Supreme Court bans warrantless cell phone searches, updates privacy laws

The Supreme Court ruled Wednesday that police cannot go snooping through people�s cell phones without a warrant, in a unanimous decision that amounts to a major statement in favor of privacy rights. Police agencies had argued that searching through the data on cell phones was no different than asking someone to turn out his pockets, but the justices rejected that, saying a cell phone is more fundamental. The ruling amounts to a 21st century update to legal understanding of privacy rights. �The fact that technology now allows an individual to carry such information in his hand does not make the information any less worthy of the protection for which the Founders fought,� Chief Justice John G. Roberts Jr. wrote for the unanimous court.

Michigan's concealed weapons permit process is one step closer to becoming faster, cheaper and easier.
A state lawmaker wants to streamline the process to get a concealed carry permit. The new law would eliminate county gun boards from reviewing permit applications but some say those boards ensure gun safety statewide.
This bill has already passed the state Senate.
A Michigan State Police spokesperson says they're opposed to this legislation.
Meantime, the Michigan Sheriff's Association says they haven't come to a decision on whether or not they back the proposed law.
The bill is now headed for the state House of Representatives.
We�re expecting a vote sometime after the November election. |

O�Toole has been in and out of law enforcement in Massachusetts and recently in Ireland, but she�s yet to walk a beat west of the Mississippi or north of the Columbia and when � not �if� � the mayor starts talking about gun control, she�ll be facing something not found in the Bay State. Gun owners in Washington State don�t need permission from police or politicians to exercise their rights, and they know it. Local governments can't set their own firearms policies, and gun owners know that, too. |

In a remarkable commentary published this afternoon, CNN commentator and legal analyst Mel Robbins noted that the next time there is a mass shooting, one should not blame gun rights organizations or so-called �lax gun laws,� but instead �Look first at the shooter and the mental health services he did or didn�t get.�
This was hitting the news wires about the same time that the Chicago City Council in a 48-0 vote, approved the gun sales scheme crafted by anti-gun Mayor Rahm Emanuel. That package includes video recording of all gun sales, a three-day waiting period for a handgun purchase and a 24-hour hold on rifles and shotguns. It also contains a one-handgun-per-month limit per buyer, and special-use permits for gun dealers. |

The Second Amendment Foundation is promising a lawsuit against a Connecticut school if it does not address inconsistencies with its firewall, which restricts access to pro-gun and conservative-leaning websites but allows students to freely view pro-gun control and liberal orientated pages.
This comes after Andrew Lampart, a senior at Nonnewaug High School in Woodbury claimed that sites belonging to many gun rights and conservative groups were restricted from access through the school�s internet firewall� while those for gun control organizations and liberal groups were not.
�It�s an outrage,� said SAF founder and Executive Vice President Alan M. Gottlieb in a statement last week. |

Gun owners achieved a big win in Colorado during Tuesday�s elections, but also suffered a narrow loss in Mississippi.
In Colorado�s 4th Congressional District, GOA-endorsed candidate Ken Buck won his primary by an astounding 20 points.
This is great news for gun owners across the country.
Gun Owners of America doesn�t look for candidates who will merely vote right, but do nothing else. We look for strong leadership qualities and the willingness to stand up to the powerful elite in Washington D.C., and Ken Buck is that type of person. |

People who imagine the Second Amendment doesn�t apply to semiautomatic weapons because the technology wasn�t available 200 years ago, must believe the First Amendment doesn�t apply to the telephone, telegraph, radio, television or the Internet.
When the Second Amendment was drafted, every weapon was a weapon of war. The Constitution made it clear weapons used to win the Revolution were to be owned by the citizens. It is widely understood that the Second Amendment, like the First and Fourth amendments, codified a pre-existing right. The very text of the Second Amendment implicitly recognizes the pre-existence of the right and declares only that it �shall not be infringed.� |

To take the NRAs position, if you are in a domestic relationship, a committed ten year relationship with children, but not a marriage certificate, and you beat up your girlfriend and leave her physically and emotionally scarred, and spend 5 years in prison, the gun prohibition should not apply to him. If they had married, the bill is OK to be applied to them. |

