Schenectady County Court Judge Karen Drago has toughened her sentencing policy against people accused of firing a weapon in a crime, hoping to send a message about escalating violence in the community, officials said. Drago has told the Schenectady County District Attorneys Office that she no longer will accept a plea agreement that does not require the person to serve a minimum of 10 years in prison. |

A 75-year-old Union City homeowner said a frightening break-in started when someone rang his doorbell. Then, the homeowner said, there was a noise at his back window.
So I went upstairs and got my pistol and came back down, said the homeowner who didnt want to be identified.
Im within 8 feet of the guy. Im nervous. I yelled at him and it seemed like his hand went up so I hit the floor and I started shooting, said the homeowner.
The homeowner said he fired at least three rounds. Police said one bullet hit the 17-year-old suspect in the leg and the other in the groin area.
The homeowner said he purchased the house three months ago and this was the second time someone tried to break in. |

Supposedly from a August 7 draft of the Democratic Party Platform for 2008: "We recognize that the right to bear arms is an important part of the American tradition, and we will preserve Americans continued Second Amendment right to own and use firearms."
No, thats not correct. The right to bear arms is a right endowed by our Creator, existing prior to the creation of this country, incapable of being alienated or surrendered, with protection guaranteed by the Constitution. It is not merely important or traditional.
Nah, the Democrats CONTINUE to want to remove all firearms from civilian ownership. Period. And my hands are not yet cold nor dead, so good luck Liberals. |

The fact of the matter is that in a conservative state like Kansas, or even Louisiana, no law enforcement officer should have an incentive to obey such unconstitutional orders. Yet they did. Why?
Because they haven't been called on it by the populace who elects the sheriffs and the politicians who appoint the police chiefs.
So let us do this. Let us craft a pledge, one using simple language affirming that the Second Amendment is not suspended by natural or man-made disasters. Let us then make that pledge part of our vetting process for political campaigns. And we shouldn't even wait for the sheriff to get re-elected, but approach him now, asking for his signature on this pledge, swearing that he will abide by it no matter what.

Albany County lawmakers are expected to re-allocate $10,000 tonight so a local pastor can continue his gun buyback program. Rev. Charles Muller of Victory Christian Church established a program in May to get guns off the streets of Albany after the shooting death of 10-year old Kathina Thomas. He offered a gift card to Crossgates Mall to anyone who turned in a gun, with no questions asked. So far, 60 guns have been turned in, but Muller ran out of funds for the program. Albany County legislators decided to help fund the program to reduce gun violence in the city and county. "Rather than re-invent the wheel, we will allocate the money toward Rev. Muller's program," said cegislator Chris Higgins. |

Robert A. Levy and David B. Kopel
The Supreme Court ruled in June that provisions of Washington, D.C.'s gun laws are unconstitutional. Unfortunately, the city has responded with new regulations that are a flagrant attempt to circumvent the court's decision.
It's time for Congress to use the power granted to it in the Constitution to "exercise exclusive legislation" in the District and uphold its residents' constitutional rights. It can do so by passing the District of Columbia Personal Protection Act now pending in Congress, with a few adjustments. |

What is it about Guns? . . a question addressed by many observers except Presidential candidates where the subject seems to be verboten. Here’s a new wrinkle: As the 2008 presidential candidates remain mute or just vague on prime 2008 liberty questions - especially in light of the recent Supreme Court decision that gun bans are unconstitutional - you’d think they’d comment as an important plank on their platform.
Are they missing a bet?
There are more than 300 million guns in the hands of some 80 million adults (I said adults) in America, and most of these adults believe that non-gun owners don’t have a clue as to what guns are really all about. |

A big boost is coming for a gun buyback program set in motion by the death of an Albany girl.
The Albany County Legislature is voting Monday night to contribute $10,000 originally earmarked for a county buyback plan to the program started by the pastor of Albany’s Victory Christian church, which trades guns for gift cards at the mall.
Reverend Charlie Muller says they have taken in more than 60 weapons in over six weeks since he started a gun buyback program. |

The gun issue, he adds, will hurt Obama. Obama, who has been endorsed by the moderate American Hunters and Shooters Association, received an F rating from the National Rifle Association for supporting gun control measures. McCain has an NRA rating of C.
Here, the right to bear arms is sacrosanct; you don't run for office in Montana if you don't believe that, says Schweitzer, who has an A rating from the NRA. Marty Rau, 58, a lifelong Montanan and railroad worker who lives outside Missoula, agrees. "Any type of restriction on ownership just simply opens the door to more," Rau says. "A pickup truck with a gun rack—that's how it's always been." |

A Transportation Security Administration official said Saturday that it is considering allowing airports to ban guns from its premises.
The ban proposal follows a request from Atlanta Hartsfield-Jackson International Airport.
A new gun law that went into affect July 1, now allows Georgians to carry concealed weapons into restaurants that serve mainly food, state parks and on public transportation, including MARTA trains and buses.
--- Submitter's note: Federal law bars passengers from bringing weapons to or past airport checkpoints. But in many airports, state law allows passengers to carry guns and knives in unsecured areas such as a main terminal. |

The Transportation Security Administration may allow airports to ban firearms from terminals, parking lots, roads and other airport areas where many states currently allow passengers to carry lethal weapons.
Airport officials and lawmakers are watching closely as the TSA weighs a request by Hartsfield-Jackson Atlanta International Airport to modify its security program to impose an airportwide ban on guns. It is the first such request to TSA from an airport.
"I don't really like the idea of people coming here with weapons and carrying them into terminals, but that's their right as citizens of the state of Texas," said Alan Black, public safety chief at Dallas/Fort Worth International Airport. |

TRANSCRIBER'S NOTE: In fact, the rebellion might have been strangled in its crib for want of powder, had not another source been found -- contraband powder smuggled through, I am proud to say, the Dutch West Indies island of St. Eustatius. Smugglers have long been a necessary component of the forces of liberty. But THAT story is for another day. MBV |

A federal judge on Monday upheld a gun ban at the world's busiest airport, dealing a blow to gun rights groups who argued a new Georgia law authorized them to carry weapons in certain parts of the Atlanta airport.
U.S. District Judge Marvin Shoob expressed concern that allowing guns at Hartsfield-Jackson Atlanta International Airport could cause significant economic damage and could be a "serious threat to public safety and welfare."
His decision rejected a request by GeorgiaCarry.org that would have temporarily allowed gun owners to carry their weapons in the airport until his final ruling on the gun ban — a challenge that could likely last months. |

An aspiring Savannah rapper who was shot and later died was committing a crime when it happened, police said Wednesday.
Kareem Omarr Grant, 25, was shot in the back of the head July 19 during an attempted robbery of two people, said Judy Pal, a Savannah-Chatham metro police spokeswoman.
The robbery victim shot Grant in self-defense, she said.
Grant and two others were together in a 2001 Buick LaSabre near Wilshire and Montclair boulevards about 4:45 a.m. when they encountered two men walking down the street.
The men got out of their car and approached the two unidentified walkers, intending to rob them, Pal said.
"One of the victims apparently pulled a gun and shot Grant in self-defense," she said.

GUATEMALA CITY -- Robbers armed with machetes hacked a U.S. tourist to death and seriously wounded his wife in an attack aboard the couple's sailboat in northeastern Guatemala, the woman said Sunday. -------
Submitter's Note: There are two unfortunate lessons learned here. First is that many non-firearms make excellent weapons and most are too common to consider banning. Secondly, armed robbers will not necessarily let their victims live just because they complied with the robber's demands. |

Bernard W. Bell, a professor and associate dean at Rutgers Law School in Newark, argues that the unintended victims of gun violence should be permitted to sue GUN OWNERS (emphasis added).
Bell goes on to say, "Earlier this summer, the U.S. Supreme Court decided, in District of Columbia v. Heller, that the Second Amendment CONFERS (emphasis added) a personal right upon citizens to keep guns for self-defense. Of course, the majority acknowledged that the right it recognized is far from absolute."
