Evidence in the fatal shooting of an intruder by the owner of a southeast Houston business early today probably will be referred to a grand jury without charges, police said.
The shooting happened after the victim, whose name has not yet been released, jumped a fence and entered a tire business in the 4500 block of Telephone Road about 4 a.m. today, police said.
The owner of the business, who lives on the property with his family, armed himself and confronted the intruder, who was shot in the head and died at the scene of the shooting.

The Bureau of Alcohol, Tobacco, Firearms and Explosives is offering a reward of up to $2,500 for information leading to the arrest and conviction of the person or persons responsible for the Aug. 31 burglary of 13 handguns from the Gone For a Day sporting goods store in Elderton.
Anyone with information can contact the agency at 1-800-ATF-GUNS.
In addition, anyone wishing to anonymously surrender any of the firearms can also call that number.
