Restraining orders scrutinized in wake of Supreme Court ruling

"A new U.S. Supreme Court ruling won't change how local officers enforce restraining orders, but it concerns at least one judge."

"Based on a Colorado case, the June 27 ruling says that police can't be sued for failing to enforce a restraining order. In the Colorado case, a woman made repeated phone calls and paid a visit to police within a few hours, asking them to find her estranged husband against whom she had a restraining order. She thought he had taken their three daughters. The man eventually turned up at the police department with a shotgun he had just purchased. Police shot and killed him, and the bodies of his murdered daughters were found inside his truck."

"An estimated 100,000 people were killed in conflicts in 2003 by small arms, which have inflicted more deaths than conventional weapons, a survey said Monday."

"Small and light arms accounted for 60 to 90 per cent of all direct war deaths in all phases of contemporary conflict by causing injury and death during fighting, said the independent Graduate Institute of International Studies in Geneva."

"The study said post-conflict regions have also experienced violence at levels higher than during armed conflict because of continued existence of firearms."

"Activists around the country are beginning to probe federal shooting ranges, seeking public access, if my inbound emails are any measure. This follows release of news from Bloomfield Press that federal law specifically allows such use (linked at end). So far, authorities have reportedly been resisting the public's interest in following the law, and that's putting it nicely."

"No one appears to be surprised by the stonewalling. Some of these target shooters have actually been motivated by the resistance they have encountered, saying it is a good arena for "shoe-leather activism.' The reward of having a lot of new places to go shooting has also encouraged people to act."

"Council members performed verbal gymnastics to rationalize their vote in favor of a ban. Council Member Patsy Thomas reminded everyone that she is a former county prosecutor and went on several drug raids, and has seen the power of the guns criminals have. She left out the fact that in earlier Council hearings on this matter, she has nodded in affirmation as fellow council members discuss their opinion that drug offenders don't belong in jail. Her comments are seemingly contradictory."

"AN explosives expert has won a three-year battle to stop police destroying an ex-military rocket launcher that is not considered a firearm under Tasmanian laws."

"In the Devonport Magistrates Court yesterday, Magistrate Don Jones denied applications from Tasmania Police to destroy a rocket launcher and two inert rockets seized from Erriba resident Peter Mielke in August 2002."

"In handing down his decision, Mr Jones said other states' firearm legislation contained provisions which could be applied to rocket launchers, mortars, and even rocket-propelled grenades, but Tasmania's did not, and he was not satisfied that Mr Mielke's rocket launcher was a firearm under Tasmanian legislation."

"Many hunters had to be sure shots because they carried long rifles that required 15 to 30 seconds to reload � measure out a small powder charge in a small cup, pour it down the barrel, place the bullet in a piece of cloth on top of the barrel and ram it down with the ramrod, replace the ramrod, charge the lock with powder, pull back the hammer and prepare to fire � more than enough time for a deer or other game to disappear into the woods or prairie grass."

"But there were some firearms that offered a second shot to hunters with swivel-barrels and over-and-under hammers. Some combined shotgun barrels with rifle barrels. With a twist and a pull back on the hammer, these guns were ready for another shot. But there was a drawback."

"The new law allows private citizens to use deadly defensive force anywhere outside their 'home castle' without fear of criminal or civil liability if they 'hold a reasonable fear of imminent peril of death or great bodily harm.' Instead of requiring an actual attack, the citizen-victim's perceived threat is the guideline, and it grants them a legal presumption that they in fact acted due to being in 'reasonable fear.' The act also allows recovery of reasonable legal fees, court costs and business losses due to having to defend civil lawsuits filed by intruders or other assailants."

"Involved parties have 'no duty to retreat and [have] the right to stand [their] ground and meet force with force [including deadly force] if the person is in a place where he or she has a right to be.' This broadly includes one's car, workplace and public places like shopping malls, parking lots, bars and restaurants. Formerly, the law would not allow use of lethal force outside the home until victims had first attempted to escape under the 'retreat doctrine.'"

That's a right that's been steadily eroded since the 1930's, and even in the supposedly pro-gun Bush administration, isn't really gaining ground. Gun sales records which are supposed to be destroyed when the applicant passes a background check are being held; various databases sought and promoted by government officials will prove to be gun registration whether they're called that or not.
