NY: New York�s concealed carry restrictions are far too restrictive

The U.S. Supreme Court has granted certiorari to the case of the New York State Rifle & Pistol Association Inc., et al. v. Corlett, et al., challenging New York�s ban on concealed carry of handguns without �proper cause.�

It is about time the Supreme Court affirms the right of not only New Yorkers but all Americans to carry arms outside the home.

For the past decade, the hottest sector of the firearms market has been the concealed carry market and an obvious trend has been the invention and mass manufacture of handguns that are ever-smaller and friendlier to concealed carry. While many dedicated enthusiasts do carry compact or full-size double-stack autoloaders, the vast majority of concealed carriers who are more casual in their approach do not find carrying such guns on a daily basis practical, or even achievable.

As a whole, the defensive shotgun seems to have lost its following. Even in the law enforcement arena, the shotgun has in many cases been pushed aside in favor of the AR-15 style carbine. Why? For many, issues of recoil, weight, ease of operation, and lack of good training drive their decision to opt out of a scattergun, but for me and thousands of others, the shotgun can never be replaced. It is truly one of the most versatile firearms of all time. As a trainer, I can report that I receive fewer requests for defensive shotgun training than any other firearm platform, and that includes requests from law enforcement, security, and civilians. How unfortunate, but I digress.

Senator Charles Schwertner, R-Bryan, who laid out the bill said, �We cannot allow another session to come and go where we paid lip service to the second amendment while failing to fully restore and protect the rights of citizens granted by the constitution.�

Republican Senator Jane Nelson of Grapevine said while she strongly supports the second amendment, she was concerned about domestic violence victims.�I�ll be real honest with this, and people on the floor know, I have struggled with this.�

Louisiana's House and Senate have each overwhelmingly passed bills that would allow people to carry a concealed handgun without a permit despite a veto threat from Democratic Gov. John Bel Edwards.

Thibodaux Republican Rep. Bryan Fontenot's House Bill 596 cleared the House this week on a 73-28 vote, joining the Senate in providing veto-proof passage to a similar measure (Senate Bill 118) from Monroe Republican Sen. Jay Morris.

House Republican Caucus Chairman Blake Miguez of Erath said what supporters call "constitutional carry" is a top priority for those seeking to expand gun rights.

The line returns to mind today, though in slightly sinister reverse. The Supreme Court has decided to hear a Second Amendment case, New York State Rifle & Pistol Association v. Corlett, about the constitutional rights of an individual to carry a handgun outside the home, against the claims of a long-standing New York state law (dating to 1913), which holds that you must demonstrate �proper cause� and get a concealed-carry license to do so. The law, scarcely radical, insures that you need a license to tote a lethal weapon under your coat, just as you need a license to drive a car. (The first New York driver�s license dates to 1910.)

What the media isn�t telling you: Nearly half of all U.S. Counties are now Second Amendment Sanctuaries!

There are few stories the mainstream media enjoys more than �trend� stories.

Whether it�s plant-based fake meat, live-streamed workouts, celebrity podcasts, or TikTok videos and other new apps, the media revels in reporting the latest trends that are sweeping the country � at least most of the time.

However, if the trend involves guns or the Constitution � especially the Second Amendment � don�t look for stories anytime soon, even if it�s a viral national trend.

Association of New Jersey Rifle & Pistol Clubs, Inc. v. Grewal is another ILA-backed case challenging a New Jersey statute that criminalized possession of magazines capable of holding more than ten rounds. New Jersey previously banned 15 round magazines, but that didn�t go far enough for the notoriously anti-gun lawmakers in the garden state, who arbitrarily dropped the limit to ten rounds in 2018, despite the fact that many of the most commonly owned firearms in America have standard magazines larger than that. Last week, ILA asked the Supreme Court to hear the case and strike down this statute under the Second Amendment.

Every american state requires you to have a licence to drive a car, hunt or become a barber. Yet by the end of this year at least 20 states will allow you to carry a handgun in public without a permit. So far in 2021 five have already passed �permitless carry� laws, and five more, including Texas and Louisiana, are considering them. If these became law, around a third of Americans would live in states where it was legal to carry guns around without any need for a licence or training.

