TX: HPD: Woman shoots, kills man who tried to break into her home in Spring Branch

A woman shot and killed a man Friday she said was trying to break into her home in the Spring Branch area, according to the Houston Police Department.

HPD said the woman, 41, is cooperating with investigators. They believe she fired in self-defense.

This happened right after 7 a.m. in the ABA RV Park on Jacquelyn Drive near Long Point Road.

Police said the man, 53, recently moved into the community and he and the woman had just met.

That�s why Democratic state leaders joined with leaders of the city of Columbus and gun control activists on the Statehouse steps on Thursday to send a message to the Republicans who dominate the Ohio Legislature.

�If they don�t have the courage to act, they need to get out of the way,� Columbus Mayor Andrew Ginther said.

For the past couple of decades, Republicans in the Ohio General Assembly have pushed through laws that they say protect the Second Amendment rights of law abiding citizens.

Federal law still bars cannabis consumers from owning firearms or ammunition.

That�s despite Second Amendment-friendly provisions in the Minnesota law. The federal Bureau of Alcohol, Tobacco, Firearms and Explosives has said that regardless of Minnesota�s new law, a �current user� of marijuana is defined as an �unlawful user� for federal purposes. That means people following state law are still prohibited from having guns and ganja.

�It really goes through that process of what it�s like to receive a child with a gunshot wound and what that is like to treat them, what that means for the families. These things continue to happen repeatedly and no one sees that more than our doctors who work in the ER,� said Au.

Rep. Michelle Au sponsored a bill last legislative session called the Safe Storage Act. It didn�t make it out of committee, but Au feels this letter could get her colleagues across the aisle to listen. She�s looking to add an addendum, a tax incentive for people to buy a gun safe or lockbox. She hopes that may get one of her Republican colleagues to cosponsor the bill.

This problem is not insignificant. In North Carolina, there are five firearm related deaths every day; in 2020 alone, more than 1,600 fatalities resulted. One-hundred-and-sixteen children died from a firearm-related injury in 2021, and related hospitalizations increased 120 percent from 2016 to 2020. In fact, gun violence is the leading cause of death for children, surpassing even motor vehicle accidents. More than half of all firearm deaths are suicides. Young people and veterans are at elevated risk of creating a permanent solution to a temporary problem when experiencing an emotional crisis. If the person is using drugs or alcohol, this risk increases.

�A statute that can only trace its origins back to 1938 (referencing the Federal Firearms Act of 1938) is surely not consistent with this nation�s history of firearm regulation. ... It is (a) modern law that has no roots in how the United States has treated firearms and firearm regulation,� the motion presents.

In Benton�s case, his previous felony convictions shouldn�t forever deprive him of gun ownership, according to the motion, as even �treasonous rebels� were able to regain firearm ownership following the Revolutionary War.

�There is no circumstances under which it is constitutional to permanently deprive an American citizen of a right guaranteed to him by the Constitution,� Joy wrote.

Everybody wants to shoot a magnum revolver until, well, they shoot a magnum revolver. Cartridges like the .460 S&W Magnum gain their appeal from proven performance on game, even beyond conventional handgun distances. However, many of these platforms are geared toward wilderness self-defense and, as such, are short in nature, making them only desirable to fire if your life depends on it.

The controversy within this amendment lies in the interpretation of the right to bear arms. Some believe it means the right of all to carry arms openly or concealed without restrictions. It is the opinion of the Shasta County Sheriff�s Office, and the courts, that Concealed Carry (CCW) permits authorize persons to bear arms without infringing on those rights. It is our belief that laws are made to govern rights and protect the rights of law-abiding citizens. There are members of our society who, if allowed to bear arms, would pose a danger to the public (violent, dangerous convicted felons, etc.). CCW regulations help ensure only those who meet the standards can lawfully do so.

Illinois Gov. J.B. Pritzker appeared to concede that his and Democratic lawmakers' ban on a wide variety of semi-automatic handguns and rifles has a less than 50-50 chance of surviving in the federal court system.

During a discussion the governor�s office said was about �gun violence prevention� at Temple Jeremiah in Northfield Thursday, Pritzker was asked about the chances his ban on certain semi-automatic firearms and magazines survives a challenge in the federal courts.

