A grand jury has indicted Daniel Penny in the chokehold death of Jordan Neely on a New York City subway train. The indictment remains sealed, and the exact charges will not be announced until Penny appears in court.
Penny was arrested last month and charged with second-degree manslaughter. Penny claims he was acting in self-defense and the defense of others when he tried to restrain Neely.
Witnesses said that Neely, who was homeless, was screaming loudly and harassing people on the train before Penny, a former United States Marine, intervened. Penny subdued Neely and put him in a chokehold. |

It�s always been my desire to own a gun. Perhaps it�s because I grew up with a lot of anxiety about crime from when I was a little girl until I was a young adult.
I always thought it was crazy that we didn�t have a specific plan in my home for what to do if somebody broke in. I used to ask my dad when I was younger,
�Why don�t we have a gun in case bad guys break in?�
And my dad used to say,
�No. We don�t have guns. That�s not what we do. ..Don�t worry. Mom and I will protect you.� But, how? I wondered. |

A west Houston resident was shot confronting two burglars early Saturday morning, but he survived after returning fire and killing one of the assailants.
KTRK reported that the man received an alert through his Ring doorbell at about 3:30 am on Saturday and saw the two suspects walking into his garage. Seeing them walking away from the garage with a box of tools, the homeowner grabbed his handgun and went outside to confront the men. |

A 22-year-old man has been charged with assault after an incident in East Bremerton that left a 23-year-old fatally shot and another man seriously injured.
The events that led to the death came following a fight in the parking lot at McCloud's Grill House off Wheaton Way in Bremerton early Friday morning, according to court documents.
The Kitsap County Medical Examiner's Office identified the deceased man as 23-year-old Deshawn Wild, of Lynnwood, and said his cause of death was multiple gunshot wounds and his manner of death was homicide. |

Whatever else Gov. Gavin Newsom �s (D-CA) campaign for a 28th Amendment gets wrong about guns, at least it implicitly admits that the Democratic Party�s gun control wish list is unconstitutional under the Second Amendment . After all, why propose an amendment if the Constitution doesn't forbid what you want to accomplish?
Leaving Newsom�s admission aside, however, his 28th Amendment would accomplish nothing, at least nothing good. At worst, it would lay the legal groundwork for confiscating every gun in the United States. |

Republican efforts to prevent the use of a financial tracking code for firearm retailers have expanded.
Over the weekend, Texas Governor Gregg Abbott (R.) signed House Bill 2837. The law prohibits transactions at firearm retailers from being tracked with a specialized Merchant Category Code (MCC). Texas joins Montana, North Dakota, Idaho, West Virginia, Mississippi, and Florida in passing laws to ban the use of the specialized codes.
The move makes Texas the biggest state to implement restrictions on the use of MCCs. It also represents a victory for gun-rights advocates and gun industry members who have been pushing back against the idea of trying to track, and potentially flag, certain kinds of gun purchases. |

A Republican lawmaker has said that a Biden administration rule targeting pistol stabilizer braces could trample gun owners� basic rights under the Second Amendment.
�You�re talking about something that was completely legal. It�s not even a firearm, it�s a piece of furniture for the firearm and you�re now trying to go ahead and criminalize people for this. This is a very slippery slope and a Second Amendment violation,� Rep. Cory Mills (R-Fla.) told The Post Wednesday. |

If you draw your gun, you better be justified in using it, and prepared to press the trigger. Don't ever draw the gun as a tool for intimidation only.

A separate Peltola-backed effort would undo a Bureau of Alcohol, Tobacco, Firearms and Explosives rule that reclassifies pistols with stabilizing braces as rifles and requires owners to register them with the government. Republicans argued that the rule oversteps gun owners� Second Amendment rights.
Peltola, a vocal supporter of gun rights, voted for the resolution alongside moderate Democratic Rep. Jared Golden of Maine, who regularly bucks his party. All but two Republicans also backed the measure. The Biden administration has threatened to veto the legislation. |

A longshot right wing initiative that seeks to sabotage Washington�s gun safety laws is opposed by a plurality of likely 2024 Washington State voters despite having received a favorable ballot title and looks like a bad bet for the gun lobby, the Northwest Progressive Institute�s most recent statewide poll has found.
46% of 773 respondents interviewed last week by Public Policy Polling for the Northwest Progressive Institute said they would �probably� or �definitely� vote no on Larry Jensen�s Initiative 2078, which Jensen is trying to qualify to the 2024 Washington State Legislature with the backing of Tim Eyman and Glen Morgan. |

I am writing in opposition to item 23-099 from the Town Council meeting on March 22, 2023, which reaffirmed the resolution declaring the town of Burrillville to be a 2nd amendment sanctuary town (first) adopted April 24, 2019. This last resolution is specifically written as a proclamation in opposition to pending Rhode Island 2023 gun control legislation. I especially disagree with the position urging the General Assembly to repeal Rhode Island General Law 1-47-60 which prohibits possession of firearms on school grounds. |

A federal judge has denied the plaintiffs� motion for a preliminary injunction in the lawsuit challenging Washington�s ban on many semi-automatic firearms commonly used by lawful Americans. The new law makes the sale, import and transfer of 60 named firearms illegal along with AK-47 and AR-15 rifles in �all forms.� In the lawsuit Hartford v. Ferguson, plaintiffs argue that the blanket ban is unconstitutional under the Second Amendment.
�The Supreme Court has repeatedly held that the Second Amendment �protects the possession and use of weapons that are in common use at the time,�� the plaintiffs� motion for preliminary injunction stated. �The banned firearms certainly qualify for protection under this standard. |

A defendant�s tougher sentence for possessing a gun while selling drugs was upheld by a federal appellate court.
The defendant argued that the sentencing enhancement violated his Second Amendment right to keep and bear arms. But the US Court of Appeals for the Ninth Circuit said Tuesday that Miguel Alaniz didn�t have the right to keep and bear arms �during and in close proximity to his criminal activities.�
