[Gunfight on] Aug. 2, 1879. When it ended, a lawman and a desperado were dead, and a prisoner was wounded. [shooters' conviction reversed] on three grounds:
First, the arrest warrant was illegal because Tom Alford's name was misspelled on the document.
Second, White was never legally sworn in as a county law officer.
And third, Mace and George Alfords' efforts to "free their brother from an illegal arrest attempt were justified under the U.S. Constitution, Article 1, Section 9." |

The "new" government does not preserve and protect the rights of the people but, instead, has established what is essentially a dictatorship enforced by armed marauders. ... One must conclude that either the people in government cannot read or they ignore what they read for their own self-serving interests." |

Judge PAINTER, There is no doubt that the Ohio Constitution grants citizens the right to possess, and to bear, arms. That is exactly what it says.
The Ohio Constitution, Section 4, Article I, states, The people have the right to bear arms for their defense and security ***. The framers of the Ohio Constitution did not add this and others in a bill of rights as amendments, as in the United States Constitution. We believe they meant what they said.
