Hurley is being called a hero for reportedly taking down a gunman who killed an Arvada police officer.

Wednesday night, sources told FOX31 the Critical Incident Response Team (CIRT) is investigating the possibility that a responding officer shot Hurley.

Self-defense experts say concealed carry owners are often faced with split-second decisions in situations like this.

An 11-judge panel, sitting en banc, heard oral arguments in Duncan v. Bonta (formerly Duncan v. Becerra). The CRPA lawsuit, which challenges Californias flat ban on magazines capable of holding more than 10 rounds of ammunition, was the first successful constitutional challenge to bans on so-called large-capacity magazines in the country. But with a likely unfriendly en banc panelcomposed of 7 judges appointed by Democrats and just 4 appointed by Republicansthat victory hangs in the balance.

Democrats believe that those laws didnt work because they were not restrictive enough. And yet they continue to claim they are not asking for total disarmament.

The Democrats current idea of compromise is to permit only a few trusted people to own a single-shot firearm that would be infrequently used under highly controlled circumstances. And, none of those circumstances will include self-defense.

CA: California 9th Circuit Heard Arguments in Magazine Ban Case

California argued that banning large-capacity magazines was necessary to reduce gun crimes where more than 10 rounds of ammo were used. Those crimes are relatively rare. But at the same time, California argued that the ban is trivial because law-abiding citizens rarely use 10 rounds of ammo in self-defense situations. In other words, California argued that rarely occurring events justified its authority to ban the magazines, but the ban was trivial because law-abiding citizens rarely need 10 rounds of ammo to defend themselves. Judge VanDyke then accused Californias counsel of making a heads we win, tails you lose argument by using rarity in two different ways.

Rep. Dan Newhouse, R-Wash., is sponsoring a bill that would categorize the firearms industry as critical infrastructure and those who make, sell and repair guns and ammunition as essential workers.

The bill has support from some Columbia Basin officials, including Moses Lake Police Chief Kevin Fuhr.

Newhouse introduced on Tuesday the Second Amendment is Essential Act to amend the Homeland Security Act of 2002 and the Patriot Act, passed nearly 20 years ago following the Sept. 11, 2001, terror attacks, to add the manufacture, importation and selling of firearms and ammunition to the list of businesses and industries essential to U.S. safety and security in times of emergency as currently defined by federal law.

President Biden in remarks Wednesday said his crime prevention strategy would focus on strengthening background checks, banning assault weapons and high-capacity magazines, and boosting community policing.

Biden met with state and local leaders and law enforcement officials ahead of his remarks to talk crime prevention strategy, amid a surge in violence in cities across the U.S.

Both Biden and Attorney General Merrick Garland, who spoke before him, pointed to a historic rise in crime in the summertime, and said that rise "may be more pronounced" as the nation comes out of the COVID-19 pandemic.

"Red flag" gun laws--which allow law enforcement to temporarily remove firearms from a person at risk of harming themselves or others--are gaining attention at the state and federal levels, but are under scrutiny by legislators who deem them unconstitutional. A new analysis by legal scholars at NYU School of Global Public Health describes the state-by-state landscape for red flag legislation and how it may be an effective tool to reduce gun violence, while simultaneously protecting individuals' constitutional rights.

Sonny Hostin, one of the shows most progressive panelists shocked viewers with her about-face on guns this week. The former lawyer, historically critical of 2nd Amendment rights, shocked viewers on Wednesday morning when she shared, A lot of my friends and family members have begun to purchase guns, theyve begun gun training and, I think, a lot of it has to do with the increase in violence against Black people. This is in stark contrast to what she said three months ago to the day. I dont think we can any longer equate freedom with the unfettered right to own assault rifles. She bolstered this opinion with an emotional plea, I feel like a hostage to the selfish people that insist on owning these weapons.

WI: Wisconsin Senate passes 'Second Amendment sanctuary' legislation limiting federal gun laws

The Senate passed Assembly Bill 293 on a voice vote. It is meant to exempt firearms in Wisconsin from federal gun laws and regulations. Similar measures have been found unconstitutional in other states because state laws can't override federal ones.

If signed into law and deemed constitutional, the legislation would prevent Wisconsin law enforcement officials from confiscating guns from those convicted of misdemeanor domestic violence offenses, according to nonpartisan lawyers for the Legislature. That's because there is no state law that corresponds with a federal law allowing guns to be taken from such offenders.

On Wednesday, Change the Ref, an organization aiming to raise awareness about mass shootings, released a video titled "The Lost Class," which showed Lott speaking to a chorus of empty chairs on June 4, an event he thought was a rehearsal for a prominent institution's graduation commencement. The footage featured clips of Lott talking about gun background checks as the group panned over the empty chairs and insisted thousands of high school students die from firearm violence annually, a number Change the Ref says would be improved by more laws regulating gun sales.

Texas HB 1927 the new constitutional carry bill was just signed by Gov. Greg Abbott on June 16. As its nickname suggests, this law recognizes the constitutional right to bear arms by removing the requirement that Texans obtain a license before they are allowed to carry a handgun. As Ellis County Judge, I believe that constitutional carry makes sense for Ellis County citizens and for Texas.

California is appealing a recent decision by U.S. District Judge Roger Benitez, who ruled that the states 1989 ban violates the Second Amendment. Gov. Gavin Newsom said the ruling was a direct threat to public safety and innocent Californians.

The law says such rules shall be invalid to this state, shall not be recognized by this state, shall be specifically rejected by this state, and shall not be enforced by this state. It authorizes injunctions against law enforcement agencies that violate this new policy, along with civil penalties of $50,000 per occurrence.

In response to anxious questions from the U.S. Justice Department, Parson and Schmitt said the laws restrictions and remedies apply only to state and local officials. That means they do not interfere with federal enforcement of federal laws the same point the Times made in defense of sanctuary cities and states.

Gun rights groups and Connecticut residents reached an agreement with the state that effectively ends their challenge to a 2013 law that restricted ownership of large-capacity gun magazines.

Susan Ross and Domenic Basile, as well as the Connecticut Citizens Defense League Inc. and the Second Amendment Foundation Inc., sued state officials in March 2020. The threat of enforcement of the law keeps plaintiffs from loading magazines to full capacity and limits their ability to keep and bear arms in the process, the complaint says.

 QUOTES TO REMEMBER
America does not go abroad in search of monsters to destroy. She is the well-wisher to the freedom and independence of all. She well knows that by one enlisting under other banners than her own, were they even the banners of foreign independence, she would involve herself beyond the power of extrication in all the wars of interest and intrigue, of individual avarice, envy and ambition, which assume the colors and usurp the standards of freedom. JOHN QUINCY ADAMS (1821)