A bill that could ban private gun sales, set a high threshold of qualification for owning a gun and grant law enforcement broad discretion in issuing permits even for long guns is making its way through the committee process of the Massachusetts House of Representatives.
The bill, HB 4121, would place a host of new hurdles in the path of potential gun owners in a State that�s not known for its lawmakers� restraint in leaving the 2nd Amendment as it is. Gun owners both inside the State, as well as those throughout the Nation concerned about the general erosion of the 2nd Amendment right to bear arms, are calling the measure extreme and dangerous. |

The Second Amendment Foundation today filed a lawsuit in federal district court in North Carolina on behalf of an Australian citizen who legally resides in the state, but cannot obtain a concealed carry permit under a state law that only allows citizens to get such permits.
The plaintiff, Felicity M. Todd Veasey, lives with her family in Butner, where she has resided since 2004. Prior to that, she lived in neighboring Durham County. She has a permanent resident visa and she once worked at the Australian Embassy in Washington, D.C. |

Also Wednesday night, the State Committee unanimously denounced a gun control bill proposed by House Speaker Robert A. DeLeo, a Democrat, last month. Their resolution asked every Republican candidate � �from the top of the ticket to the legislative candidates at the bottom to stand united in opposition to this unconstitutional bill in its entirety and without compromise of our most basic rights to self-defense.�
That measure move could expose yet another rift between the party and its endorsed candidate for governor, Charlie Baker, who has spoken generally in favor of the gun bill.
�Charlie�s position remains the same,� spokesman Tim Buckley said after the vote. |

A Knight is well-known for his sword and shield, but some UCF Knights are more comfortable with firearms.
Many UCF students own firearms and carry concealed weapon permits, but with the differing UCF and Florida policies, these students are weighing in on why they choose to arm themselves.
Chris Morelli, a senior criminal justice major, owns a semi-automatic clip fed .22 caliber rifle by Marlin Firearms that he uses for target shooting, as well as a Sig Sauer P250 9mm handgun that he uses for target shooting and self-defense. |

Now, Florida has added insult to the serial injury in a state that is quickly becoming the modern equivalent of Hollywood�s fictional Wild West, since in the real �wild west� you had to check your guns at the sheriff�s office before entering Dodge City. In Arizona, Sheriff Wyatt Earp enforced a broad ordinance declaring it �unlawful to carry in the hand or upon the person or otherwise any deadly weapon within the limits of said city of Tombstone, without first obtaining a permit in writing.� |

Since the Dec. 14, 2012 massacre at Sandy Hook Elementary School in Newtown, Connecticut, in which 27 people including 20 children and the shooter were killed, there have been 79 more school shootings.
Gun rights advocates dispute the number related to schools, but that is the figure Bill Moyers reported a few weeks ago and there are certain to have been even more since his report. The total number of people killed by guns, suicide and accidental deaths between Newtown and December 2013 is 12,042.

In North Carolina, individuals wanting to exercise their concealed-weapon right must apply to their county sheriff for a permit. One prerequisite under state law is not suffering "from a physical or mental infirmity that prevents the safe handling of a gun." Sheriffs sometimes ask an applicant's physician whether the person satisfies this criterion.
The study showed that North Carolina physicians, by and large, feel uncomfortable and not so capable in this role of judging firearm competency.
The authors surveyed 600 physicians last fall on this subject and received 222 responses: 62% from family physicians and internists, and another 38% from psychiatrists. Thirty-six percent of the physicians said they owned a gun. |

Starting July 1, gun owners with a carry permit will be allowed to legally bring their guns into bars, churches and �unsecured� public buildings such as local libraries and the like.
While the law allows bar owners and church leaders to decide they will not allow weapons to be carried on their premises, there is no such waiver possible for �unsecured� government buildings that are not staffed by an armed security guard. Under a new law, gun owners with a carry permit will have the blanket right to carry their weapon into libraries and other government buildings. |

While Seattle Mayor Ed Murray meets with the City Council today to talk about solutions to so-called �gun violence,� the Chicago City Council will vote on Mayor Rahm Emanuel�s proposal to allow highly-restricted firearms sales in the Windy City.
Between Murray and Emanuel there may not be much philosophical difference about gun rights and firearms ownership, but there is a marked difference in style. Both men complain about violent crime, but compared to the Chicago slaughterhouse, Seattle is downright sedate. |
