Citing not the Constitution but judicial supremacy through legal precedent, the U.S. 7th Circuit Court of Appeals upheld strict gun control ordinances in Chicago and suburban Oak Park, Ill., stating the 2nd Amendment applies only to federal laws.
This is one of the rare times you will see the federal government deciding in favor of states. Except in this case, it�s misapplied and incorrect, because the Bill of Rights, wherein the Second Amendment is contained, takes precedence over any states� infringement or cancellation of specific rights granted thereof. |

Although I doubt they will, this particular issue about college campuses around the country stifling debate about concealed carry on campus is an opportunity for those (the Daily News included) who have advocated gun control and victim disarmament to re-evaluate their positions, because it proves what other pro-gun-rights advocates and I have been saying for years.
We will only have our First Amendment rights so long as we have our Second Amendment rights. Once we have been disarmed, tyrants will take away all of our freedom, especially the right to dissent.
Now you see why there is an ammunition shortage. |

It resembled most any Sunday afternoon picnic in Bronson Park. Except most of the people assembled around tables filled with watermelon and grilled goodies had firearms in holsters strapped to their waists.
The Glocks and the Smith & Wessons remained holstered but visible during a three-hour Open Carry Picnic designed to raise public awareness of what organizers called Second Amendment rights in Michigan to openly carry a firearm in most places. |

Second, the fact criminals ignore the seriousness of crimes committed with a gun has little to do with prison sentences for offenders. We currently have a federal and state prison system bulging with a world record number of citizens imprisoned for all types of offenses, great and small.
What does encourage real and potential dangerous criminals of all stripes is the common knowledge that we have a Congress which is bought and paid for by the National Rifle Association, ensuring a constant voluminous supply of deadly weapons to support them. |

Judge Frank Easterbrook also stated in the ruling the federal republic is a longer standing and more deeply ingrained value than what kind of gun someone can own, Heise said.
In a release, the NRA said the court should have followed a Ninth Circuit Court of Appeals decision, which found previous court decisions did not prevent the Second Amendment from applying to states through the 14th Amendment.
It will be up to the Supreme Court whether to hear the NRA's appeal. If it does, the case will be scheduled for briefing and oral argument. According to the Supreme Court's public information office, the current term ends in June, with the justices returning in October.

"Earlier, he indicated he was going to push for Senate ratification of what is really an anti-American gun owner treaty," he adds.

A man who shot and wounded a dog that threatened the safety of his 4-year-old son does not have to pay a $2,156 veterinarian bill, a Yuba County Superior Court judge ruled Monday.
"The Second Amendment does apply in this country," Judge Julia Scroggin said in court. "You don't have to put up with somebody else's growling dog on your property."
Anthony Moua, 37, was sued in small-claims court by the dog's owner, Ernest Williams Harris, who said Moua didn't call Animal Control first to pick up the dog after it entered his property when getting out of the his yard two houses away in the 2100 block of Erle Road on Feb. 5. |

Having read and reread Valerie Schultz's May 30 article, "Unpacking heat: Mom's decision to turn in guns yields peace of mind," several times, I thought I might try to point out a few irresponsible statements she made. Most of the guns in this country are owned by responsible citizens exercising their Second Amendment rights that many of our forebears fought and died to ensure. I'm sure that most of the arms owned and enjoyed by most Americans are legal and properly registered, as most were purchased from a legal dealer. |

Sotomayor ruled this year that the Second Amendment did not protect ownership of certain martial arts weapons. Understandably, the plaintiff is seeking to appeal.
Wisdom should be a key attribute of any judge ... yet, Sotomayor's record indicates that all too often she relies, not on wisdom, but on liberal beliefs to anchor her decisions.
Even if one ignores the racist aspects of Sotomayor's 'wise latina' comments and presupposes them to be true, the question must be asked: Would those comments apply to her?
Count at least one observer who is skeptical of the nomination of this 'wise latina', not because of the second word in her description, but because of the first. |

The June 8 editorial ("Guns and justice," Opinion, June 8) writes of hope that Chicago's handgun ban will be upheld. I'd like to know how many people who also want such a ban have been the victim of a crime themselves. Not a family member, not a neightbor, not a friend, but......themselves.
My home was robbed in broad daylight while I was out for only an hour. Upon my return, my cell hone rang, so I stayed in my car for a few minutes, which I was told by the authorities was fortunate. Had I gone in the house, the burglars would probably have harmed me, rather than face the upgraded charge of "home invasion," which carries a much stiffer sentence. |

One year after the Supreme Court ruled that the Second Amendment protects an individual right to keep handguns, the justices have before them a new test of that right.
The National Rifle Association has appealed a ruling from a U.S. appeals court in Chicago that said the right to bear arms cannot be invoked by gun owners challenging state and local firearm regulations. It said the high court's groundbreaking decision last term in a case from Washington, D.C., allows the Second Amendment to cover only regulations by the federal government � at least until the high court weighs in again. |

As a traditional supporter of the right "to keep and bear arms," I find the content and purpose of HB 0962 and SB 1127 puzzling in the long-standing Second Amendment debate.
The debate surrounding the meaning and intent of the Second Amendment can be reduced to three interpretations.
First, some suggest that people have a right to bear arms for the purpose of maintaining a militia to prevent invasion and keep tyranny in check.
Second, that people have a right to bear arms if they are actively serving in a militia. The third interpretation is that individual citizens do not have to be in a militia to keep and bear private arms for personal protection. |

Throughout the history of law enforcement, police have been in an arms race with the criminals they pursue. Some believe that law enforcement agencies have started to go to far as many agencies have supplemented shotguns with rifles, while others feel that such arms are necessary to protect the public.
It can be hard to know where the line is drawn. While one need only to look around at the violent acts of criminal gangs and the threat of terrorism from abroad, many still object to the increasing paramilitarization of our police forces, particularly those of large cities. |

In a podcast interview with AVweb, Perry says he was going through his pre-start checklist for a flight to Loreto, Mexico on May 22 when his Cessna 210 was suddenly surrounded by yelling CBP agents and local airport police, weapons drawn (the Customs agents had M-16s) who ordered them out of the airplane. "They were yelling at us to put our hands on our heads," said Perry, a retired military officer who said he makes frequent flights to his second home in Loreto. In March, four police officers in Oakland, Calif., were gunned down in the line of duty. Days later, three police officers in Pittsburgh were murdered, also with guns. And they were far from alone. Police officers investigating a homicide or shooting try to piece together the information that leads them to the shooter. One of the most valuable pieces of information is the gun itself, but criminals rarely leave guns at crime scenes, which can leave investigators at a dead end. Currently, law enforcement officers can only trace the origin of a gun when they find the gun itself. A technology called microstamping has the power to change that. |
