The Sheepdog Barks!

Humanity is divided among sheep, wolves, and sheepdogs, I wrote in the mid-1980s. The great Col. David Grossman popularized it but philosophers said it long before either of us were born. The sheepdog is simply the domesticated creature with fangs who plays with the children, lives peacefully with the family and is prepared to neutralize wolves before they can harm the lambs. Some debate the metaphor but this writer believes right-thinking armed citizens (and of course, cops) truly fit the sheepdog analogy.

But New York and those gun control groups got what they wanted. The Supreme Court dismissed the case on Monday, finding that it was, in fact, moot because the regulation was no longer in place. Six justices Chief Justice John Roberts, Kavanaugh and the Courts four liberal members voted to dismiss the case. Conservative Justice Samuel Alito wrote a dissenting opinion calling the issue not moot, joined by Justices Clarence Thomas and Neil Gorsuch. Though Kavanaugh agreed the case was moot, he also wrote that he was concerned that lower courts werent properly applying the Heller decision recognizing individuals rights to gun ownership.

In order to purchase a handgun in North Carolina, Edgecomb says a person must first apply to their local sheriff for a Pistol Purchase Permit, appear in person with a government ID, pay a fee, and undergo a criminal background check. There are no state permitting requirements to buy a rifle or shotgun. However, a potential firearm purchaser undergoes the FBIs National Instant Criminal Background Check System check at the time of purchase. This instant check provides the firearms dealer with pertinent information and approval to purchase the firearm at the time of sale. Or, the sale is disapproved.

The Mississippi Justice Institute, a non-profit constitutional litigation center, has filed a lawsuit on behalf of pro-Second Amendment State Rep. Dana Criswell (R-Mount Olive) against Jackson Mayor Chokwe Antar Lumumba's executive order prohibiting the open carry of firearms in the city. This legal action, filed in the U.S. District Court of the Southern District of Mississippi, challenges both the constitutionality and legality of the mayor's open carry ban. Your NRA-ILA reported earlier this week that the mayor's actions violate both the Mississippi Constitution's right to keep and bear arms provision and the state firearms preemption law.

A Republican state lawmaker filed a lawsuit Tuesday challenging a Democratic mayor's temporary ban on the open carry of guns in Mississippi's capital city during part of the coronavirus pandemic.

#The city of Jackson and Mayor Chokwe Antar Lumumba exploited the present public health crisis" to limit people's Second Amendment right to carry firearms for self-defense, says the federal lawsuit by state Rep. Dana Criswell of Olive Branch.

Safeside Lynchburgs indoor gun range is open again after nearly six weeks.

On Monday, a Lynchburg judge ordered a temporary injunction against Gov. Ralph Northams executive order to close nonessential businesses, including indoor ranges. The group filed a lawsuit in state court and pleaded their case last week.

To keep customers and staff safe, people will see Plexiglas shields up at every counter and tape on the ground to keep people 6 feet apart.

The Supreme Court on Monday sidestepped issuing a major ruling on a New York handgun law, a blow to gun rights advocates and the Trump administration, who had hoped the conservative majority would expand gun rights as early as this term.

The court's action means that the Supreme Court has gone a decade without deciding a major 2nd Amendment case.

Before the pandemic, the majority of gun buyers left stores with weapons in hand. But with roughly twice as many sales in March, according to FBI statistics, getting those purchases approved takes a little longer these days.

Shooters Choice Manager Kim McDaniel said Monday that prior to COVIDs impact on Delaware, about 95% of approved buyers left the store with their new gun that day. Now, in the midst of an overwhelming demand for firearms, she said about 60% of purchasers are cleared to buy on the spot.

Right now, for a first-time offense, carrying in a prohibited area stands as a $150 fine and they cant take your gun or your carry license. On the other hand, under this new not committing any other violations of Illinois law provision, does that mean the penalty for inadvertently carrying in a prohibited location while wearing the mandated mask goes way up to a Class 4 felony where the state takes all of your guns and your carry license? For life? And potentially your freedom for one to three years, too?

John Costa believes in the Second Amendment and does not want the government to infringe upon it.

So he is keeping his gun store open, albeit with a few modifications. The Gunrunner, in Middleborough, is still operating, despite gun shops not being on Massachusetts Governor Charlie Bakers list of essential businesses that are allowed to stay open during the coronavirus emergency.

Its good to have friends in the fight. The coronavirus pandemic is causing economic hardship and worry for millions of Americans. Fortunately, the firearm and ammunition industry has allies in Congress to protect Americans rights and support small businesses.

U.S. Rep. Ted Budd (R-N.C.) joined NSSFs Larry Keane for a virtual town hall hosted by NSSF PAC with dozens of members of the firearm industry trade association. Congressman Budd brings a unique perspective. Along with serving as a Member of Congress, the second-term U.S. Representative from North Carolinas 13th Congressional District is a gun store and range owner.

It took one look at Kavanaugh's comment for Alan Gottlieb, founder and executive vice president of the Second Amendment Foundation, to suggest, SCOTUS mooted the New York case as the old law is no longer valid, but invited hearing another case pending before the high court to insure that lower courts adhere to the Heller and McDonald rulings made previously by the high court. Weve got four ready-made cases now on the table just waiting for acceptance.

Not in recent memory, if ever, did one organizationespecially a gun rights grouphave four ready-made cases on the table just waiting for the high court to accept one, or more, for review.

But gun control advocates caution that victory could be fleeting, as the high court is already poised to consider whether to take up other pending legal battles involving the scope of the Second Amendment.

"It's a win, but it's a temporary one based on the appetite of at least the four justices who joined separate opinions to take up another Second Amendment case," Hannah Shearer, litigation director at the Giffords Law Center to Prevent Gun Violence, told CBS News. "It's not to say that the victory will soon turn into a loss, but what's likely to happen is the court will take Second Amendment cases soon and the process will start over."

Its not often that a nondecision is a good decision, but the Supreme Courts ruling Monday morning that it would not decide a New York City gun case was the right call.

And, in a sense, gun control advocates dodged a legal bullet this time. Unfortunately, the conservative members of the court signaled in dissents that they might be looking for a way to recognize a private Second Amendment right to carry a firearm in public.

Some attacks on our rights can be so subtle, they can be missed at first glance, even in a relatively short piece of legislation. In fact, these are the ones worth studying, if only to be more aware of them.

One such attack is contained in HR 4271, the Gun Suicide Prevention Act, introduced by Representative Julia Brownley (D-CA). At first glance, this very short piece of legislation all of three pages long in the PDF provided at Congress.gov seems very innocuous. All it requires is that the phone number for the National Suicide Prevention Hotline be provided on a warning label that is included with every firearm sold.

NJ: Lawsuit claims Murphy retaliated against gun rights group, kicked activist out of briefings

Gov. Phil Murphy improperly booted a gun rights activist from New Jersey's daily coronavirus press briefings, the New Jersey Second Amendment Society alleges in a new federal lawsuit.

Alexander Roubian, the group's president, attended the briefings in March to ask Murphy about the governor's closure of gun stores and ranges as part of his shutdown of businesses the state believes are not essential. The same day Murphy announced a limited re-opening of gun stores, the Murphy administration started barring Roubian from the briefings.

Roubian's exclusion amounts to retaliation for him "taking on" Murphy over the gun store closures, the lawsuit says.

 QUOTES TO REMEMBER
You are bound to meet misfortune if you are unarmed because, among other reasons, people despise you....There is simply no comparison between a man who is armed and one who is not. It is unreasonable to expect that an armed man should obey one who is unarmed, or that an unarmed man should remain safe and secure when his servants are armed. In the latter case, there will be suspicion on the one hand and contempt on the other, making cooperation impossible. Niccolo Machiavelli in "The Prince."