The Chief Medical Examiner�s Office on Wednesday said a 38-year-old Newbury woman died from shotgun wounds to the head and torso, and that her death is a homicide, according to a news release from Vermont State Police.

Gun-safety advocates said the death of Karina Rheaume, who was allegedly shot by her father after she went to check on him and bring him food on Monday afternoon, was further evidence that Vermont�s gun laws need to be strengthened, especially in regard to keeping guns out of the hands of people who may be behaving erratically.

The reality is that today�s �good cause� requirements may not be overtly racist, but in practice they serve to disproportionately exclude people of color from the ability to protect themselves in public with firearms. Constitutional implications aside, this makes discretionary licensing poor public policy.

Who ends up getting concealed carry permits in the most restrictive �good cause� jurisdictions? Overwhelmingly, the permits go to wealthy white men�especially those who are well connected to whatever public official happens to have sole discretion over granting permit applications.

After about six hours of debate, the Texas Senate passed a permit-less or constitutional carry bill, 18-13.

Under House Bill 1927, Texans 21 and older would no longer need a license, training, and to pass a test to carry a handgun in public.

That�s already the case when it comes to long guns.

Having said that, shares in the manufacturers of handguns, shotguns and �modern sporting rifles� such as the old AR-15 had a pretty good run from July 2020 to early this year. But now it looks like they are reverting to type: low-tech metal benders with subnormal valuations.

Many of the great American gun-making names, such as Remington, Winchester, Colt and Marlin, have had at least one trip to bankruptcy courts. The two pure play gunmakers left, Sturm, Ruger & Co and Smith & Wesson Brands, have underperformed the broader indices, even though their sales hit all-time records in January.

The Mayfield native is now the vice mayor and since he�s been on council he�s coordinated with the Fredericksburg Police Department and the city�s Sheriff�s Office to host an annual gun giveback. This year�s event will take place on Saturday from 10 a.m. to 2 p.m. at the Fredericksburg Police Department at 2200 Cowan Blvd.

The voluntary program allows gun owners to dispose of unwanted weapons with the police department, no questions asked. All firearms turned over to the police will be destroyed or donated to the Virginia Department of Forensic Science to assist with research. No ammunition will be accepted.

Some facts: The Virginia State Police (VSP) reported a total of 428 murders in 2019 (the last year for which statistics are available) for a statewide murder rate of 5.01 per 100,000 population.

Unsurprisingly, the murder rates were much higher in Democrat-controlled, crime-infested cities like Richmond (24.2), Portsmouth (16.9) and Norfolk (14.7).

In the four counties surrounding the City of Fredericksburg, the murder rate was 2.9 per 100,000, except for the city itself, where the rate was 10.5.

House Bill 1298 would change state law on background checks for firearms transfers as well as close what�s known as the Charleston loophole that refers to the 2015 shooting at the Emanuel AME Church in Charleston, South Carolina, which resulted in the murders of nine African American parishioners. The shooter obtained a firearm without a background check, because under South Carolina law � the same as Colorado's � if a background check doesn�t come back within three days, the dealer has to transfer the firearm to the buyer without it.

More dramatically, the NRA faces its own institutional crisis. Leadership is battling internal dissent over management practices and public ridicule of Executive Director Wayne LaPierre�s lavish lifestyle. Contributions have faltered. Facing unprecedented financial stress, the NRA fired more than 200 staffers and declared bankruptcy. New York Attorney General Letitia James has filed suit to dissolve the group.

The gun safety coalition is stronger than in the past, and the NRA is weaker. That could make a difference.

By a vote of 70-47, yesterday the NC House passed H. 398 to repeal our Jim Crow-era pistol purchase permit system.

Having passed one chamber before next week�s crossover deadline, the bill remains alive for action in the Senate.

Grass Roots North Carolina (GRNC) has been the main advocate for the bill, having worked for nearly twenty years to repeal the archaic law.

GRNC president Paul Valone said, �Today, the North Carolina General Assembly has taken a step toward abolishing a vestige of the Jim Crow era which is being used by a small number of sheriffs to obstruct citizens from protecting their families, as well as bringing gun purchase background checks into the 21st Century.�
