MI: Guns not banned at Michigan Capitol unless lawmakers act

Guns cannot be banned from Michigan�s Capitol unless legislators change state law, an official who helps oversee the building said Wednesday, less than a week after some protesters armed with rifles shouted at lawmakers inside the Senate chamber.

John Truscott, vice chairman of the Michigan State Capitol Commission, said he received �early indications� from the panel�s lawyer that �we do not have jurisdictions to prohibit weapons in the building. That�s a legislative function.�

It appears unlikely the Republican-led Legislature would restrict guns in the Statehouse. GOP leaders didn�t immediately respond to messages seeking comment.

Should visitors should be barred from carrying firearms into the state Capitol?

You know, the way they're forbidden to carry them into the state Supreme Court, the Secretary of State's office, and the governor's mansion?

Well, of course they should, for heaven's sake.

And responsible gun owners, and the organizations that look out for their interests, ought to be leading the campaign to secure that no-brainer prohibition.

It's been a week since armed protesters swarmed the spectators' gallery of the state Senate and mustered outside the door to House chambers, mugging for photographers and asserting their constitutional right to visit the barber, although many did not seem conspicuously concerned with personal grooming.

Toilet paper isn�t the only commodity in short supply during the COVID-19 pandemic. Personal safety concerns triggered by the pandemic have made nationwide gun sales explode. Many gun dealers in Northeast Ohio say business is so busy they�ve had trouble maintaining inventory.

At Summit Armory in Bath Township, owner Tim Ostrander reports business in his four-year-old store has hit �record levels.� Not even five months into 2020, his sales have surpassed everything he sold in 2019. Customers seeking to defend their homes have driven 95 percent of the increased sales, he says.

A Texas woman reportedly shot her ex-boyfriend Wednesday evening after he allegedly broke into her San Antonio home.

The woman told San Antonio police she hid in the bathroom when she heard noises before grabbing her shotgun and opening fire on him, leaving him critically injured, WOAI-TV in San Antonio reported.

I have been taking some heat from friends and colleagues for my steadfast defense of personal liberties and my arguments that the Constitution -- when interpreted in accordance with the plain meaning of its words, and informed by history -- does not permit the government to infringe upon personal freedoms, no matter the emergency or pandemic.

Just as firearm sales are on the rise, the crime rate is down, except for acts of domestic violence, which have increased.

Rep. Shalala wants firearm owners to quarantine their firearms from its ammunition and then lock them up.

�Unsecured guns in the home dramatically increase the likelihood of unintentional shootings and suicide,� stated Rep. Shalala �While we stay home and socially distance, it is imperative for gun owners to make sure that their firearms are unloaded, separated from ammunition, and locked up.

Lopez himself owns a total of 15 firearms � four assault rifles, six Glocks, two shotguns, two M1911 pistols, and an AK-47. He was hesitant to talk to a reporter about the weapons.

�I don�t know, you guys kind of twist the truth at times,� he said, recalling past experiences with media outlets where he felt like his words had been taken out of context. He said he only talked to this reporter �to give her a chance.�

Legislators in the state of Michigan are reportedly considering new measures to ban guns from inside the State Capitol building after armed protesters staged a provocative protest there last week and prompted criticism from across the political spectrum in the United States.

Hundreds of anti-lockdown demonstrators, some of them armed, gathered at the state capitol building in Lansing, Michigan, last Thursday during a session which a skeleton crew of state legislators gathered to consider a measure rebuking Democratic Governor Gretchen Whitmer's response to the coronavirus pandemic.

A pair of Second Amendment champions, Senator Tom Cotton (R-AR) and Representative David Kustoff (R-TN), have introduced legislation called the Restoring The Armed Career Criminal Act, known as HR 2837 and S 1541 to address that ruling.
According to releases from Senator Cotton�s and Representative Kustoff�s offices, they do this by dispensing with the old definitions of �violent felony� and �serious drug offense� and going with a single �serious felony� that is defined as any offense that lands a person with a potential sentence of at least ten years in prison.

