New charges have been filed against 65-year-old Charles Foehner after he shot and killed a man who he says was trying to rob him.

Foehner is facing more than two dozen counts of criminal possession of a weapon after the shooting death of 32-year-old Cody Gonzalez who is seen in surveillance video pursuing Foehner.

The Connecticut House passed sweeping new gun laws this month attempting to curb firearms-related violence. Despite the efforts of many states to curtail crime with firearms bans, 3D-printed, homemade firearms continue to exploit the shortcomings of these policies. The family of Banko Brown has filed a wrongful death lawsuit against Walgreens and a security guard who fatally shot Brown in April in San Francisco.

Security guard Michael Earl-Wayne Anthony shot and killed Brown, 24, at a Walgreens on April 27 after Anthony confronted Brown about allegedly shoplifting $14 worth of merchandise.

The shooting inspired protests and calls for Anthony to be charged with murder.

This article (which I serialized several months ago) is now out in the NYU Journal of Law & Liberty. The Introduction:

Craig is trying to force Danielle to do something, by explicitly or implicitly threatening to criminally retaliate if she doesn't go along. And, as often happens, Craig's threatened crime would endanger not just Danielle but also innocent bystanders.

Should the legal system require Danielle to comply with the demand, on pain of civil liability or even of criminal punishment? Or should Danielle have, in effect, a right to defy Craig's demands, even if this means a higher risk to bystanders?

While the Ohio General Assembly moves closer to removing sales tax from baby items, another bill introduced late Wednesday would strip sales tax from guns and ammunition.

The proposed legislation would also give tax credits to gun and ammunition manufacturers to offset a federal excise tax on gun and ammunition makers.

�We are enforcing the constitutional rights of our citizens with this legislation,� Rep. Al Cutrona, R-Canfield, said. �This will not only lower costs for Ohioans, but it will also assist Ohio�s businesses.�

A Manhattan grand jury has begun hearing evidence against former Marine Daniel Penny concerning the chokehold killing of Jordan Neely on a subway last month, the Daily News confirmed Thursday.

According to a law enforcement source, the panel began hearing the Manhattan district attorney�s case against Penny on Wednesday. Prosecutors declined to comment or confirm.

Penny, 24, of L.I., has pleaded not guilty to second-degree manslaughter for the May 1 death aboard an afternoon F train. Disturbing footage of the incident shows Penny on the ground with his arms around Neely�s neck until the 30-year-old stopped moving.

After interviewing a woman on scene, police decided to charge Hensley and, upon his release from the hospital, take him to Albemarle-Charlottesville Regional Jail, where, according to court records, he continues to be held.

Byers said that officers consider the shooting a case of self-defense and declined to release the name of the shooter.

Calling this �an isolated domestic incident� that remains under investigation, the police department urges anyone with information to contact the criminal investigation division...

His lawyers have already told Justice Department officials that, if their client is charged with the gun crime, they will challenge the law under the Second Amendment, according to a person familiar with the private discussions granted anonymity because they are not authorized to speak publicly. That could turn a case that is already fraught with political consequences into a high-profile showdown over the right to bear arms.

Shannon Watts, the founder of the gun violence prevention group Moms Demand Action, praised Waldman for linking firearms to threats against children.

"This moral character being displayed by this one Georgia man � prioritizing children�s lives over gun-related profits � is sorely needed among right-wing Republican lawmakers in America," Watts said Thursday.

Asked about Waldman's concerns about young victims, Kris Brown, the president of Brady: United Against Gun Violence, said too many children are hurt by firearms every day in the U.S.

Tennessee Gov. A federal judge has denied a request by gun advocates for a restraining order that would have temporarily struck down Connecticut's ban on assault weapons while a lawsuit challenging the restriction is pending.

...

But U.S. District Court Judge Janet Bond Arterton concluded in a ruling issued Thursday that the gun group had no standing to seek the temporary order in part based on state officials agreeing that people who owned guns reclassified by the ATF would not be prosecuted under Connecticut's assault weapons ban.

