Yesterday, the Senate voted 28-16 to pass House Bill 3094, the open carry bill. Though the constitutional carry amendment failed, the Senate did manage to adopt an amendment to eliminate the fee for a Concealed Weapons Permit (CWP). H. 3094 now goes back to the House for further action.
House Bill 3094 allows citizens who hold a CWP to carry a handgun in the manner they choose. At the moment, South Carolina is just like New York and California in not allowing open carry of handguns. Self-defense situations are difficult to predict and everyone has different circumstances. It is unreasonable for the law to impose a one-size-fits-all method of carrying a handgun for self-defense. |

H.145, by Rep. Maxine Grad, as currently written, would eliminate legal protections for those engaged in self-defense in the aid of others. These protections evaporate if you are fending off a violent attack for anyone other than yourself or an immediate family member. For example, the convenience store manager rescuing a clerk from an armed robber or an individual helping a neighbor who has come under violent criminal attack would now be in legal jeopardy and could face prosecution. |

According to a Supreme Court document, the judges will decide on the following: �Whether the Second Amendment prohibits New York from requiring residents who wish to carry a concealed firearm in public to have an actual and articulable need to do so.�
Eric M. Freedman, a constitutional law professor at the Maurice A. Deane School of Law at Hofstra University, noted that in agreeing to take up the case, the justices narrowed their inquiry. Instead of a sweeping rejection of all New York gun laws, they will limit the inquiry to the constitutionality of the petitioners being denied the permits.
�The mostly likely outcome is a narrow decision striking down what they perceive as the most extreme parts of the New York system. |

Senate Bill 141 resolves New Hampshire�s longstanding problem with delays during handgun purchases, by abolishing the �state gun line� system that the State Police currently use for handgun purchases. Instead, the process for purchasing a handgun will now mirror buying a long gun, which goes through the National Instant Criminal Background Check System (NICS). This switch in the process will not only reduce taxpayer burdens, it will greatly reduce the number of delays experienced by those attempting to exercise their Second Amendment rights by purchasing a handgun. |

But gun rights advocates are not content with eliminating stringent regulations on firearms ownership and use. They oppose minimal ones as well. An Illinois circuit court judge recently ruled that the state�s requirement of a license to own a gun is unconstitutional, at least when applied to someone keeping a firearm at home.
The case arose after sheriff�s deputies in downstate Carmi responded to a report of shots fired inside the home of Vivian Claudine Brown. Though they found no evidence of shots fired, they did find a rifle in her bedroom. |

New polling shows there isn�t �widespread consensus� on these proposals or any new proposals for that matter. In fact, it�s the opposite. Support for more gun control is at the lowest levels in at least five years, according to Gallup. That includes support for enacting �more strict� gun policies dropping by 10 percent since 2018. That survey reveals a five percent drop in support for stricter policies among self-identified Democrats.
Gallup isn�t an outlier. More recently, a Washington Post/ABC News poll also found Americans have lost their desire for more gun control policies. That poll showed �that Americans overall are less supportive of new gun control legislation than they were just three years ago.� |

Responding to citizens� concerns about gun control measures the Biden administration may pursue, county commissioners and Sheriff Scott Steward issued a Tuesday declaration �strongly� supporting citizens� inalienable right �to keep and bear arms for the defense of life, liberty and property.�
�Given what�s shaken out in the new administration east of here, a lot of folks in the county, a lot of folks in Wyoming are concerned about � federal overreach,� Commission Chairman Lee Livingston said. �And we here in Park County are pretty adamant about what the Second Amendment spells out.� |

For the first time since 1968, the Department of Justice's Bureau of Alcohol, Tobacco, Firearms and Explosives is seeking to update the legal definition of firearm in an effort to crack down on "ghost guns."
The proposed rule seeks to redefine "frame or receiver" as well as classify more firearm kits as "complete" firearms, making them subject to more regulation and oversight. It also seeks to legally define terms such as "complete muffler or silencer device" as well as "privately made firearms." |

Shane Williams, the town councilman who introduced the resolutions, said they both were the result of many conversations he�d had with people in Mooresville who expressed �serious concerns� about cancel culture and people otherwise punished for political speech.

Gov. Ron DeSantis on Friday signed a measure to crack down on local governments creating gun control measures.
Lawmakers last week passed a bill (SB 1884) clarifying that existing preemptions on local firearm and ammunition laws also apply to unwritten rules and policies. The proposal, which the Legislature formally sent to the Governor earlier in the day, will also make clear local governments can�t bypass court cases simply by scrapping gun laws. |

Two competing guns-in-schools bills will not get a hearing in the waning days of the 2021 legislative session.
�This session�s over,� Senate State Affairs Committee Chair Patti Anne Lodge, R-Caldwell, told Idaho Education News. �I am not having another committee hearing.�
In an interview Friday � one day after a shooting at Rigby Middle School, which left two students and a school custodian injured � Lodge emphasized the need to train teachers and school staff so they know how to respond to a crisis. And on Thursday, Rigby�s training worked, Lodge said; a teacher was able to disarm and detain the suspect, female sixth-grader, until officers could arrive on the scene. |

The bill was still being worked on in a committee Friday morning to hammer out the differences remaining in the House and Senate versions, before it is sent to Governor Greg Abbott, who has said he intends to sign the measure into law when it reaches his desk.
Greenville Police Chief Scott Smith and Hunt County Sheriff Terry Jones said they were prepared for the eventuality of the law being implemented.

Governor Doug Ducey today signed legislation to protect the Second Amendment rights of Arizonans by safeguarding against frivolous lawsuits that have no connection to unlawful use of firearms. The new state law mirrors federal law that was passed on a bipartisan basis.
�With efforts currently underway in Washington to erode Second Amendment rights, Arizona is taking action to protect those rights,� said Governor Ducey. �In Arizona, we�re safeguarding manufacturers, sellers and trade associations. Bad actors need to be held accountable, and we will work to make sure they are. A Democrat-backed bill to create a state Office of Gun Violence Prevention got its first hearing before a Colorado legislative committee Friday, with backers arguing it could educate residents about gun safety and existing laws on firearms while collecting data about gun violence in the state. Opponents, however, told the House Public & Behavioral Health & Human Services Committee the proposed office would amount to a gun-control agency in state government and duplicate existing programs to deter homicides, suicides and domestic violence and offer mental health services. |

�This bill has bipartisan support as it should since all are affected when a child dies or is injured by an unsecured firearm,� said Wool, a Democrat from Massachusetts who represents Fairbanks. �If this bill prevents one accident or suicide then we�ve accomplished a great thing.�
