The Jackson County District Attorney's office announced the decision not to press charges against a 79-year-old man who shot and killed a man he assumed to be trespassing on a neighbor's property. The DA's office said the man was acting in reasonable self-defense because he believed the trespasser, 65-year-old Brian Patrick Arnold, had a gun, when in fact, the object in his jacket was a flashlight.

I have a forth�com�ing essay in the Harvard Law Review Forum about how crim�inal laws govern�ing gun use, as opposed to gun carry�ing, provide incent�ives and disin�cent�ives for public carry through mech�an�isms like sentence enhance�ments, self-defense elements, burdens of proof, and legal infer�ences. If the Supreme Court strikes down New York�s proper cause require�ment, one avenue for regu�la�tion might be blocked, but that would merely redir�ect poli�cy�makers down other aven�ues.

The jury believed him. They found him not guilty of the first-degree murder charge sought by the office of Circuit Attorney Kimberly M. Gardner. They found him not guilty of manslaughter and of second-degree murder.

But shortly before trial, Gardner�s office added a charge of felony murder. Under Missouri law, self-defense can�t be argued when somebody kills another person in the process of committing another felony. Smith�s felony was that he had a gun. He�s not allowed to have one because 20 years ago he was convicted of drunken driving.

A third-grade Michigan student's First and Fourteenth Amendment rights were violated when she was prevented from wearing a hat at school with the text "Come and Take It" along with an image of an AR-15 rifle, according to a lawsuit filed Friday in U.S. District Court in Detroit.

The suit, filed on her behalf by the child's father, Adam Stroub, names the superintendent of Durand Area Schools officials, along with the principal and track coach at Robert Kerr Elementary School where she attends.

It alleges the hat portrays support for the right to keep and bear arms in a non-violent, non-threatening manner and contains "pure speech."

For Marvin Sanders, a second chance in front of a jury of his peers ended differently.

The Peoria man, who represented himself at a trial this week in Peoria County Circuit Court, was found not guilty by a jury in connection with a fatal shooting on Jan. 29, 2021, at a Peoria gas station.

Had Sanders been found guilty of first-degree murder, he could have faced up to life in prison. Jurors took about 3 1/2 hours on Thursday before returning the not guilty verdict.

While anti-gun Legislators continue to push for more gun free zones and other gun laws that inhibit self-defense; smart American citizens are starting to realize that it�s time to take the responsibility for their own lives into their own hands. The blame for mass killings lies, not with a gun but with the killer, but the responsibility lies with all of us. It is time for responsible adults to put aside the anti-gun rhetoric, ignore the left-wing propaganda, and own the responsibility of self-defense because we know the cops can�t be there in time to do it for us.

Campus safety regulations have been a hot topic since April 2007, when a student killed 32 people on a Virginia Tech campus. No federal law restricts guns on campus. It is up to states to decide whether it is legal or illegal for college students to carry guns on campus. Some states want to tighten regulations to keep guns off-campus. Others feel the need to ease existing regulations and allow students to carry concealed weapons on campus.

...proponents of the bill claimed it would have simply allowed state police to address individuals convicted by tribal courts of drunk driving and similar offenses.

But the broad language of the bill could have also required state police to carry out other orders issued by tribal courts, potentially including orders to seize guns from Oklahomans who �annoy� Cherokee officials with online posts, based on an existing Cherokee Nation law.

That potential has grabbed the attention of Second Amendment supporters in Oklahoma.

�We�re always concerned at any restriction of Second Amendment rights, which includes the exploitation of �red flag� laws,� said Don Spencer, president of the Oklahoma 2nd Amendment Association (OK2A).

Despite securing an endorsement from Donald Trump himself in the GOP primary for an open senate seat in Pennsylvania, Dr. Mehmet Oz is somehow staring down a potential upset from GOP rival Kathy Barnette, who�s being attacked by the likes of Sean Hannity for being �Ultra MAGA.� Apparently, there�s such a thing as being too Trump-like. Who knew?

Katie Britt is attacking Mike Durant as a "New Hampshire liberal" who opposes gun rights as she seeks to undermine her main foe in the race for the Republican nomination for Senate in Alabama.

Britt, former chief of staff to retiring Sen. Richard Shelby (R-AL), is airing an advertisement on broadcast television in the Birmingham media market that plays a grainy clip of Durant criticizing the proliferation of firearms in the United States and calling for a crackdown.

A motel room shooting that occurred on Monday, May 9, in Dumfries resulted in one injured. However, Prince William County Police Department determined the shooting to be justified.

Shortly after 7:30 p.m., officers responded to a suspected shooting at the Motel 6 located at 17133 Dumfries Road.

An investigation into the incident revealed that two male residents of the motel � a 44-year-old and a 34-year-old � had become involved in a verbal argument in the parking lot.

Waldman says the ruling could take many forms. The question is how much room it leaves for government regulation.

�They could say you don�t need a permit at all,� he said. �They could say you have to do what a lot of other states have done, which is to basically say you need a permit, but anybody who asks for it, gets the permit.�

State leaders are preparing for the worst, and say they�ll craft new legislation that goes as far as possible in restricting concealed carry while still conforming to the court�s ruling.

�I�m not expecting any great news from this Supreme Court,� said state Senator Michael Gianaris, a leading Democrat.

Mayor Adams blasted gun rights advocates Friday � as well as their argument that �good guys with guns� save lives � saying simply that their position on the issue is �dumb.�

�This is not Jesse James and the Sundance Kid, who can draw the fastest, you know?� he said, responding to a reporter�s question about that pro-gun argument. �For those who are stating that, if all the bad guys have guns, let�s equal it out by having all of the good guys have guns, that is just so dumb.�

But, what is that going to cost you in this anti second amendment state, that wants desperately to take away your constitutional right? More to the point, what will it cost you in Tehama County?

The cost of a firearm is obviously your first decision. You could pay anywhere from $300 to $500 for a moderately priced handgun. Higher priced models could run to $1,500, whether you choose a pistol, rifle or shotgun. And you must choose from the list of allowed firearms that California says it�s okay for you to purchase. A Federal Firearms Licensee (FFL) dealer will only be selling approved firearms, and you can look up the list with an internet search.

Under the Biden-Harris administration revocations of gun dealers� Federal Firearm Licenses (FFLs) have increased a stunning 500%.

Under previous administrations, the ATF revoked an average of 40 FFLs per year. But in the 11 months, since Biden has occupied the White House, the ATF has revoked 273 FFLs, and many more dealers are in the pipeline to lose their licenses and their livelihoods too.

A new report from the Centers for Disease Control focusing on a spike in gun-related violence pulls data out of context and demonstrates how the CDC is �up to its old tricks� under the Biden administration, the Citizens Committee for the Right to Keep and Bear Arms said today.

�All violent crime was up in 2020, the year on which the CDC research focused,� said CCRKBA Chairman Alan Gottlieb. �But the CDC, which is not a crime control agency, has an unhealthy fixation on trying to make guns the issue, turning the Second Amendment into a public health problem.
