If Posner is nominated to replace one of the Court�s current conservatives, he could easily take flak from the GOP for his decision in NRA v. City of Chicago. NRA is a relative of the recent Supreme Court decision in McDonald v. City of Chicago that held the Second Amendment is incorporated against the states. In NRA v. City of Chicago, Judge Posner had held along with the rest of the three-judge panel that the Second Amendment was not incorporated against the states and that therefore no Constitutional right overrode Chicago�s ban on personal handgun ownership. |

Three trials later, authorities have finally won a criminal conviction against Hal Turner, the New Jersey hate blogger charged with threatening to kill federal appeals court judges.
Turner was convicted in federal court in Brooklyn on Friday of threatening to assault or murder a federal official or judge, and faces a maximum 10-year prison term under the law, with a likely 10 to 16 months under federal sentencing guidelines. His sentencing date has not been set.
He blogged at turnerradionetwork.blogspot.com that the three judges of the Chicago-based 7th U.S. Circuit of Appeals should be �killed� for upholding a Chicago handgun ban last year.
�Let me be the first to say this plainly: These judges deserve to be killed," the 47-year-old blogger wrote. |

Gunfire erupted Friday afternoon when two suspects attempted to rob a cell phone store in Fairfield and an employee with a gun opened fire in apparent self-defense, according to police.
Officers responded to a reported attempted robbery at a MetroPCS store located at 2023 N. Texas St. at around 3:15 p.m., Fairfield police said.
Witnesses told police that two black men in their early 20s entered the store and one of them pointed a handgun at two employees while the second jumped over the store counter and demanded cash. |

Friends say Pantagraph commenters always claim it�ll be a wild frontier if non-criminal Illinoisans carry legal self-defense firearms. Nonsense. I�ve been to self-reliant, truly wild America, without law enforcement or crime because inhabitants carry guns.
Affiliations, status, education, wealth or lack of it are meaningless. You�re judged by the look in your eye.
I recall in a primitive saloon in wilderness Alaska just south of Yukon River, fishermen, loggers, gold-panners, hunters and trappers discussed guns with me. Rugged alpha men, they exuded manners, politeness, kindness and self-confidence. Outside were stray dogs they all cared for. |

Where are the nearest exits? Gunfire can echo, can you figure out where it came from? You sure don't want to unexpectedly be face-to-face with the gunman as you try to escape. Maybe you should hide under your desk? Can you jump out the window? Can you lock your door? What about your coworkers, where are they?
Workplace violence can come from just about anywhere; a customer, coworker, coworkers lover, supplier, or the street. There are sometimes signs that the violence is coming. |

A Martinez man remains in critical but stable condition at the Medical College of Georgia after being shot during a confrontation on the 2000 block of Westfield Drive in Augusta. Authorities say 19-year old Milo Hayes III was shot by Brete Anthony Gunby after Gunby spotted Hayes allegedly attempting to break into a neighbor's truck.
The 39-year-old says he watched Hayes enter his neighbor's truck and that's when he called 9-1-1. He then went outside with a pistol and told Hayes to stay put until the police arrived. Hayes pulled out an object from his pockets and that's when Gunby fired at him, according to the police report. Investigators say the shooting was self-defense. |

A lawsuit filed Monday argues Chicago's latest gun ordinance is unconstitutional.
The suit was filed in federal court by a group known as "The Second Amendment Foundation". They argue that since the ordinance bans gun ranges from operating within the city limits a citizen cannot meet the training requirement needed for gun ownership without leaving the city.
A "Second Amendment Foundation" executive calls it a "catch 22" scenario that discourages Chicago residents from owning a gun. |

The Second Amendment Foundation (SAF) today filed a lawsuit in federal court against the City of Chicago's new gun ordinance, asserting that "by banning gun ranges open to the public�under color of law," the city is depriving citizens of their right to keep and bear arms in violation of the Second Amendment to the U.S. Constitution.
Joining SAF in this lawsuit are the Illinois State Rifle Association (ISRA), Action Target, Inc., and three individual plaintiffs including a retired Chicago police detective. Gun rights advocates have filed another lawsuit against the City of Chicago's new handgun ordinance, claiming that it violates the Second Amendment because it doesn't allow shooting ranges for the public.
The lawsuit filed on Monday, claiming that by "by banning gun ranges open to the public� under color of law," the new Responsible Gun Ownership Ordinance violates the constitutional right to keep and bear arms.
Two gun rights advocacy groups � the Second Amendment Foundation, the Illinois State Rifle Association � filed the lawsuit, along with shooting range equipment maker Action Target Inc. and three individual plaintiffs.

Charleston police are hoping a new approach toward taking more firearms off the streets will lower the number of gun crimes in the city.
Chief Brent Webster outlined the department's new multi-faceted strategy, called "Project Gun Safe," on Monday. The goal of the project is to reduce gun crimes, to promote officer and public safety and to educate and involve community members on personal firearm responsibility. The project includes monetary incentives up to $100 for informants and for those wanting to turn in unwanted guns.

