Kyle Rittenhouse's attorney wants a judge to allow him to argue that one of the men his client fatally shot during a Wisconsin protest was a sex offender, saying it supports a defense theory that he attacked Rittenhouse and intended to take his gun because he couldn't legally possess one.

Mark Richards maintained in court filings Thursday that Joseph Rosenbaum was convicted of having sex with a minor in Arizona in 2002 and was prohibited from possessing firearms. Rosenbaum started the altercation with Rittenhouse in hopes of making off with his assault-style rifle, which only bolsters Rittenhouse's self-defense argument, Richards wrote.

A Johnson City police officer�s daughter was cleared by a Washington County grand jury of any wrongdoing for shooting a man earlier this year after he pointed a gun at her.

District Attorney General Ken Baldwin confirmed that the grand jury reviewed evidence from the April 24 shooting that happened in the Cherry Street parking lot around 2:30 a.m.

The National Rifle Association on Wednesday went to a federal appeals court after a judge last month upheld a Florida law that prevents people under age 21 from buying guns.

The NRA, which challenged the constitutionality of the law after it passed in 2018, filed a notice of appealing the ruling by Chief U.S. District Judge Mark Walker to the 11th U.S. Circuit Court of Appeals in Atlanta.

The notice, as is common, did not detail the NRA�s arguments. But Marion Hammer, the organization�s longtime Florida lobbyist, said in an email that the NRA is pursuing the appeal to �protect the constitutionally guaranteed rights of all law-abiding adults.�

For the third time in just a week in our area, homeowners apparently shot and killed home intruders for fear of their lives while at home. A recent incident occurred on Tuesday in Fairfield. Last week, two separate burglary guns broke out in Modesto. In books since 1872, California�s �Castle Doctrine� gives them the right to act for self-defense because someone has invaded their home or premises without permission.

Shortly after D.C. v. Heller was decided, stun guns were banned in seven states, D.C., the Virgin Islands, several substantial cities, and some smaller towns. (I cataloged these in Nonlethal Self-Defense, (Almost Entirely) Nonlethal Weapons, and the Rights To Keep and Bear Arms and Defend Life, 62 Stanford Law Review 199 (2009).)

But I'm pleased to say that things have gotten a good deal better. In Caetano v. Massachusetts (2016), the Court signaled that stun gun bans may well be unconstitutional, and lower courts and legislatures have largely heard the message.

Homeowner CaliforniaThe Bay Area shot and killed an armed intruder he claimed to have kicked his front door while he and his wife were having breakfast.

Fairfield police received a 911 call about the shooting around 8:30 am on Tuesday.

The homeowner told police that he and his wife (both in their 60s, but unnamed) heard a knock on the door before the intruder kicked the door down.

He says he ran to regain the legally owned gun he used to shoot the man twice before he scrambled the street, fearing the safety of his wife and himself. It was.

Rep. Claudia Tenney, R-N.Y., is pushing the U.S. Supreme Court to overturn a state law limiting who can carry concealed handguns outside their homes, and she has support from 168 House Republicans.

Tenney and the coalition of Republicans will file an amicus brief backing the New York State Rifle & Pistol Association's lawsuit against New York, arguing that its law denying concealed-carry licenses to law-abiding citizens without a "proper cause" determined by the state is a violation of Second Amendment rights, the congresswoman announced Tuesday.

The Supreme Court on April 26 agreed to hear an appellate court's ruling upholding New York's state rules under the 1911 Sullivan Act.

� then liking guns is mental illness. That�s the endgame.

It�s obvious in the terminology. There can be no such thing as �gun violence,� because an inanimate object cannot be violent. It can be used in a violent manner but it cannot be violent in and of itself. Admit the use of the term and the discussion is lost.

Any restriction on firearm ownership that is based on the firearm and not the owner is unsupportable. I will grant that certain people should not be allowed to own firearms. I will not grant that those who may own them should be restricted in any way from owning whatever firearm they are inclined to own.

I recently joined Rep. Claudia Tenney (R-NY) and other Members of Congress in signing an amicus brief supporting the Supreme Court case NYSPRA v. Corlett to address unconstitutional limits placed on Americans� second amendment rights. NYSPRA v. Corlett challenges New York�s Sullivan Law as a violation of the Second Amendment and condemns a blanket ban on the right to keep and bear arms outside the home.

Under the Sullivan Law, citizens are required to have permission from the state government to carry their privately purchased handgun.

One of the court's other most publicized cases is a New York firearms dispute, the first major Second Amendment case. The justices will examine whether a state law forcing gun owners to demonstrate "proper cause" for a concealed carry permit violates the Second Amendment. The case came before the court after Justice Neil Gorsuch, joined by Justices Samuel Alito and Clarence Thomas, all but asked for it in a 2019 opinion.

It started in the summer of 2016. The back-to-back shootings of Alton Sterling and Philando Castile brought what many saw as a groundswell around race issues in the United States. It was in this atmosphere that the #BlackLivesMatter movement began to firmly take root. But it wasn�t the only one to get started.

Maj Toure answered his cell phone from his mobile-training RV somewhere in Mississippi; he talked smoothly but with the speed and passion of an activist. The interview careened down one fully fascinating rabbit hole and then headed down another intriguing path, any sense of a quick, boring media interview long since evaporated.

"Usually, they're going to be NYS gun laws that are going to be enforced on not be enforced as time goes by," Pullano stated. Nearly 1.2 million law-abiding Californians bought a firearm in 2020 and the ranks of gun-owning Golden Staters has grown even more in 2021. They had good reasons but their purchases may now cost some even more.

Gun control cheerleaders and their media allies are heralding a new �innovative� achievement as a shining example city officials in San Jose, Calif., believe is needed to offset the costs of criminal violence. That focus is entirely misplaced. They just want to impose a new �gun ownership� tax and require already law-abiding gun owners to purchase liability insurance just to exercise their Constitutionally-protected Second Amendment right.

Congresswoman Claudia Tenney, R-New Hartford, was in Ilion Tuesday to discuss the Congressional amicus brief related to an upcoming Second Amendment case in the U.S. Supreme Court, but many of the concerns expressed centered on a new state law regarding civil lawsuits against gun manufacturers.

The law passed by the state Legislature and signed into law Tuesday by Gov. Andrew Cuomo raises concerns among state and local officials about the future of the Ilion gun manufacturing plant now known as RemArms.

The title �The Price of Freedom� refers to the death toll that the gun lobby would dismiss as simply the cost of Second Amendment rights. Bill Clinton, among other interviewees in this documentary, disputes that idea. If the deaths of innocents are necessary for people to exercise their freedom, the former president says, the logical conclusion is �that we don�t really have mutual responsibilities to each other. It�s a very high price.�

The movie, directed by Judd Ehrlich, takes viewers through the history of the National Rifle Association, explaining competing factions in the 1970s and charting the increasing radicalization of the organization�s rhetoric.