Lawmakers approved an amendment to a current law that if passed by Senate and signed into law, would legalize knuckles, more commonly known as �brass knuckles�.

The amendment that was passed is part of a larger Public Safety bill, that will be voted on by the House Chamber in the future.

It was first introduced in January by Republican Representative Tony Lovasco.

In the wake of a mass shooting in Nova Scotia, Canada, Prime Minister Justin Trudeau unilaterally banned over 1,500 types of semi-automatic, or assault rifles. Canadians have little to no recourse but to comply. Canada does not have a Second Amendment, or any protection to self-defense, as does the U.S.A.

The assault rifles ban was inevitable. Other commonwealth nations, Australia and New Zealand, have already followed Great Britain down that path.

In last week�s disturbing pictures of protesters brandishing assault weapons in and around Michigan�s Capitol, we saw the naked face of the gun-rights argument, and it was repulsive. This is not a movement about liberty but anarchy. Only in the U.S., and no other civilized democracy, does a supposed right to take up arms against a duly elected government garner a measure of respect from politicians, the courts and the court of public opinion. No tenable reading of the Constitution supports it.

A federal judge has refused to dismiss the National Rifle Association�s challenge to a 2018 state law that blocked people under age 21 from buying guns.

Attorney General Ashley Moody�s office argued that Chief U.S. District Judge Mark Walker should dismiss the case, which challenges a law that the Legislature and then-Gov. Rick Scott approved after a gunman killed 17 people at Marjory Stoneman Douglas High School in Parkland.

The Second Amendment declares that �the right of the people to keep and bear Arms, shall not be infringed.� For nearly 250 years, these words have held up. Despite numerous wars, changing cultures and economies, our Second Amendment has remained strong. The directive �shall not be infringed� is powerful; there are no footnotes, exceptions, or clarifications � not even for coronavirus.

After a hoard of armed and angry protesters swarmed Lansing last week, State Rep. Sarah Anthony brought some extra protection on her way to the State Capitol today.

At least three African Americans carrying large rifles escorted Anthony across Capitol Avenue earlier this morning so she could safely attend committee meetings without fear of intimidation. She said she didn�t necessarily request the help, but welcomed the extra security nonetheless.

�We were all just appalled by the lack of support and lack of security that I had, that other legislators had, and the fact that a lot of the demonstrators last week were adorning many racist, anti-Semitic signage. I think it just triggered a lot of folks, especially African Americans.�

Nothing ruins a good protest like a gun. The anti-shutdown protesters who have been showing up in Lansing armed to the teeth are hurting their own presumptive cause.

It's hard to take anything else they stand for seriously when they appear this way at the Capitol.

Their guns, not their message, draw all of the attention. And they overshadow the other protesters who have legitimate gripes about the way Gov. Gretchen Whitmer is exercising her emergency powers.

An estimated 1.8 million guns were sold in America in April, according to the research consultancy Small Arms Analytics and Forecasting. This is a 71-percent increase from last April, and a continuation of the surge that began in March when a record of more than 2.5 million firearms were sold to Americans.

According to figures released by the National Shooting Sports Foundation, which represents gunmakers, the number of checks adjusted to not include those conducted for permits was more than 1.67 million for this April, 70% higher than April 2019.

Gun sales are reportedly increasing across the country during the COVID-19 pandemic.

But some Central Georgians say they can't get their hands on a carry license from their local court.

Houston County resident, David Braunstein, says when he read the state-wide judicial emergency order, signed by Georgia Supreme Court Chief Justice Harold Melton in March, he didn't see anything about weapon licenses.

"When I read it, I didn't see anything that even came close to not giving out conceal carry permits," Braunstein said.

During the meeting council members brought in constitutional law expert and Capital University professor Dan Kobil. He explained the first amendment is broadly protected, and there has to be a serious and harmful threat for action to be taken.

"It's a high bar," Kobil said. "They have to have an intent to harm. They also have a second amendment right and an Ohio right to carry a weapon."
