Charges Dropped Against Paul Lathrop. His Story

Paul Lathrop was arrested last February. Paul was accused of brandishing a firearm and making terroristic threats at a Nebraska truck stop. All charges were dropped earlier this week. Thank you to the many friends who helped fund Paul's defense. Here is what we can learn.

Win the race to the phone.
Have self-defense "insurance".
Don't expect "justice" from our legal system.

The prosecuting attorney in Nebraska would have happily prosecuted and convicted an innocent man. The only way that justice was done was because a few hundred of us helped Paul pay for his defense. You only get the justice you pay for.

First, to the extent that anyone is actually drawing a parallel between laws regulating �cocks� and �Glocks,� they�ve lost their legal minds. Anti-obscenity laws are in the category of offenses against �public indecency.� They�re not declaring what�s �unsafe,� but rather what�s �indecent,� and their enforcement is heavily restricted by the First Amendment. There are multiple reasons why no one is prosecuting the protesters for waving their dildos � it�s protected speech, and it�s almost certainly not even unlawful under the statute they abhor.

Ed.: Actually, had they had this demonstration in a jurisdiction not as sexually tolerant as Austin, such as most anywhere else in Texas, they would have been arrested for indecency.

And it�s easy, no doubt, for Hillary Clinton to turn a blind eye to the ravages of crime when she has her own, personal, armed security force. Now she wants to essentially dismantle our Second Amendment. I think the first thing she should do is call up Washington and immediately request that her great Secret Service agents drop all weapons�let them walk around with no weapons�and let�s see how she feels about that when she wants to take away your guns.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) recently released a report highlighting state-by-state ownership of guns regulated under the National Firearms Act (NFA) of 1934.

Firearms and accessories covered under the NFA (hereafter: NFA-registered firearms) include machine guns, short-barreled rifles, short-barreled shotguns, silencers/suppressors, certain explosive devices, etc.

What I was saying, and I just need to repeat myself I guess, is that Weld himself made it pretty clear in an interview with Reason's Nick Gillespie that he's aware that banning "assault rifles" now would be a bad idea. And the presidential candidate Gary Johnson has been pretty good on gun policy and gun culture questions, though I question his lack of desire to roll back any existing federal gun law.

Ed.: If the best the LP can do is no better than the Rs, then there is no benefit to even having them around at all.

About 96 percent of �initial denials� are dropped after the first two stages of review. Many more are dropped during the three remaining stages. But the Obama administration no longer conducts those reviews, which means nearly all initial denials are likely still mistakes � they�re just never corrected.

Eventually applicants used to be able to get their gun, though the delay could be dangerous for someone who needs a gun for self-defense. Now, however, most applicants are forced to appeal their denial, and will likely find it necessary to spend thousands on an attorney to do so.

In Cleveland, Ohio, an armed suspect attempted to rob the Family Dollar on West 117th and Bellaire Avenue.

The robber walked in around 3 PM on Sunday and announced the hold up.

An armed customer drew his own pistol and told the robber to drop the gun. Shots were exchanged between the robber and armed citizen. The robber was hit in the head and transported to Metro Health Medical Center. His condition was unknown as this is written.

Chris Christie yesterday vetoed a bill that would have required New Jersey gun dealers to carry at least one �smart gun� for sale. Christie used a pocket veto, which means the Democratic legislature cannot override it.

Smart guns have been developed by several different sources, but are not yet for sale in the U.S. A smart gun can only be fired by an authorized user (though some smart gun tech has a way for authorized users to override that and allow anyone to fire it). The New Jersey Institute of Technology�s smart gun prototype uses �dynamic grip� technology to prevent anyone else from firing it. NJIT�s smart-gun project was begun at the behest of the state, but was eventually killed.

A new law was passed that allows students and employees 18 and older to carry stun guns and tasers on Georgia public college campuses.

House Bill 792 was proposed by House representative Buzz Brockway as an alternative to the Campus Carry bill that would have allowed guns on college campuses. Governor Nathan Deal vetoed the Campus Carry bill in March.
According to Maura Copeland, associate vice president for legal affairs, electroshock devices have been removed from the definition of prohibited weapons on college campuses.

The number of donated adult entertainment devices outnumbered attendees at the Cocks Not Glocks rally against campus carry at the University of Texas on Wednesday.

