Would you please tell me where exactly the Second Amendment to the Constitution of the United States says that a user of illegal drugs can be denied gun ownership?

I mean, you�re always going on an on about how people have a right to defend themselves. Against...you know...those people. And of course the government itself! People must have the right to protect themselves against those bucket helmeted storm troopers of the Deep State!

Ed.: Given the dearth of widespread historical laws, gun prohibition for peaceable drug users shouldn't survive Bruen. We'll have to see how the cases progress through the courts.

The U.S. Supreme Court is being asked to hear a legal challenge to New York's sweeping 2022 gun control law, which sets limits on who can get concealed carry permits.

A lawsuit filed by a New York gun owner challenges the state's new restrictions barring gun owners from carrying weapons in parks, bars and other "sensitive" locations and requiring them to demonstrate "good moral character" to get a gun permit.

Cao has the most campaign money and past experience running for higher office in a general election among the five contenders in the primary on June 18. He also has the endorsement of former President Donald Trump, who stated that Cao would help stop inflation, secure the border and "defend our always under siege Second Amendment."

The Second Amendment Foundation told Secrets that the Texas-based 5th U.S. Circuit Court of Appeals has agreed to hear oral arguments on the group�s claim that the administration crossed a legal line in suddenly imposing new ownership hurdles and taxes on the firearms.

�I expect that we will win at the 5th Circuit, and I am sure that the Biden Justice Department will appeal to the Supreme Court. I look forward to getting this case to the high court,� SAF founder and Executive Vice President Alan Gottlieb told Secrets on Wednesday.

Hunter Biden�s trial for lying on a Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Form 4473 has kicked off in Delaware. The trial has split the Second Amendment community. Some gun owners hope he gets criminally convicted and sent to prison, while others believe that the 4473 is unconstitutional and that no matter what your opinion of the man on trial is, we shouldn�t root for unconstitutional laws.

Hunter Biden marked that he was not a user of illegal drugs on the ATF Form 4473 when he purchased his Colt Cobra revolver. At the time, Biden was using crack cocaine and various other drugs.

The 5th U.S. Circuit Court of Appeals has announced it will hear oral arguments in the Second Amendment Foundation�s challenge of the �Final Rule� issued by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives regarding arm braces for pistols, during the week of Aug. 5th, 2024.

The case is known as SAF v. ATF and was filed in February 2023. SAF is joined by Rainier Arms, LLC and two private citizens, Samuel Walley and William Green.

C.A. Bridges, a �digital producer� for Gannett�s USA TODAY Florida network, wrote basically the same story on May 12 and May 28, which claimed that Florida has experienced more mass shootings than any other state. Unfortunately for Bridges and his readers, both stories were wrong, incredibly biased and typical of the fake news that permeates today�s corporate media, especially when the topic involves guns.

The bill ballyhooed by the Warwick Beacon (and the company�s other two newspapers, the Cranston Herald and Johnston SunRise) and other gun control advocates takes away the most essential reason for constitutionally owning a gun � self defense. A gun cannot be used for self defense or to protect a family member if it cannot be quickly accessed. Thus, the bill is most likely unconstitutional because it takes away the most important reason for gun ownership.

Court adjourned for the day in Hunter Biden's gun trial, with testimony expected to resume Thursday morning.

After the jurors were dismissed, Derek Hines told the judge the prosecution has six more witnesses after gun store clerk Gordon Cleveland, and that their testimony would be shorter. He said it is possible the prosecution could rest its case Thursday. If so, he said, the prosecution would like to know which witness or witnesses the defense might call.

Defense attorney Abbe Lowell didn�t indicate who his first witness might be once the government rests its case.

The Second Amendment�s right to bear arms was the subject of two cases heard this term. In United States v. Rahimi, the justices are deciding if a federal law prohibiting the possession of firearms by individuals subject to domestic violence protective orders violates the Second Amendment. The second case, Garland v. Cargill, considers if a bump stock, an accessory which allows a rifle to fire hundreds of rounds in a minute, can be regulated under the National Firearms Act.

Ed.: The still pending *Chevron* decisions will also bear on 2A rights, as govt. agencies try to regulate arms.

There has been a drastic surge in the number of Americans becoming first-time gun owners over the past four years according to a press release.

The National Sports Shooting Foundation (NSSF) pointed to data showing a major trend in gun ownership. The number of people who became first-time gun owners since 2020 has reportedly grown to over 22.3 million people, which is equal to the population of Florida.

Governor Greg Abbott�s pardon of Daniel Perry is creating a chain reaction of legal maneuvers. After Perry�s pardon, his attorneys filed a motion to dismiss an appeal of his murder conviction. But on Wednesday they�re temporarily suspending that motion. Perry�s attorneys want to wait for the outcome of the Travis County District Attorney�s application to reverse Perry's pardon before dismissing his appeal.

Attorney Clint Broden said, �In the one in a zillion chance that Garza�s Application is successful, Mr. Perry would then desire to pursue his appeal. Wherefore, Appellant Daniel Perry, respectfully requests this Court hold his Motion to Dismiss Appeal in abeyance ..."

The New York Times published an article headlined, �This Is How Close We Live to Gun Violence.� The article showed the in-depth work by the Times� researchers to map every homicide committed by a murderer criminally misusing a firearm in the United States since 2020. The Times drew a quarter-mile circle around each crime scene to then estimate how many people lived near those horrendous crimes.

The New York Times calculated that 47 million Americans � 8.7 million more than pre-pandemic � live within a quarter mile of these crime scenes.

The House of Representatives listened and passed H.R. 8580 by a vote of 209-196 with GOA-backed provisions to protect tens of thousands of veterans from being unconstitutionally disarmed by President Joe Biden�s bureaucrats. These two cases � one involving the president�s son, the other involving the president�s opponent in this year�s election � highlight the arbitrariness of a federal law that deprives Americans of their gun rights for reasons that have nothing to do with public safety. That constitutionally dubious law treats millions of Americans with no history of violence as public menaces who can never be trusted with firearms.

This policy is relatively recent. The original federal restriction, enacted in 1938, applied only to violent crimes like murder, manslaughter, rape, kidnapping and robbery. In 1961, Congress expanded the ban to cover nonviolent crimes punishable by more than a year of incarceration.

Erickson also pointed to discrepancies in state and federal law, including that federal law does not require serial numbers on privately made firearms or older guns manufactured prior to 1968.

"Looking at the plain language, if this court says every firearm in Minnesota is required to have a serial number then everyone that is in possession of a firearm that was manufactured before 1968 that does not have a serial number is committing a felony," Vagle�s defense attorney Anders Erickson told the justices on Wednesday.

Prosecutors maintain the language of the state law is clear.

But the majority of Chicagoans, we�re convinced, don�t feel any safer when they read stories of good-guy-with-a-gun responses to street crime. They may feel some satisfaction when street criminals feel the same level of fear their would-be victims do. But overall, it�s not a healthy environment in a city � where by definition people live close together � when gun-packing citizens become more the norm than the exception.

Three manufacturers of �ghost guns,� the self-built, largely untraceable firearms used in an increasing number of deadly shootings, have agreed to stop making or selling those guns in California and will pay the state $675,000 in civil penalties, officials announced Wednesday. The suit was filed by the city of San Francisco in 2021 and then expanded into a statewide case by Attorney General Rob Bonta.

Ghost guns, which have no serial numbers and are sold in parts that can be quickly assembled, have accounted for 25% to 50% of the firearms found at California crime scenes in recent years. A federal report found that 65% of all ghost guns found by officers in 2020 were in California.
