Another would-be burglar was shot Thursday by homeowner, at least the fifth such incident in recent weeks.
Thursday�s shooting happened at about 12:30 p.m. when two allegedly men broke into a home on the 8200 block of Penrod on the city�s west side, Detroit Police 3rd Deputy Chief Rodney Johnson said.
�The homeowner was able to retrieve his weapon, and fired off one shot, hitting one of the burglars,� Johnson said. �He ran away and collapsed in the driveway. The other burglar was able to escape.�
The burglar�s wound was critical, and he�s not expected to live, Johnson said.
�They need to stop going into people�s houses uninvited,� he said. Hopefully, the word will spread, and we can stop talking about these home invasions.

Lockport police violated Paul A. Wojdan�s constitutional rights by counting the bullets in his gun and charging him with violating New York�s SAFE Act, Lockport City Judge William J. Watson ruled Wednesday. Watson dismissed a misdemeanor charge against Wojdan, filed because the magazine of his 9 mm Ruger handgun contained 10 bullets, more than the limit of seven bullets per magazine under the Secure Ammunition and Firearms Enforcement Act.

A Detroit homeowner shot at two intruders Thursday afternoon, killing one of them at the home in the 8200 block of Penrod Street on the city's west side, police say.
Police are looking for that second suspect but have not shared a description.
The homeowner was not injured. He is described a middle-aged man. |

Battle Creek police have opened an internal investigation of more than one member of the department.
The Battle Creek Enquirer reports interim Chief Jim Blocker announced the investigation on Wednesday, saying it�s �a pending personnel matter� involving �members� of the department. He declined to answer question about the investigation. |

Gun rights advocates are claiming victory after a federal appeals court ruled Wednesday that Yolo County was wrong to deny concealed and carry permits.
In 2011, a district court upheld Yolo County's policy that anyone wanting a permit to carry a concealed handgun had to show "good cause." Now, the U.S. Court of Appeals for the 9th Circuit has ruled that policy unconstitutional, which follows a similar ruling in San Diego County. |

The case at hand, Richards v. Prieto, challenged Yolo County, California Sheriff Ed Prieto�s policies on granting concealed carry handgun permits. Brought by the Calguns foundation and the Second Amendment Foundation, a federal judge Wednesday found the policy unconstitutional.
�Today�s ruling reinforces the Second Amendment�s application to state and local governments, and will help clear the way for more California citizens to exercise their right to bear arms,� said SAF founder and Executive Vice President Alan M. Gottlieb in a statement. |

A federal district court has refused to issue a preliminary injunction blocking Sunnyvale, California�s ban on magazines with more than 10 rounds. (Fyock v. City of Sunnyvale (N.D. Cal. Mar. 5, 2014).) A large part of the court�s rationale was that �a prohibition on possession of magazines having a capacity to accept more than ten rounds applies only the most minor burden on the Second Amendment,� and I think that�s both correct and legally relevant. |

The FBI�s semi-annual uniform crime data for the first half of 2013 confirms once again what the firearms community already knew, that violent crime has continued to decline while gun sales have continued to climb.
The report says murders declined 6.9 percent from the first half of 2012, while aggravated assaults dropped by 6.6 percent nationwide and robberies were down 1.8 percent. Forcible rapes declined 10.6 percent from the same period in 2012 and overall, violent crime fell by 10.6 percent in non-metropolitan counties and 3.6 percent in metropolitan counties. |

A struggle for gun rights has morphed into a fight for free speech in Hamburg, after the town cited a Clarice Drive man with a zoning violation for his anti-SAFE Act sign.
E. Scott Zawierucha put the banner up on his fence that faces busy South Park Avenue.
�NY IS NOT S.A.F.E.!! STOP CUOMO � PRESERVE YOUR RIGHTS!!� says the sign, referring to Gov. Andrew M. Cuomo�s passage of the NY SAFE Act gun legislation.
There are anti-SAFE Act signs throughout the town, but Zawierucha will be in Town Court today to face the charge of the illegal sign.
In addition to the First Amendment and Second Amendment issues, he has questions about the role of local politics surrounding the sign. |

The California gun store that put the nation�s first smart gun on sale is facing a furious backlash from customers and gun rights advocates who fear the new technology will encroach on their Second Amendment rights if it becomes mandated.
Attacks in online forums and social networks against the Oak Tree Gun Club have prompted the store to back away from any association with the Armatix iP1 smart gun. The protests threaten the nascent smart gun industry, which received a jolt of support recently when a group of Silicon Valley investors offered a $1 million prize for promising new technology.

On April 4, 2013, Connecticut Governor Dan Malloy (D) signed Senate Bill 1160 into law, unleashing one of the most draconian gun control laws in the nation on his constituents.
Among other things, the 140-page law bans large classes of firearms and magazines that had been obtained lawfully by tens of thousands of Connecticut residents.
Limited grandfather provisions apply to those who registered otherwise banned items before January 1, 2014. Others in possession could face felony penalties for violations. President Obama himself was in Connecticut four days after this bill became law, praising it as a model for the nation. |

It�s a rather fascinating as well as perplexing society we live in, with our obsession with gun culture. No matter which way one goes on the subject, there is usually little compromise. When it comes to interpreting the Constitution, however, judges seem to rule more favorably for more freedom in gun ownership than for upholding restrictions on it. That is fairly evident in the lack of any forward movement with bans or restrictions after mass shootings � legislators know it�s an uphill battle not only in passing but in upholding new laws. |

The Florida Legislature has set its sights on a slew of bills being pushed by gun advocates during this legislative session, which began this week.
So far, four gun bills are working their way through committees. The first bill, commonly known as the �warning shot� bill, is now being scheduled for a final floor vote. If passed, the bill would allow law-abiding Floridians to show a gun and even fire �warning shots� in self-defense without facing steep prison time. Under current law, someone can be locked up for 20 years for armed aggravated assault for firing a warning shot in Florida. |

The Missouri General Assembly allows drunks to carry weapons, but seven Kansas City Council members balked at changing city ordinance to match state law.
Kansas City currently says it is a crime to possess or fire a weapon while intoxicated. The possession part is in conflict with state law.
City attorneys told council members that if they didn't change the ordinance then they couldn't enforce it. |

�Out of the 76,142 initial denials in the federal system only 44 individuals were prosecuted and only 13 were convicted of illegally trying to purchase a gun when they were prohibited from doing so,� Lott explained, adding, �As if that wasn�t bad enough, those convicted were hardly what one would call dangerous criminals � usually people with relatively trivial records from years earlier that didn�t realize their offense was covered.� |