�It is not zero chance and it is not, you know, 30% chance, I think it�s better than that that we will win,� Pritzker said. �I don�t know what percent to put on it. I just think we have a pretty good argument.�

The Biden administration is blocking key federal funding earmarked under the Elementary and Secondary Education Act (ESEA) of 1965 for schools with hunting and archery programs.

According to federal guidance circulated among hunting education groups and shared with Fox News Digital, the Department of Education determined that, under the Bipartisan Safer Communities Act (BSCA) passed last year, school hunting and archery classes are precluded from receiving federal funding. The interpretation could impact millions of American children enrolled in such programs.

The man and woman were seated on the ground, being held at gunpoint, when police were called, McManus said.

Then about two minutes after that call but before officers arrived, the suspect pulled his own gun and shot the Ford's owner prompting him to return fire, killing the alleged car thief, McManus added.

The woman with the suspect was critically wounded in the shooting.

"The bad guy is the one dead, yes," McManus said. "The driver of the stolen vehicle is deceased, shot by the owner of the stolen vehicle."

It wasn�t until 2008 that the Supreme Court for the first time struck down a gun control law, ruling the 2nd Amendment protected the �right of law-abiding, responsible citizens� to keep a handgun at home for self-defense.

Last year, the court went a step further and said an �ordinary law-abiding citizen� also has a right to a state permit to carry a concealed weapon in public for self-defense.

Now the justices face a new frontier: Do gun rights extend to dangerous people and dangerous weapons?

A legal battle over whether Hawai�i can continue enforcing a new law banning firearms on its world-famous beaches went before a U.S. judge, who said Friday she would rule as soon as possible but didn�t give a specific date.

The state�s latest gun control measure landed in court because of a lawsuit by three Maui residents who want to carry guns on beaches and other places deemed sensitive by the law, which took effect this month and involves a misdemeanor offense.

On July 14 U.S. District Judge Karin Immergut held that while the Constitution protects an individual right to self-defense, large capacity magazines "are not commonly used for self-defense, and are therefore not protected by the Second Amendment."

Alan Gottlieb, founder and executive vice president of the Second Amendment Foundation, one of the groups that filed a notice of appeal, thought her decision was stunning.

"She went out of her way to find an excuse to say that the law does not violate the Second Amendment when it comes to magazines," he told Newsmax.

The Second Amendment to the Constitution states: �a well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.�

It has occurred to me that Massachusetts should form a militia from among the registered gun owners in this state and shut down FirstLight�s Northfield Mountain Pump Storage Station, which has been operating illegally (without a required license) since April 30, 2018.

Tennessee Gov. Bill Lee said details on a special session would finally come in the middle of August.

"The efforts of General Assembly members that are bringing ideas forward want to make sure this is a very productive session that leaves Tennessee safer," Lee said outside of an event on Friday to media members. �Usually we make a call about a week out. If we have enough clarity on what bills are going to be proposed by members of the General Assembly, we might make it a few days before.�

The date of the special session is Aug. 21 as was announced in May. This special session will discuss public safety and the Second Amendment.

A Springfield Township woman who shot a woman who had trespassed into her home saw her conviction thrown out in a ruling that cited the state�s �castle doctrine.�

Ohio's 1st District Court of Appeals on Friday threw out Tierra Robertson�s felonious assault conviction and ordered a new trial in Hamilton County Common Pleas Court.

In its opinion, the appellate court said the trial judge failed to instruct the jury on the state�s castle doctrine, a law that allows someone to defend themselves in their own home. With that instruction, the jury would have begun deliberations assuming Robertson acted in self-defense.

A condition of the Hunter Biden plea deal documented in the Hearing Transcript (p. 85) raises questions about the existence of and authority for permanent disqualifying entries in the National Instant Background Check System (NICS), a practice Gun Owners of America has demonstrated is unauthorized and unlawful. Attorney Stephen Stamboulieh filed a Freedom of Information Act request on behalf of this correspondent on Thursday to seek answers.

Addressed to the Office of the Attorney General, the request notes a commitment by Biden to �consent to a permanent entry in the National Instant Criminal Background Check System such that he will be denied via NICS if he attempts to legally purchase another firearm.�
