Federalization of Law Enforcement Would Remove Bulwark for Second Amendment

The call to federalize law enforcement departments and offices around the country was made more than once after Officer Darren Wilson shot Michael Brown in Ferguson, Missouri, in August 2014.
Following that incident, President Obama asked a group of individuals to prepare a study on 21st Century Policing that includes measures by which law enforcement could be federalized. ...
It must be noted that one stark result of such federalization would be the successful and quiet removal of opposition to gun control via new constraints on sheriffs around the country who currently enjoy relative freedom from extensive federal input and oversight.

Rep. Bonnie Watson Coleman's (D-NJ) new bill is called the Stop Online Ammunition Sales Act of 2015. You can't get any clearer than that.
The proposed legislation, introduced Tuesday, would require individuals trying to purchase a firearm online to present a photo ID to authorized ammunitions dealers in person.
So much for the online part.

A Waterford man prevented a robbery by pulling his weapon on an armed suspect early Tuesday, according to the Oakland County Sheriffs Office.

The 49-year-old victim was approached by the suspect around 4:40 a.m. outside DeVita Dialysis on the 6000 block of Dixie Highway, police said. The victim had just arrived for an appointment when the suspect approached the vehicle from a wooded area between the dialysis building and adjacent Rite Aid.

The victim told police he then pulled his own gun on the suspect and said, Do you really want to do this?

The case of an aspiring Michigan businessman has reignited the debate over limits to the federal government's ability to seize property of those it suspects of being involved in criminal activity.
Joseph Rivers of Dearborn was on his way to California to start a career as a music video producer when he was stopped by DEA agents in New Mexico, who seized $16,000 in cash Rivers had in a bank envelope, the Albuquerque Journal reported.
Rivers' story is one of many from U.S. citizens who say the government unfairly seized their assets under the Justice Department's Asset Forfeiture Program.

This map shows how America's 3.7 million NFA registered weapons break down by state and by weapon type.

In Wyoming, which has a population of only about 600,000, there are over 100,000 registered destructive devices.

The state with most machine guns per capita is New Hampshire, with 7.4 for every 1,000 residents. New Hampshire also happens to have the lowest murder rate.

Bailey said always keep your cell phone and car keys with you. If someone comes into your house, dial 911 and leave the line open. Drop the phone if you have to, he said, so dispatchers can hear whats going on.

He also advises not to go looking for a confrontation with an intruder. Avoid it if you can, he said, and if you plan to pull out a weapon, dont let it be used against you.

If you have a weapon in your house, if its a firearm or whatever, it may be you need to make sure that youre trained in that weapon, said Bailey.

We look around the house, anything you can pick up is a weapon, said Jeff Patterson.

The Supreme Court expanded gun rights for felons Friday by allowing them to keep the proceeds from their sold firearms after they are seized by the government.

When former Border Patrol Agent Tony Henderson was convicted of distributing marijuana, he knew he couldnt keep his collection of 19 guns. Federal law prohibits felons from owning firearms.

D.C. has some of the strictest gun laws in the country, but they have been loosened a bit after a judge ruled in favor of three firearms owners who sued the city claiming it was virtually impossible to obtain a concealed carry permit.

Attorney Alan Gura represents the three gun owners who filed a lawsuit against D.C.

You certainly dont need a good reason to be able to carry a gun for self defense which is a fundamental right, Gura says.

A federal judge agreed with Gura and granted an injunction blocking police from requiring residents to show a good reason when applying for a concealed carry permit.

The city responded by putting a may issue concealed permitting process in place, whereby DC residents who proved a need for a gun could acquire the permit to carry one for self-defense.

On May 18, Judge Scullin took exception to the requirement that citizens must show a good reason for carrying a gun before getting a permit. Scullins ruled that this requirement impinges on Plaintiffs Second Amendment right to bear arms.

Since the landmark 2008 Heller v. District of Columbia case, which Second-Amendment lawyer Alan Gura argued before the Supreme Court, anti-gun officials in the nations capital have spent every waking hour trying to avoid doing what the high Court ordered be done: allow District residents to exercise their right to keep and bear arms.

Gura has been fighting them every step of the way; and on Monday, was victorious once again, as a United States District Court granted his injunction to stop the city from requiring concealed carry permit applicants to demonstrate a good reason to fear injury to his or her person or property or has any other proper reason for carrying a pistol.

Advocates for greater gun controls say that while they expect federal appeals courts to uphold laws such as the Districts, the high court may still seek to use it to tackle questions left unanswered in prior rulings.

Does the Second Amendment apply outside the home, and if it does, to what extent? said Mike McLively, staff attorney at the Law Center to Prevent Gun Violence, a gun-safety legal advocacy group. This case pretty much square-on asks that question.

Submitted to the high court in January, Jackson has been distributed for conference by the justices four times since then and has been rescheduled on each occasion.

If Jackson is accepted by the court, it will be one of the first gun rights cases the high court has agreed to hear in the past several batches of petitions. In 2013, the court refused two different requests for cases involving the right to carry firearms outside the home.

Last February, the court batted away three out of three gun rights cases without comment. Shortly thereafter, the court declined another concealed carry case, Drake v. Jerejian, even though 19 state attorney generals and 34 members of Congress supported it.

Both the victim and the suspect in the Billings case went to Senior High School, located just a block from the shooting scene. Outside the school on Tuesday, several of their classmates described Schulte and the suspect as good friends who had no known ill feelings toward each other.

Freshman Betty Mitchell said the two were close as hell. She said the suspects house was previously broken into and he was probably scared when he heard noises outside his window Sunday night.

Neighbors said the suspect and his family had lived in the single-story house where the shooting took place for many years.

Some would argue that these tragic stories are reason enough for people to rethink their attachment to firearms, but apparently not. Not all American Christians are pro-guns of course, but there is a sizeable number who are. One of the more outspoken evangelical proponents of gun ownership is theologian Wayne Grudem, whose arguments I will critique here.

Despite the fact that gun owners in Oregon are now facing new legislative Second Amendment roadblocks, a coalition of activists are determined to stand up for their constitutional rights. As the Gateway Pundit explains, state Senate Bill 941 which mandates background checks for all private firearms sales was recently signed into law, provoking the ire of gun owners who already feel their liberties are under attack.

One way these pro-gun advocates plan to make their displeasure known is through a demonstration set for May 30 at the capitol building in Salem.

Under the "Protect Our Military Families' Second Amendment Rights Act," military spouses would be allowed to buy a handgun outside their home states of record.

Right now, only the military member can make such a purchase. The 1968 Gun Control Act does not allow the wife or husband the same privilege.

"It's just something that needs to be corrected," said Rep. Scott Rigell (R-Va., 2nd District) "The service member has that right right now to purchase a firearm. That same right needs to be extended to a spouse."
