Florida House Speaker (2007-2008). Hammer said, �He was a big disappointment to us when he was the speaker. He talked the talk, but he didn�t walk the walk.�

Earlier this year, Tennessee House Rep. Andy Holt (R-Dresden) and Sen. Mike Bell (R-Riceville) proposed a bill that would allow full-time employees of Tennessee state colleges and universities to carry guns on campuses with a valid permit. Since then, the bill has received protest from state university student governments, as well as criticism from proponents and opponents of campus-carry laws.

The surge in FBI background checks associated with retail firearms sales via the National Instant Check System (NICS) is continuing, with February�s numbers being the third highest on record, according to data released yesterday by the agency, CNN is reporting.

While this number does not reflect actual firearms transactions, it is a good indicator that business is brisk.

The cable news channel is reporting that last month�s total fell short of the record set in December of last year when 3.3 million background checks were reported. The second biggest month was in December 2012, the month that 26 people were slain at Sandy Hook Elementary in Connecticut. That month, 2.8 million checks were logged.

When Marco Rubio was a local commissioner in Florida in 1999, he voted to ban guns from local parks.

Now, politicians make mistakes. And honest politicians �fess up� and move on. Rubio�s problem is that, when Senator Ted Cruz called attention to Rubio�s anti-gun vote, Marco�s response was to call Ted a �liar.�

This was part of a larger narrative in which Donald Trump and Rubio were hurling �pants on fire� insults at Cruz. But when Rubio disavowed his 1999 anti-gun vote � falsely accusing Ted Cruz of Rubio�s own sins � he made a serious mistake. Because it turns out that Breitbart had a videotape of Rubio casting the anti-gun vote which he was denying.

But the National Rifle Association and the Connecticut Citizens Defense League said asking a gun owner to see their permit is a violation of their rights.

Christopher Kopacki, Connecticut liaison to the NRA, said the bill violates the U.S. Constitution by failing to protect people from the threat of unreasonable search and seizure.

�Stopping, detaining, or frisking a person is a seizure,� Kopacki said. �No matter how brief.�

He said there�s no evidence the law would make Connecticut residents safer. He said the relationship between police and the community is already strained, especially in urban areas, and this bill �would have dangerous consequences� that would further separate police from the community.

Rep. Mike Pitts introduced House Bill 4701 (H4701) on Jan. 19. Titled the Second Amendment Preservation Act, the bill garnered 31 cosponsors in the House. If passed into law, the legislation would prohibit the state from enforcing any federal law, rule, or regulation taking effect after January 1, 2016, that limits the right of a person to own, possess, or use a firearm, ammunition, or firearm accessories. The bill would also prohibit the state from accepting any federal funds related to any future law, rule, or regulation, that requires firearms to be registered or confiscated. Finally, the bill would bar the state from expending any funds for the enforcement of such laws, rules or regulations.

The Arizona House has passed a bill that would let the state join with other states to make themselves exempt from any new rules curtailing Second Amendment rights.

Arizona Republican Rep. Bob Thorpe sponsored the measure that would establish Arizona as the first member of an interstate compact, which other states could join.

Thai police said they arrested three men identified as Chinese citizens who were shot as they tried to rob a gun shop in Bangkok on Friday. A fourth suspect was arrested later.

The men entered the shop near Bangkok's Chinatown armed with BB guns and knives, said police Col. Suriya Jamningchoke.

He said the men used the knives to attack the shop owner and his assistant, who shot at the suspects in self-defense. The men were later shot by officers patrolling the area, police said. A fourth member of the gang escaped but was later tracked down and arrested, Suriya said.

On Thursday afternoon, the head of the National Rifle Association gave a fiery speech to a room filled with the country�s most dedicated conservative activists.

Just one thing: Nobody was packing heat.

That�s because the nation�s top conservative conference is now an official gun-free zone.

Security here is conspicuously tighter this year than in recent years past. Attendees were greeted by metal detectors, and at one point a lengthy line of conference-goers stretched through the hotel as they waited for security guards to search their bags.

Gov. Nathan Deal says a campus carry gun bill may be softened in the next few days to accommodate concerns by the Board of Regents. Campus Carry overwhelmingly passed the House last week despite concerns from parents and educators.

Campus carry is politically popular among those who beat the drum for the second amendment -- including legislators who are eager to expand gun rights. But those who actually work and study on college campuses have been less enthusiastic.

One of the many ways gun control advocates try to change the meaning to the Second Amendment is by twisting the definition of words and phrases. A common target is the phrase �bear arms,� which they claim is a military term only.

By any measure, time has virtually run out for President Obama to nominate someone to the Supreme Court.

What has gone unnoticed is that the problem of confirming judges during presidential election years isn�t just a difficulty facing Supreme Court nominees. Recent Senate tradition is clear: Few Court of Appeals nominees get confirmed during those years and none gets confirmed after July.

The reason is simple: Judicial confirmations are political footballs. Particularly when a president is nearing the end of his eighth year as president, the opposing political party wants to leave vacancies in the hope that their party will have the chance to fill them.
