The media have been telling us to watch the gun-control case now before the U.S. Supreme Court, where we await a decision about Americans' Second Amendment rights. But the 2nd U.S. Circuit Court of Appeals just handed down an equally important gun decision that has additional implications against judicial supremacy. The court, which convenes in New York City, shot down the longtime liberal dream of achieving gun control by suing gun manufacturers for crimes committed by firearms. In a remarkable decision, this federal appellate court dismissed City of New York v. Beretta U.S.A. Corp. and protected gun corporations against frivolous lawsuits in state and federal courts. |

Which is why we must support James Spears. A former Pizza Hut deliveryman, Spears had responded to a phony call for food, and found himself with a gun to his head. Spears shot the thug three times. But Pizza Hut fired Spears.
Why? Because their employees can't carry weapons. Well, after a search on Google, because I am a journalist, I found a pile of cases involving assaults and murders involving deliverymen. In Boston, there were 34 armed robberies against food deliverers in just 110 days. In D.C., 16 carriers were mugged in the 4th Police District alone. — I don't even know what that means. |

Three Montana Highway Patrol troopers, firing from the prone position, sent 15 rounds from their new rifles downrange in quick succession recently.
After officers from the sixth district, which covers Flathead, Lake, and Lincoln counties, qualify with the new weapon, every trooper in Montana will be riding shotgun with a semiautomatic AR-15 rifle.
"They're just all-around more versatile for our day and age, Trooper Jerril Ren, one of the patrol's firearms instructors, said of the AR-15. For the changing times, I think it's just more appropriate. --------- Changing times? Anyone know what he's talking about?

Massachusetts Turnpike toll collectors are calling for self-defense training after a worker was attacked at a toll booth last month.
...
Instead of signing the form, Tierney said the driver became enraged, grabbed his arm, smashed his face into the door and dragged him several feet before speeding off.
The veteran toll collector said he was left picking up several of his teeth off the Mass Pike.
...
A few months ago it was revealed many toll collectors were secretly allowed to carry handguns for years. That policy was reversed in February, and workers had to turn in their weapons. At the time, the union was vowing to fight the decision. It's unclear whether this story will have any impact on that. |

A Brooklyn store owner who struck a 15-year-old boy in the head with a hammer was indicted on felony assault charges on Friday, although his lawyer said he acted in self-defense.
The store owner, Salah Ahmed, owner of Munchies Deli in Brownsville, hit the boy, Bunkless Bovian, 15, on April 13 after seeing a security monitor in the rear of the store showing the youth and two friends up front attacking an employee, according to Gary Conroy, one of Mr. Ahmed’s lawyers. |

Right now law-abiding, right-to-carry holders and gun owners have to disarm and store their firearms in an inaccessible part of their vehicle.
Some opponents say that you do not need access to a firearm in a national park. But these people ignore the fact that park rangers are wearing protective vests and carry semiautomatic rifles (in addition to their handguns) for self-defense from predators of the two- and four-legged kind. What is it that they know that the public does not know? Could it be that bear (four-legged) and man (two-legged) have increased the specter of violence? |

A woman who stabbed her boyfriend during a violent confrontation last month acted in self defense and will not be charged with a crime, a prosecutor said.
Tamesha Doreen Miles, 22, had marks on her that were consistent with abuse and her boyfriend, Terry T. Townsend, had been arrested in February on a charge of battering her, officials said.

It’s not often you watch a video where a frail, 98-pound grandmother is slammed into the wall by a burly police officer, handcuffed and dragged from her home — all because she refused to surrender her firearm and leave her home.
She was not a felon, drug dealer or other miscreant but was a homeowner in New Orleans immediately after Hurricane Katrina.
This somewhat brushed-over bit of history is reappearing in discussion on talk radio and other locations as we await the decision of the U.S. Supreme Court on the District of Columbia’s wholesale ban on handgun possession. |

Just when we were optimistic that Boones Mill would see some peace and quiet after a bitter election, people carrying firearms and a shouting match highlighted the town council meeting Tuesday night.
A group called the Virginia Citizens Defense League sent about 40 members to the Boones Mill Town Council meeting in an apparent protest over a sign that is posted at town hall. The sign requests that no firearms be brought into the building. |

I've never been troubled by the idea of carrying a firearm on a trip into the backcountry of a wilderness or national park, whether on a hiking or horse trip, climbing or otherwise.
I've never done so, but I have thought about the need. And I long ago decided if push came to shove, I would use it against a serious threat. Trouble is, until now, I never associated those threats with anything other than wildlife.
But the U.S. Department of Interior's proposed rule to allow concealed pistols into national parks and refuges gives me pause. And that's because much of the discussion seems to focus on protecting ones self from others visiting the park. |

Paul Clement resigned today from his post as solicitor general, effective June 2, the Justice Department has announced.
Mr. Clement, 41, is regarded by many as one of the brightest young stars of the conservative legal firmament, and argued 49 cases before the Supreme Court for the Bush administration.
But some in the White House, particularly Vice President Cheney, were not happy with Mr. Clement's arguments in D.C. v. Heller, the gun rights case heard by the court in March.
Mr. Clement argued that the second amendment allows individuals to bear arms, but he also allowed some room in his interpretation of the second amendment for the control of firearms by the government. |

A county jury has acquitted a Madison store owner facing a retrial on a murder charge leveled against him eight years ago.
The jury deliberated about two hours Thursday before clearing Baha “Bob” Hamdallah of first-degree murder for shooting Robert Steptoe in October 2000.
Steptoe was a customer at Charlie’s Market in the 1600 block of Market Street in Madison, which Hamdallah owned.The decision reverses a 2002 jury ruling finding him guilty of the murder. Hamdallah, 33, was sentenced to 38 years in prison then. He appealed, arguing his lawyers didn’t present certain evidence. |

John McCain put Barack Obama in his sights yesterday while hunting for votes at the National Rifle Association's annual convention.
Before his speech, the GOP presidential standard-bearer even visited a hunting shop - but bought a fishing rod and bobbers, not a rifle.
McCain said he's been a staunch supporter of Second Amendment rights, while claiming Obama has often been hostile to gun owners.
"I've opposed efforts to ban guns, ban ammunition, ban magazines and dismiss gun owners as some kind of fringe group unwelcome in modern America," McCain said during the NRA gathering in Louisville, Ky. |

Wearing blaze orange stickers that read "GUNS SAVE LIVES," nearly 40 members of the Virginia Citizens Defense League came from as far away as Bristol, Virginia Beach, Richmond and Northern Virginia to protest a sign at the tiny Boones Mill town hall requesting that guns not be brought into the building.
Several people at the town council meeting also carried guns in hip holsters, and others said they had concealed weapons.
They told Mayor Ben Flora and town council members that the sign violated their rights, was discriminatory and was potentially dangerous. |

With the recent passing of Charlton Heston, the National Rifle Assn. lost its biggest media gun. But rocker Ted Nugent -- the man known for once performing in a loincloth and for greeting concertgoers from the back of a bison named Chief -- is prepared to fill in for the elder statesman as popular culture's most outspoken proponent of the 2nd Amendment.

Another important change is that now only the county sheriff issues permits. In the past, chiefs of police also issued permits. However, chiefs do not answer to voters. Many did not agree with the majority of state legislators, Gov. Owens, the county sheriffs and Colorado voters that law-abiding citizens have the right to carry a concealed weapon, and therefore refused to issue concealed weapons permits. Greeley Police Chief Jerry Garner does not fall into that category.

In the concealed weapons law, it is optional for the county sheriff to enter the names into the database. I absolutely refuse to enter Weld permit holders into the state computer system just because they legally exercise their rights. |