According to the Axios report, more than 1,700 firearm-related bills have been introduced in state legislatures since last May, following the Uvalde, Texas, tragedy. Ninety-three of those bills were passed by legislatures and signed into law. Of those, 56 percent �expanded access to firearms or benefited the firearms industry by allowing manufacturing in the state or protecting them from liability lawsuits.� On the flip side, nearly 44 percent of the bills �restricted access to firearms or supported victims/potential victims in gun-related cases.�

From diapers needed in the cradle to firearms that could put people prematurely in the grave, Ohio lawmakers appear to be in a sales-tax-cutting mood.

One bill, which would eliminate sales taxes on diapers and other necessary child-care items such as car seats, strollers and cribs, passed the Ohio Senate Wednesday with bipartisan support.

It now moves to the Ohio House for consideration, although Senate President Matt Huffman, R-Lima, has discussed adding the measure to the state budget lawmakers are working on.

The mantra and foundation of the political left�s propaganda on guns is that it is always the gun. It is never the fault of criminals nor the state/city prosecutors of the Democratically controlled cities who refuse to prosecute and jail the violent repeat offenders who commit most murders.

Per Alan Gottlieb of the Citizens Committee for the Right to Keep and Bear Arms: �The idea of putting violent, repeat offenders in prison has always made more sense than penalizing law-abiding citizens who only want to exercise their constitutional rights.�

As marijuana restrictions loosen around the country, the ATF wants Americans to know users of the drug are still prohibited from owning guns.

On Tuesday, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) clarified what Minnesota�s recent legalization of marijuana means for current and future firearms owners in the state. The agency said the federal Gun Control Act of 1968 bars anyone who unlawfully uses a controlled substance from possessing guns or ammunition. And, while marijuana is now decriminalized in Minnesota and 23 other states, use of the drug is still unlawful under federal law.

Erin Brown recalls all too well the dreadful call he received from his mother in 2021, while in the thralls of the covid-19 pandemic: His cousin � his �brother� � had been shot six times.

Although it was not the first time gun violence had reached the then-17-year-old Brown�s social circle, that incident was different. It involved family. So it hit Brown harder, even though his cousin, then 21, survived the gunshot wounds.

Hunter Biden's lawyers have latched onto a legal argument that President Biden has ripped as contrary to 'common sense' as they seek to persuade prosecutors not to hit him with a gun charge from his troubled past.

In addition to the long-running federal probe of his taxes and finances, the president's son has been investigated for a possible gun charge over a form he signed in 2018 when applying to own a firearm.

He checked 'no' when asked if he was addicted to drugs � although this appears to contradict information he put in his own autobiography about his state at the time.

Knife Rights has filed a federal lawsuit challenging the constitutionality of portions of the Federal Switchblade Act (Title 15 Chapter 29 �1241), originally enacted in 1958, that restricts the introduction into interstate commerce of common automatically opening (�switchblade�) knives. It also challenges the ban on their possession on Native American reservations and in U.S. territories.

During a pre-trial hearing in Portland Tuesday, in preparation for a scheduled five-day federal court battle to determine the constitutionality of Oregon�s gun control Measure 114, nationally-recognized firearms trainer and author Massad Ayoob told an attorney representing a gun control group why he opposes limits on magazine capacity, according to the Portland Oregonian.

Ayoob, who is also president of the Second Amendment Foundation, was blunt: �On principle, I don�t see supporting a law I know the criminals will never obey.�

This comes as no surprise. Although the GOP has a supermajority plus one in the Senate, a large handful of them go weak in the knees on different issues that should be slam dunks for any conservative (or, in the case of the child protection bill HB 648 that would prohibit permanent physiological mutilation of minors without informed and reasoned consent, any human being). McCormick�s HB 131 presents one such challenge when the chattering classes and certain special interests to which they pay attention oppose it, yet in all likelihood a majority of their constituents, and almost certainly of those who vote in legislative elections, favor it.

The tragic death of Jordan Neely and the despicable legal lynching of Daniel Penny are not random events.

Democrats have instituted globalist-inspired programs and policies, transforming major cities like New York into dystopian hellscapes. Public safety has been abandoned. Predatory criminals, the drug addicted, and the violently mentally ill roam the streets and subways with impunity. Police are either absent or passive spectators. States attorneys protect criminals instead of their victims.