"We want to ask the citizens of Charleston to properly inventory and secure their firearms," Webster said. "It's a completely voluntary thing." |

In what may be one of the more craven legislative acts to be committed by a local government entity in my memory, the city commissioners of Royal Oak are set to repeal their own wise and responsible ordinances prohibiting the open carrying of side arms in such venues as street festivals. There�s one such scheduled for Labor Day weekend in Royal Oak.
This means that the honorable commissioners have been cowed by the Open Carry lobby whose members swagger about with long, ugly pistols clipped to their belts just daring someone to object to the exercise of their Second Amendment right to keep and bear arms. Only they are not members of a �well-regulated militia.�

Gun owners will be able to openly carry their weapons at next month's Ford Arts, Beats & Eats festival in downtown Royal Oak.
Officials lifted the gun ban after hours of public comment on Monday night.
On one side were gun-rights activists who pointed to state law that allows them to openly carry their guns. On the other side were residents and families worried about safety.
The festival, expected to draw tens of thousands to Royal Oak over Labor Day weekend, is now ground zero for the gun debate in Michigan. |

A minister�s fight to bring a gun to his Upson County church is now a federal case in Macon.
State and Upson County officials had the case moved to the U.S. District Court in Macon on Friday. The case garnered national news coverage when it was first filed a month ago in Upson County Superior Court by the Rev. Jonathan Wilkins of the Baptist Tabernacle of Thomaston, which is partnering with GeorgiaCarry.org Inc. on the lawsuit. Wilkins said he has a constitutional right to be armed in church, which is now prohibited under state law.
... Wilkins� attorney, John R. Monroe of Roswell, said the case depends more on Wilkins� First Amendment right to freely worship than his Second Amendment right to bear arms.

Several people spoke out about an ordinance would ban Taser use by both private citizens as well as law enforcement. The ordinance was unanimously voted down moments ago by the Council and will be decided by voters during the Nov. 2 elections.
People for a Taser-Free Columbia spokesman Ken Green said Tasers are a type of cruel and unusual punishment and said the city should worry about possible lawsuits filed by Taser victims.

Columbia resident Bryan Vanderhoof argued that Tasers are protected under the 2nd Amendment of the U.S. Constitution as a weapon that should be allowed for self defense. He clarified that if a Taser is used irresponsibly or in excess, then of course the user should be punished. |

A Henderson man who allegedly took matters into his own hands and shot at two teens throwing eggs at his truck has been arrested and charged with attempted murder, Henderson Police said.
Officials said Christopher Brunelle, 22, called 911 at about 11:50 p.m. Sunday and said he fired two shots at a Jeep Cherokee after its occupants had thrown "projectiles" at his truck. Brunelle was sitting in his truck in front of his Dalsetter Drive home ... at the time of the incident, police said.

Henderson Police urged residents to call authorities about vandalism before acting on their own.
"Self-defense cannot be used when a threat no longer exists or there was not a real or perceived threat," police said in a statement. |

Convicted bank robber and disgraced cop Christopher Kerins had a tough time convincing the teller he meant business when he pulled his latest heist in Pennington last week, according to a federal complaint released yesterday.
The 53-year-old former Trenton undercover detective, who spent time in federal prison for a string of local armed bank robberies in the mid-1990s, is accused of the Aug. 8 robbery of a TD bank on Route 31.
According to documents released yesterday, Kerins approached a teller, told her he had a gun and demanded she put money in the plastic bag he handed her. She thought he was joking. |

Only months after the Supreme Court struck down the city's restrictions on guns, Chicago is the target of a new lawsuit because it now requires gun owners to practice at gun ranges but bans the ranges themselves.
"While the city has adopted new regulations that make it legal to own handguns," said Alan Gottlieb, executive vice president of the Second Amendment Foundation, "they have crafted this new ordinance to make it virtually impossible for prospective gun owners to meet all legal requirements unless they travel outside the city for mandatory training. The new ordinance prohibits public gun ranges inside the city yet the city demands that handgun owners get at least one hour of range training time." |

The case for Sharpton as a hero in the wake of the arrest of Bernhard Goetz is even more preposterous. By any reasonable definition, Goetz had acted in self-defense when he shot four young menacing blacks who had surrounded him in a New York City subway car on the afternoon of Dec. 22, 1984. His "victims" - Barry Allen, Troy Canty, James Ramseur and Darrell Cabey - already by then had amassed a combined nine criminal convictions. Two of the "unarmed" youths, moreover, were packing sharpened screwdriver shanks. Their intent, as Cabey himself admitted at Goetz's civil trial, had been to rob Goetz. To describe Goetz, a mild-mannered white electronics repairman, as having "opened fire" on these criminals is true only in the narrowest sense. |

Add Ronnie to the list of "Jersey Shore" stars who have been arrested. Sammi's ex-bf was picked up by the Seaside Heights Police Department Sunday morning, RadarOnline.com has confirmed. An unmarked car pulled up to the Jersey Shore cast house Sunday morning and officers took Ronnie into custody without incident and without using handcuffs. In a statement to RadarOnline.com, the Seaside Heights PD described the arrest of Ronald Ortiz, age 24, of Castle Hill Avenue, Bronx, NY.
