The sheriff vowed to lobby lawmakers to pass legislation that would expedite the return of firearms in similar cases.
On Tuesday, nearly two years after Kochanskis gun was seized, Assembly Bill 13 passed on a voice vote. It now heads to the Senate.
The bill mandates the return of property to those who have been cleared of charges in connection with the seizure of a firearm or ammunition. It creates a timeline for the entire process, ensuring that individuals will no longer be subjected to long wait times for the return of their property.
Its not 48 hours, but the bill does set a maximum of 35 business days for the return of a weapon seized in such cases. |

A recent story out of Reidland, Kentucky where a man told deputies he shot and killed a man that was allegedly stealing from his storage unit has raised questions about what rights a person has to defend themselves.
Jeffrey Conrad, 49, is being held at the McCracken County, Ky. jail on a $500,000 bond for one charge of capital murder for allegedly shooting Garlon Cox, 30, that was stealing from Conrad's Reidland, Ky. storage unit, according to the McCracken County Sheriff Jon Hayden. |

So we can thank Justice Clarence Thomas for pulling back the curtain a bit this week when he issued a public dissent from the courts refusal to hear a challenge to a San Francisco gun control ordinance. This case, Jackson v. City and County of San Francisco, went to conference six times before the court issued an order on Monday denying review. Even without Justice Thomass dissenting opinion, which only Justice Antonin Scalia joined, it would have been obvious that something was afoot, but we wouldnt have known exactly what. |

Following the Supreme Courts June 8 decision not to overturn gun storage requirements in San Francisco, Democrats in Albany, New York, want to require residents there to lock up their guns, as well.
The San Francisco law requires gun owners to store their gunsas in a safe or other containeror outfit them with trigger locks in the home. And this is precisely the requirement proposal discussed by Albany Assembly members. |

An amended bill to allow people to carry concealed weapons without a permit is currently awaiting a signature from Gov. Paul LePage. In addition to doing away with the permit requirement, it would also do away with the requirement that people show they understand the basics of gun safety, such as by completing a gun safety course.
What are people likely to learn in a gun safety course? Here are some basic rules all people should follow when operating and owning a gun, according to the National Shooting Sports Foundation and the National Rifle Association: |

Leija Farr, the 17-year-old who was recently named Seattles first youth poet, understands the responsibility of the title. I have the ability to put messages out there, help people, she says. I self-heal with poems.
Farr is taking up the challenge. In her poem GUN, published here for the first time, Farr addresses American gun culture and tells me she sees police shootings as an epidemic. Im always hurt when I hear about my fellow black men getting shot, she says. Its so common that its not a shock anymore. |

As an avid hunter and lifelong gun owner, I have always been a strong defender of the Second Amendment. We cherish our right to bear arms in South Dakota, where we have a strong outdoor heritage and lively economy based on sportsmen activity. This fundamental right is embedded in the Constitution and must be fiercely protected.
That's why I'm greatly concerned about the President Barack Obama administration's latest attempt to circumvent Congress and impose sweeping new gun restrictions on the American people. It is an assault on the Second Amendment. |

The 2015 Connecticut legislative session adjourned last week and your efforts to defend your Second Amendment rights against a few misguided bills have paid off.
Throughout the session, leading national anti-gun figures put considerable effort and money into pushing three bills that would have taken away Second Amendment rights without due process of law. Thanks to your persistent calls and the dedicated efforts of a group of Second Amendment defenders in the legislature, these bills never made it to a vote. |

In recognition of Gov. Asa Hutchinson's recently opining that the open carry of firearms is, as he understands it, legal now under Arkansas law as long as the person doing the carrying doesn't intend to commit a crime, The Observer is pleased to announce the next step in the ongoing fight to preserve and defend the Right to Bear Arms: The Open Carry of Large Butcher Knives, Rusty Machetes or Razor-Sharp Hatchets Movement. |

Residents of inner-city Detroit are taking heed of their police chiefs advice: Get a gun, learn how to use it, and dont hesitate to shoot the bad guys.
For the second time in the past week, a Detroit woman with a concealed pistol permit has fired upon her attacker and sent them running for cover.
The latest incident occurred Tuesday morning, when 34-year-old Dietta Gueye was awakened before dawn by the sound of someone breaking into her bedroom window.
It was five men, at least two of whom were armed with guns.
They may have picked Gueyes home because it appeared to be a soft target. It sits on a street full of abandoned and burnt-out houses, next to an empty field. |

Gun owners Second Amendment rights are not completely destroyed by a ban on loaded firearms and ammunition at recreation areas managed by the U.S. Army Corps of Engineers, the 11th Circuit Court of Appeals has ruled.
At parks and campgrounds at dams and reservoirs throughout the United States, the Corps prohibits loaded guns without permission of a district commander. GeorgiaCarry.org and member David James, who frequently camps at Allatoona Lake in northwest Georgia, challenged that ban after a Corps commander refused to grant permission.

When a man armed with a loaded assault pistol strapped to his leg, dressed in camouflage, and singing to himself, began walking in front of a Grand Rapids church one snowy Sunday morning in March 2014, an alarmed churchgoer called 911. When police arrived, they took the man's gun, and briefly handcuffed him while they questioned him. The man, Johann Deffert, an "open carry" gun advocate, then sued police saying they had violated his constitutional rights. |

One would think that Catholic priests like Chicagos Rev. Michael Pfleger, an early supporter of Barack Obama and his push for gun control, would not be bearing false witness against one of his neighbors. Yet there he was standing in front of Chucks Gun Shop in suburban Riverdale, Illinois, to blame it, and other legal businesses like it, along with the National Rifle Association, for the murder spree in the gun-controlled progressive workers paradise of Chicago. |