The crowd was described as �several hundred� which by any account falls a skosh short of the 10K people who signed up as �attending the event� on Facebook.

The event, which has been planned for months and promised to be the largest anti-gun rally in Texas history was built on the basis of absurdity in an effort to chastise the concept of lawful concealed carry on campus, which went into effect on Aug. 24 at the start of the Long Session.

By all accounts, the event was peaceful and campus officials felt there was no need for increased police presence.

Of the two candidates vying to become Vermont�s next governor, one has a position that could cause many of the state�s gun shops to go out of business.

Democrat Sue Minter wants to ban semiautomatics. The gubernatorial candidate and native of Bryn Mawr, Pennsylvania, has said so repeatedly in interviews and out on the campaign trail.

�I also, after the tragedy in Orlando, have stepped forward to say we also need to ban assault weapons,� Minter said in a radio appearance on VPR�s Vermont Edition.

Less than three months before the November elections, Americans for Responsible Solutions (ARS) has thrown its support behind Senators Pat Toomey of Pennsylvania and Mark Kirk of Illinois. They were among four Republican senators who in the wake of the December 2012 mass shooting at Sandy Hook Elementary School in Newtown, Connecticut�where 20 children and six educators were killed�voted in support of a bill designed to prevent felons, domestic abusers and other individuals who might pose a risk to public safety from obtaining firearms at gun shows and on the internet.

This is a wonderful new development, but it�s up to us to keep Christie�s feet to the fire on this. NJ2AS is calling on Governor Christie to veto every single bill that comes to his desk until the legislature passes a shall-issue concealed carry bill and sends it to his desk to be signed. Before you say this is extreme, Governor Arnold Schwarzenegger of California did the exact same thing to the California legislature when it refused to reform its budgetary problems and again until he got his way on a water reform bill.

As the possibility of a 3D printed gun hit the internet a few years ago, it was met with immediate attention. It was almost as if an electrically charged hush fell over the pro-gun crowd while they bit their lips in anticipation. For the third year, the Mississippi Second Amendment Weekend will save shoppers money on firearms, ammunition, archery equipment, and select hunting supplies.

The tax-free sale starts Friday at 12:01 a.m. and ends at midnight Sunday.

WLOX-TV reports Gov. Phil Bryant said the tax holiday was created to celebrate Mississippi's great outdoor heritage.

The law creating the tax-free weekend went into effect on July 1, 2014.

My questions for the New Jersey Republican Party at this point with the Governor now taking this new stance is: WHAT authority does the Governor have to issue an Executive Order which will make New Jersey a �Shall Issue� State and does the Governor have the authority to enforce the US Constitution by requiring Police Chiefs in New Jersey and the Attorney General to recognize definitions which are consistent with the US Constitution�s Second Amendment�s plain and clear language?

Some people may claim this idea represents �executive overreach� however the reality of such an Order would be the complete opposite. Such an order would actually limit government overreach.

On August 23 author and Conservative Leaders for Education chairman William Bennett warned that the Second Amendment will be a �primary target� of the Supreme Court if Hillary Clinton is elected to the presidency.
He pointed out that Clinton will �appoint a dyed in the wool liberal to fill Antonin Scalia�s seat, thereby giving liberals a strong five-person majority on the Court.� And that court will then happily seize opportunities to reverse decisions that have bolstered the Second Amendment during the last two decades��decisions like District of Columbia v Heller (2008) and McDonald v Chicago (2010).

But the fact of militarization gets lost in the rubric and ritual following our routine gun carnage that has become all-too-banal, with over 30,000 U.S. gun-related deaths annually in recent years. And while news coverage digs into questions of why � the killer's motive, background, and circumstances � we hear less of the more pragmatic how. What kinds of guns were used? Make, model, caliber? Who was the maker? The dealer?

Again, not all guns are alike. There's a vast difference in speed and firepower between traditional hunting and sporting rifles and AK-47s, between small caliber pistols and semiautomatic Glock 17s. Killing more in a shorter time, these assault weapons are murderously more efficient.

Some of you have seen the reports about some mayors in Indiana wanting to repeal the preemption law that was passed in 2011.

If your mayor is one of them you might want to contact and let them know your position on the matter and the Second Amendment. Make your play.

I wonder how many gun owners in Indiana are even aware of the legislation that was passed in 2011 that took away the ability for local government to suffocate the Second Amendment in Indiana.
